Civil Mediation in the Superior CourtThe Judicial Branch Office of Mediation and Arbitration offers dispute resolution processes in Superior Court cases. Currently, in the Superior Court, Rule 170 requires that parties in all civil cases make an ADR election among the following choices: neutral evaluation, mediation, and arbitration. The choice is made by counsel at the case structuring conference along with a determination when the ADR process shall occur. The Supreme Court is now considering changes to mediation and arbitration rules that have been approved by the the Advisory Committee on Rules. (See Appendix O).
