RULES OF THE SUPERIOR COURT OF THE STATE OF NEW HAMPSHIRE

APPROVAL OF LUMP SUM SETTLEMENT IN WORKMEN'S COMPENSATION CASES


    167. All petitions for approval of lump sum settlements shall include the following:

        (a) A brief description of the accident and of the injuries sustained;

        (b) A complete medical report, together with a current detailed prognosis;

        (c) An itemized list of all medical expenses, indicating whether the same have been paid, and if so, by whom;

        (d) Dates and total amount of compensation paid;

        (e) The amount of counsel fees, which shall be subject to Court approval;

        (f) The total amount of settlement and net amount to be realized by the claimant; and

        (g) A prayer requesting approval of the settlement.

    The attorney and claimant will ordinarily be required to appear in support of the petition.

    An attorney's fee in excess of 25% of the settlement will not be ordinarily allowed unless upon good cause shown.
