RULES OF THE SUPERIOR COURT OF THE STATE OF NEW HAMPSHIRE

PRESENCE OF COUNSEL DURING JURY DELIBERATION


    114. After a civil or criminal case has been submitted to a jury, and the jury has retired for deliberations, counsel shall not leave the courthouse without permission of the Court. If counsel is absent from the courthouse, with or without permission, when a jury requests additional instructions, such absence shall constitute a waiver of the right to be present during instructions given in response to the request.


    115. In addition to those rules specifically made applicable to criminal matters, the following rules shall also apply to all criminal cases: 6, 9, 15, 16, 19, 21, 22, 37-41, 46-48, 57, 58, 64-71, 78, 79, 80 and 109.
