BASIC PURPOSE: Develops and administers Board
policies, budget and operating objectives for cases on union representation,
unit determination and unfair labor practice complaints filed by public
employees.
CHARACTERISTIC DUTIES AND RESPONSIBILITIES:

Administers and
coordinates program operations involving the conduct of elections and the
investigation of unfair labor practices.
·
Prepares notices of
elections, sets up ground rules for the conduct of elections and prepares
ballots and voting list of eligible voters.
·
Contacts and appoints
mediators and fact-finders in cases of impasse in public sector negotiations.
·
Prepares and modifies
biennial budget and makes periodic financial reports to the Board.
·
Arranges for meetings
of the Board to hear contested cases requiring unit determinations or cases of
unfair labor practice complaints.
·
Conducts
investigations of unfair labor practice cases, including reviewing charges,
gathering testimonial and documentary evidence, conducting legal research,
legal writing and presentation of the case for the Board prior to hearings.
·
Drafts proposed
legislation and testifies at legislative hearings and before House and Senate
Fiscal Committees.
·
Prepares records and
exhibits for Supreme Court in litigation cases involving public
employee/employer relations.

DISTINGUISHING FACTORS:
Skill: Requires skill in evaluating, planning
or integrating analysis of data to formulate current and long-range solutions,
strategies or policies of a specialized or technical nature.
Knowledge: Requires logical or scientific
expertise to resolve problems of a specialized or professional nature in a wide
range of applications.
Impact: Requires responsibility for achieving
major aspects of long-range agency objectives by planning short- and long-term
organization goals, reviewing recommendations for procedural changes, and
developing or revising program policies.
Errors at this level result in incorrect decisions at an administrative
level, and are detected subsequent to implementation in an overall evaluation
process.
Supervision: Requires delegating supervisory or
program responsibilities to subordinate managers, with overall accountability
for hiring employees and approving program policies. The supervisor in this position assumes responsibility for
an organizational unit, including developing long-range plans, analyzing
staffing requirements, and formulating systemwide policies and procedures.
Working Conditions: Requires performing regular job
functions in a controlled environment with minimal exposure to disagreeable job
elements and little risk of hazard to physical or mental health.
Physical Demands: Requires light work, including
continuous walking or operating simple equipment for extended periods of time
as well as occasional strenuous activities such as reaching or bending.
Communication: Requires acting as the official
representative of the agency, including explaining and defending current and
long-range goals or objectives which directly affect public policy decisions
regarding major state programs and services.
Complexity: Requires evaluating a combination of
wide-ranging job functions to determine work procedures, to solve problems, and
to reach conclusions by applying analytical, technical, or scientific thinking. This level also requires planning
policies and long-term strategies, drawing conclusions based on available
criteria, and evaluating the effectiveness of program objectives.
Independent Action: Requires administrative decision-making
in authorizing and monitoring the implementation of major departmental policies
and procedures.
MINIMUM QUALIFICATIONS:
Education: Bachelor's degree from a recognized
college or university with major study in business or public administration,
industrial relations, or a related field.
Each additional year of approved formal education may be substituted for
one year of required work experience.
Experience: Eight years' experience required in a
management level position performing administrative, professional, or legal
responsibilities in the area of employee relations, labor relations, or a
related field.
License/Certification: New Hampshire driver's license and
access to transportation for use in statewide travel.
RECOMMENDED WORK TRAITS: Extensive knowledge of federal and
state labor laws. Extensive
knowledge of unfair labor practices. Considerable knowledge of managerial and
confidential employee requirements.
Considerable knowledge of formal hearing procedures, practices and rules
of evidence. Knowledge of
budgeting principles and methods.
Knowledge of effective methods of investigation. Knowledge of collective bargaining
agreements. Knowledge of case law
as it applies to public sector labor relations. Skill in managing others. Skill in interviewing.
Skill in applying research and statistical methods. Ability to organize work. Ability to persuade or compromise. Ability to summarize long reports. Ability to communicate effectively
orally and in writing. Ability to
establish and maintain harmonious working relationships with co-workers, union
and management representatives and the public. Must be willing to maintain appearance appropriate to
assigned duties and responsibilities as determined by the agency appointing
authority.
