BOARD MEETING MINUTES – November 16, 2012

Present: Alan Goodman, Ph.D., LCMHC, Shawn Hassell, MS, LMFT, David Sundell, D.Min. LPP, Kim Spencer, MSW, LICSW, Deborah Warner, Ph.D., LP, Honorable Joseph P. Nadeau, Public Member, Jane Power Kilcoyne, Ed.D. Public Member.

Not present: Kathleen Skinner Shulman, Ed.D., public member

Board meeting was called to order at 9:00 AM.

Upon the motion of Kim Spencer and seconded by David Sundell, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing applications, investigations of alleged misconduct of licensees, final disciplinary action and other adjudicatory decisions, in accordance with RSA 91-A:3, II (c), RSA 91-A:3, II (e), RSA 91-A:5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), RSA 330-A:29, V, and the Board’s executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

Upon the motion of Jane Kilcoyne and the second of Deborah Warner, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, and CEU’s for Professional Conduct Investigators from public disclosure pursuant to RSA 91-A:3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a Board member and to render the proposed action ineffective. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

C. Marriage & Family Therapists: Frazier, Jason

D. Psychologists: Kate Vaillancourt, Elizabeth Mezick and Ashley Lambert.

E. Pastoral Psychotherapists: no agreements for review this month


A. Bates, Fred, LCMHC – Decision and Order – license suspended until further order after the investigation into the merits of the pending complaints against Mr. Bates are completed and resolved.

B. Gagne, Frances, LICSW – Settlement Agreement – Reprimand


A. Professional Conduct Investigators – The Board issued a certificate for 20 continuing education ethics credits to Professional Conduct Investigators Nancy Davis, LICSW and Ann Wadsworth, LICSW for their work on reports of investigation reviewed by the Board.

Public session resumed.

Draft minutes of the October 19, 2012 meeting were reviewed by the Board. Motion was made by Jane Kilcoyne and seconded by Alan Goodman to approve the minutes as recorded.

A. HB 1508 – discussion of the implementation of this bill will be on the December 14, 2012 public agenda

II. CORRESPONDENCE – no correspondence this month


A. Corrective Supervision Manual – an updated draft manual will be reviewed at the December 14, 2012 meeting

B. Title change for Order of Formal Investigation – draft order will be reviewed at the December 14, 2012 meeting.

C. Encumbered vs. Restriction – definition as it relates to Settlement Agreements not yet completed will be discussed at the December 14, 2012 meeting.


A. Work continues on possible rule changes. Mhp 200 and Mhp 300 were discussed at length. Additional information regarding Mhp 301.02 will be presented for discussion the December 14, 2012 meeting.
