ENFORCEMENT*

Discipline
has been imposed upon the Professional Geologist license of
an out-of-state individual for violation of RSA 310-A:133,
II (a), (f) and RSA 310-A:133, III, (a) (c).
This conduct
constitutes grounds for disciplinary sanctions.

The
Respondent was notified by letter on March 7, 2006 that
he was chosen by random audit to participate in the
Board’s 2006 audit of licensees for compliance with
continuing education requirements per administrative
rule Geo 403.01, 403.02. The Respondent was instructed
to provide proof to the Board of 12 Continuing Education
Hours claimed on his last renewal by Friday, April 28,
2006.

The
Respondent failed to respond to the Board’s repeated
requests for information regarding his compliance with
continuing education requirements in violation of Geo
RSA 310-A:133, II (f) and administrative rule Geo 501.02
(b), 501.03 (j) (3) which requires licensees to
cooperate with requests for information from the Board
or Board representatives.
THEREFORE, IT IS ORDERED that misconduct described
above is found to be in violation of RSA 310-A:133, II
(a), (f) and RSA 310-A:133, III, (a) (c). The
Respondent's license to practice geology in the State of
New Hampshire shall be suspended per RSA 310-A:135, V
(a) until such time as the following conditions are met:
1.
The Respondent shall provide proof satisfactory to the Board
of compliance with the continuing education requirements of
his 2004 license renewal by January 1, 2007; and
2.
The Respondent shall provide a satisfactory explanation to
the Board of his failure to cooperate with the Board’s 2006
audit of continuing education compliance.
If the
Respondent does not satisfy the conditions outlined above
his license to practice Geology in the State of New
Hampshire shall be permanently revoked per RSA 310-A:135, V
(a)
Once the
Respondent satisfies the conditions outlined above, his
license to practice Geology shall be in force subject to the
following restrictions:
1.
The Respondent shall provide proof of compliance with the 24
continuing education hours required for his September 31,
2006 renewal;
2.
The Respondent shall upon payment of the applicable fees,
sit for and successfully pass the Fundamentals of Geology
and Practice of Geology Exams.
3.
The Respondent shall furnish a copy of this Decision and
Order to any licensing, certificating or credentialing
authority to which he may apply for privileges or to any
employer for two years from the effective date of licensure.
A Copy of
this Decision and Order will be sent by the Board to any
licensing, certificating or credentialing authority to which
the Respondent has indicated that he has held a license to
practice Geology required per administrative rule Geo 402.02
(f).
