When a stenographer is employed by
either party in a contested case to make a record of the proceedings, the
stenographer is under the direction of the Court during the proceedings.
The fee for the service performed shall be a charge against the party employing
the stenographer. However, when a defendant in a criminal proceeding is
indigent and represented by a public defender or court appointed counsel, the
fees for the stenographer's services in making and transcribing the record, and
providing copies, shall be at the rate allowed by statute.
