BOARD MEETING MINUTES -February 17, 2012

 

Present: Alan Goodman, LCMHC, Shawn Hassell, LMFT, Deborah Warner, LP, David Sundell, LPP, Kim Spencer, LICSW, Kathleen Skinner Shulman, Ed.D., Public Member and Honorable Joseph P. Nadeau, Public Member present by teleconference call as allowed by RSA 91-A:2 III.

Not present: ----

Board meeting was called to order at 9:05 AM.

Pursuant to RSA 91-A III (a) Joseph Nadeau stated that he was 1500 miles away and unable to attend the meeting in person.

Pursuant to RSA 91-A III (e) all votes taken during the meeting were by roll call vote.

Draft minutes of the January 20, 2012 meeting were reviewed by the Board.

Motion was made by Alan Goodman and seconded by Deborah Warner to approve the minutes as recorded.

I. CORRESPONDENCE

A. John J. Randolph, Ph.D., ABPP – The Board reviewed a letter from Dr. Randolph on behalf of the New Hampshire Psychological Association’s concerns about how the Board handled the issue of recusals and professional Board member substitutions at its November 18, 2011 meeting. The Board reviewed a draft response. Motion was made by Joseph Nadeau and seconded by Alan Goodman to send a letter to Dr. Randolph which states that the Board ensures the presence of same guild members in an investigation, deliberation and adjudication of a complaint.

B.Joanne Linden, Ed.D. – The Board reviewed a letter from Dr. Linden in petitioning the Board to amend administrative rule Mhp 302.04 (k)(2)c. She recommends the Board amend the rule to reduce the number of psychologists required at an organized training agency from two to one. Motion was made by Joseph Nadeau and seconded by David Sundell to send a letter to Dr. Linden informing her that the Board will refer her suggestion to the preliminary committee to review administrative rules formed at its January 20, 2012 meeting.

C.Annamarie T. Cioffari, Ph.D. – The Board reviewed a packet of information from Dr. Cioffari regarding the graduate program in community mental health and mental health counseling from Southern New Hampshire University. Dr. Cioffari and Dr. Julie Welkowitz, representatives of SNHU, were present at the meeting. Motion was made by Joseph Nadeau and seconded by Alan Goodman to send a letter to Dr. Cioffari explaining that the Board does not pre-approve specific programs or coursework.

D.Alan Gladsden, Ph.D. – The Board reviewed Dr. Gladsden’s consent decree dated March 23, 2010 to determine whether or not he is in compliance with the decree. Motion was made by Joseph Nadeau and seconded by Deborah Warner to send a letter to Dr. Gladsden informing him that, after review of the above-referenced consent decree, it appears that he is not in compliance with the decree and his license remains restricted.

II. LEGISLATION UPDATE

A. SB 343-FN – establishing an independent board of psychologists- passed senate committee.

B. HB 1173 – relative to complaints against psychologists – due out of committee 2/23/2012

C. HB 1338 – failure to renew a professional or occupational license – due out of committee 2/23/2012

D. SB 407-FN – establishing an office of professional licensure and transferring administrative and clerical operations of certain professional licensing and certification boards to the office. – introduced and referred to finance committee

E. HB 1508 – relative to procedures of the board of mental health practice – due out of committee 3/22/2012. The Board reviewed and discussed a draft amendment to HB 1508. Motion was made by Joseph Nadeau and seconded by David Sundell to send a letter to Representative Kenneth Hawkins stating that the Board does not support HB 1508 in its present form and refers the committee to its letter of January 2012 regarding HB 554.

III. DISCUSSION

A. Tele-practice – The Board reviewed a draft statement on “tele-practice.” Motion was made by Deborah Warner and seconded by Alan Goodman to change the title of the statement to “out-of-state practice” add a notice to consumer line and post on the Board’s website. The statement reads as follows:

In light of the recent queries posed to the Board concerning out-of-state-practice, practice via the internet, practice through the use of videoconference, and via other technologies, the Board clarifies as follows:

Out-Of-State-Practice
Pursuant to NH RSA chapter 330-A

If you are located in New Hampshire and are providing mental health services to a consumer located in another jurisdiction, you are considered to be practicing in New Hampshire and need to be licensed in this State.

If you are located in another state and are providing mental health services to a consumer located in New Hampshire, you are considered to be practicing in New Hampshire and need to be licensed in this State.

In either case, you might also be considered to be practicing in another jurisdiction. This statement is not intended to interpret the laws of any other state.

NOTICE TO CONSUMERS – If you are about to engage in therapy with a mental health provider in New Hampshire you would be advised to contact the Board of Mental Health Practice to check if the provider is licensed in New Hampshire (603-271-6762) or check on line at www.nhlicenses.nh.gov.

B Right-To-Know Law – an update to the right to know law was distributed to Board members

C. Reference form from Supervisor for license application – as stated on the application information for licensure directions, “at least one (1) professional reference form shall be from a supervisor.” The Board discussed whether or not this form needs to be completed by a current supervisor. The answer is no. It may be from a current or former supervisor.

Upon the motion of David Sundell and seconded by Deborah Warner, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing applications, investigations of alleged misconduct of licensees, final disciplinary action and other adjudicatory decisions, in accordance with RSA 91-A:3, II (c), RSA 91-A:3, II (e), RSA 91-A:5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), RSA 330-A:29, V, and the Board’s executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

Upon the motion of Deborah Warner and the second of Shawn Hassell, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, and CEU’s for Professional Conduct Investigators from public disclosure pursuant to RSA 91-A:3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a Board member and to render the proposed action ineffective. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

III. PROFESSIONAL CONDUCT INVESTIGATORS

A. Mary McCrae, Ph.D. – Professional Conduct Investigator, Mary McCrae, was awarded 20 continuing education hours for completing a Report of Investigation for the Board.
