System-wide Guardian Ad Litem Application, Certification and Practice

CHAPTER II. GUARDIAN AD LITEM GUIDELINES AND STANDARDS OF PRACTICE

Rule 2.4.1. Competence


    (a) A GAL shall provide competent representation to a child or represented person which shall include at a minimum:

        (1) identification of areas beyond the GAL's competence and bringing those areas to the court's attention;

        (2) proper preparation, promptness, diligence and attention to details and schedules necessary to assure that the matter undertaken is completed with no avoidable harm to the child's or represented person's best interest.

    (b) In the performance of service by a GAL to a child or other represented person, a GAL shall, at a minimum be capable of:

        (1) personally gathering sufficient facts regarding the child's or represented person's family history and current circumstances and concerns of the child or represented person from the child or represented person and from other relevant sources, which shall include the parents of a minor or legal guardian in every case;

        (2) identifying the material issues raised, comprehending generally the legal principles applicable to the child's or represented person's situation, and formulating alternative responses for consideration;

        (3) developing a good faith presentation to achieve results in the best interests of the child or represented person;

        (4) undertaking actions on the child's or represented person's behalf in a timely and effective manner, including, where appropriate, associating with other professionals who possess the skill and knowledge required to assure competent representation and problem solving;

        (5) when ordered, preparing and presenting a thorough and timely report with recommendations to the court; and

        (6) employing impartiality, open-mindedness and fairness while acting in the best interest of the child or represented person.
