BOARD MEETING MINUTES – May 17, 2013

Present: Alan Goodman, Ph.D., LCMHC, Shawn Hassell, MS, LMFT, David Sundell, D.Min., LPP, Kim Spencer, MSW, LICSW, Deborah Warner, Ph.D., LP, Honorable Joseph P. Nadeau, Public Member, Jane Power Kilcoyne, Ed.D. and Kathleen Skinner Shulman, Ed.D., Public Member.

Board meeting was called to order at 9:00 AM. The meeting was held at the Board of Pharmacy, 57 Regional Drive, Concord, NH.

Upon the motion of David Sundell and seconded by Alan Goodman, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing applications, investigations of alleged misconduct of licensees, final disciplinary action and other adjudicatory decisions, in accordance with RSA 91-A:3, II (c), RSA 91-A:3, II (e), RSA 91-A:5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), RSA 330-A:29, V, and the Board’s executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

Upon the motion of Deborah Warner and the second of Kim Spencer, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, and CEU’s for Professional Conduct Investigators from public disclosure pursuant to RSA 91-A:3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a Board member and to render the proposed action ineffective. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

III. DOCKET NO. 13-001 – Sandra Clark, MSW

A. The Board approved a Voluntary Surrender of License for Sandra Clark, MSW,license#298. A copy of the Voluntary Surrender is posted on www.nhlicenses.nh.gov.

Public session resumed.

Draft minutes of the April 26, 2013 meeting were reviewed by the Board. Motion was made by Alan Goodman and seconded by David Sundell to approve the minutes as recorded.

I. CORRESPONDENCE

A. Sobin, Jonathan, Psy.D. – tabled from April 2013. Dr. Sobin, licensed psychologist in NH, withdrew his request for written confirmation from the Board stating it has no objection to him continuing to provide care for patients in NH via teletherapy when he moves to Florida.

B. Stevenson, Kevin, MS, Administrator , Secure Psychiatric Unit, DOC, Co-Chair State Suicide Prevention Council Public Policy Subcommittee – The Board reviewed a letter from Mr. Stevenson asking it to consider amending NH Administrative Rule Mhp 402 to require all licensees obtain a minimum of 3 CEU’s pertaining to the appropriate and ethical treatment of individuals who are suicidal. Motion was made by Alan Goodman and seconded by Jane Kilcoyne to consider Mr. Stevenson’s request when the Board works on rule changes.

C. Libby, Melissa – The Board reviewed a letter from Ms. Libby stating that she is enrolled in a 100% online MSW program at the University of NE and recently found out that NH Administrative Rules require a minimum of one academic year of full-time graduate study in social work be completed in residence at the institution granting the master’s in social work degree. Motion was made by Alan Goodman and seconded by Jane Kilcoyne to send a letter to Ms. Libby explaining that applicants for licensure must comply with the NH Administrative Rules The Board cannot give blanket approval to specific programs and refer her to Mhp 302.12 through Mhp 302.15.

D. Wubbenhorst, Robert – The Board reviewed a letter from Mr. Wubbenhorst, Assistant Director of the MA in counseling program at Union Institute & University located in Brattleboro, VT in which he asked for clarification and possible modification of NH Administrative Rules Mhp 302.16 (c)(d) regarding residency requirements. Motion was made by Deborah Warner and seconded by Shawn Hassell to send a letter stating: 1) the program does not comply with Mhp 302.16 (c)(d), 2) the residency issue needs to be addressed in rule making and 3) individuals can apply for waivers to rules. Motion failed.

Motion was made by Shawn Hassell and seconded by Alan Goodman to inform Mr. Wubbenhorst that the Board is currently engaged in reviewing rules.

II. LEGISLATION UPDATE

A. HB 234 – relative to occupational and professional board and commissions procedures concerning military service and occupational experience or training. As of May 3, 2013 this bill passed the house with amendment and is currently in the Senate

III. DISCUSSION AND REVIEW

A. Board meeting dates – The Board meeting date for December has been changed from December 20, 2013 to December 13, 2013

B. ASWB – ACE program – The Board reviewed information from the Association of Social Work Board’s (ASWB) Approved Continuing Education (ACE) program. Motion was made by Deborah Warner and seconded by Kim Spencer to consider trainings approved by ASWB acceptable for CEU Category A credits. The ACE program was not established when the list of approved sponsors was originally written into rules.

C. BOARD CONSOLIDATION

The Board of Mental Health Practice office will be relocated to the
Philbrook Center, Concord, NH 03301(exact address unknown at this
time) in November 2013.

On July 1, 2013 NH Chapter 329-B, establishing a Board of Psychology,
becomes effective. Licensed psychologists will no longer be regulated by the Board of Mental Health Practice. Beginning July 1, 2013 all matters related to psychologists should be directed to NH Board of Psychology, 129 Pleasant Street, Concord, NH 03301; phone number 603-271-9369.
