NHJB-2081-FP (10/01/06) (Formerly AOC-082SA-003) Department of Health & Human Services or Agency Surrender of Parental Rights If the Department of Health and Human Services, or a child-placing agency, has through court action or parental surrender been given care, custody and control of an adoptee, the department or agency must complete this form to surrender their rights to the adoptee.   The form specifies the rights being surrendered and the continued legal relationship with the child until a final decree of adoption is issued. NHJB-2119-P (10/01/06) (Formerly AOC-007-003)  Appearance or Withdrawal Any person, who has an interest in a case, must file an appearance in order to file any pleadings and receive any notifications regarding the case from the court.   A withdrawal is filed when the person no longer wishes to receive information about this case. NHJB-2120-P   (10/01/06) (Formerly AOC-009-003)  Appointment of Resident Agent This form is used when an executor or administrator, guardian, trustee or conservator resides outside of New Hampshire or plans to be outside the state for more than one year.   In those circumstances, that person must appoint a person who does reside in New Hampshire to serve as his or her agent to receive notice of claims against the estate or other legal documents. NHJB-2121-P   (10/01/06) (Formerly AOC-011-003)  Assent Used to show that the interested parties who are listed in the court’s case file agree with the document being filed with the court.   By signing the assent form, the interested party agrees to the document being submitted and this allows the court to make a ruling on the document without further notification from the court. NHJB-2122-P (10/01/06) (Formerly AOC-011A-003)  Assent for Summary Administration One of the documents required to close an estate using the summary administration process.   By signing this form, the legatees or other persons beneficially interested in the estate, agree that further court supervision for administering the estate is not needed. NHJB-2125-P (10/01/06) (Formerly AOC-044-003)  Inventory of Fiduciary Used to show the court the details of the assets of an estate, whether for an estate administration, guardianship, conservatorship or trust.   It should contain an itemization of real and personal properties and their values, and be signed by the appraiser appointed on either the Petition for Estate Administration, Petition for Trustee, Petition for Guardian of Minor, Petition for Conservatorship or Petition for Guardianship of Incapacitated Person. NHJB-2126-P (10/01/06) (Formerly AOC-058A-003) Return of Sale This form must be filed whenever the executor, administrator, guardian or conservator has been issued a license to sell, and the real estate has been sold.   File this form with the court within one year of the sale of the deceased’s real estate or timber and wood. NHJB-2127-P (10/01/06) (Formerly AOC-073A-003) Notice to Surviving Spouse, Legatees, Heirs at Law and Return of Notice This form is completed by the executor to notify each individual or entity named in the will that they appear to have an interest in the deceased’s estate.   It is also intended to advise each individual or entity that the court has allowed the will and whom the court has appointed to manage and settle the deceased’s estate. NHJB-2130-P (10/01/06) (Formerly AOC-094-003) Motion to Prove Will by Deposition Used to ask the court to appoint a notary public to act as a commissioner to take the deposition of a witness to the execution of a will or codicil.   It is used when none of the witness to the will or codicil can appear in court to answer questions about what happened when the will or codicil was originally signed by the deceased. NHJB-2131-P (10/01/06) (Formerly AOC-095-003) Motion for Order of Distribution This form is used to ask the court to allow the fiduciary to distribute estate funds, whether as an interim distribution or a final distribution.   Funds should not be distributed until the motion has been granted by the court. NHJB-2136-P (10/01/06) (Formerly AOC-120-003) Motion and License to Sell Real Estate to Pay Demands Used when the estate executor or administrator wants to obtain a license to sell the deceased’s property in order to pay any estate debts or claims against the estate. Instructions
NHJB-2137-P (10/01/06) (Formerly AOC-1222-003) Fiduciary Bond This form is required when the probate court has ordered the executor, administrator, guardian, conservator or trustee   to file a bond without sureties.   In it, the fiduciary promises the court that he or she will replace any funds up to the amount of the bond in case of the fiduciary’s neglect or wrongdoing in fulfilling the fiduciary’s duties.   This bond protects the estate’s beneficiaries. NHJB-2139-P (10/01/06) (Formerly AOC-136-003) Receipt This form is used when an executor or administrator distributes the assets of an estate.   Each person receiving something from the estate, whether money or something else, must sign a receipt for his or her share of the estate.   The original receipt must be filed with the court. NHJB-2140-P (10/01/06) (Formerly AOC-138-003) Resignation of Fiduciary Used when the executor, administrator, guardian, conservator or trustee appointed by the court can no longer manage the estate.   The court must be notified if the executor, administrator, guardian, conservator or trustee wants to make this change. NHJB-2141-P (10/01/06) (Formerly AOC-148-003) Petition for Small Estate Administration This form is   used to ask the court to appoint the petitioner to serve as the administrator for the estate.   The estate must involve only personal property with a total value of $10,000 or less.   A Small Estate Administration may not be used if the deceased owned real estate of any value (other than by joint tenancy) or if the date of death is on or after 01/01/06. NHJB-2142-P (10/01/06) (Formerly AOC-150-003) Notice to Town and Cities Pursuant to RSA 554:18-a This form is required to notify towns and cities when the deceased’s property is passed to someone else through inheritance or conditions of a will.   The form must be filed with both the town/city where the property is located and the probate court, prior to filing the final account. NHJB-2143-P (10/01/06) (Formerly AOC-203-003) Statement of Voluntary Administration This form is required to close a small estate by summarizing all assets and income received and all expenditures made during the course of administering the estate.   The form must be filed no earlier than 60 days nor later than 90 days from the court’s approval of the Petition for Small Estate Administration (NHJB-2141-P). NHJB-2144-P (10/01/06) (Formerly AOC-215-003) Waiver of Full Administration Affidavit This form is only used to complete the Waiver of Administration.   The form must be filed between 6 and 12 months after the executor or administrator was appointed. Instructions

NHJB-2146-P (10/01/06) (Formerly AOC-224-003) Affidavit of Counsel as to Propriety of a Foreign Will / Codicil to be Admitted into Probate This form is used when a will or codicil is being probated in New Hampshire but the will or codicil was written in another state or in a foreign country.   The form must be completed by an attorney who is stating that the will was properly executed according to the state or foreign laws in effect where and at the time the will or codicil was written. A legatee or devisee is a person, charitable organization or living trust named in the will to inherit personal or real property.   (This form should not be used if the deceased died prior to January 1, 2003.) NHJB-2167-P (10/01/06) (Formerly AOC-213-003) Investment Certification Used in some guardianship of minor cases when the bond and annual accounts have been waived.   The form certifies that the investment company or bank has flagged the account so that monies may not be withdrawn without approval of the court.
