NEW HAMPSHIRE BOARD OF DENTAL EXAMINERS

FOR YOUR INFORMATION

A. Dental Records

* New Hampshire RSA 332-I states that the information in a patient's record is the property of the patient. Although the original physical record remains the property of the dentist, the dentist must comply with any request of the patient for a copy of the records or radiographs.

* The intent of the statute is to have the information in the dental record clearly conveyed to the patient or to the patient's new dentist. If the record is difficult to read, a typed or printed version should be sent with the copy. A summary of the record may also be indicated if the record remains confusing. Radiographs are part of the record and need to be readable as well.

A dentist may charge a fee, but the sending of the records or copies is not to be contingent upon payment of that fee. It is also not contingent upon payment of an outstanding balance.
