Meeting Minutes of September 10, 2007
The September 10, 2007 meeting of the New Hampshire Board of Dental Examiners convened at 3:00 p.m. with the following members present:

PUBLIC MINUTES
Hearing – 4:26 PM – Daniel Vasquez, DDS, Docket #07-02
The President of the Board, Dr. Eliot L. Paisner (Presiding Officer) commenced a public hearing pursuant to RSA 317-A:17, RSA 317-A:18 and Dental Administrative Rules Den 206 and Den 210. Board members Ronald J. Hrinda, DMD, Gerald A. Smith, DMD and Stacy A. Plourde, RDH were recused. The issues addressed included the failure of Dr. Vasquez (Respondent) to respond to Board inquiries and his failure to adequately diagnose, treat and monitor his treatment results, as well as respond to his patient’s concerns, in violation of RSA 317-A:17 II (d) and (e), Den 501.01 (a) and Principles of Ethics 1, 2 and 3. Dr. Vasquez plead true to all allegations except one. The Board agreed to amend the one allegation to meet the Respondent’s concern. No further findings of fact were requested by Hearing Counsel or Respondent through his counsel, Attorney Brad Stolzer.
Hearing Counsel presented 12 exhibits. Respondent testified on his own behalf and presented 9 exhibits.
Dr. Paisner closed the hearing at 5:20 PM.

- Rule Proposals
- Nitrous Oxide/Oxygen Administration by Hygienists – Authorized by HB 1671 in 2006. The Board will promulgate a rule to specify how a hygienist can qualify to administer Nitrous Oxide/Oxygen. The Board voted to refer this task to its Conscious Sedation Committee, and will invite Donna Clougherty, Dental Auxiliaries Department Head of the New Hampshire Technical Institute, to take part.
- Rule package 2007-II – These rule amendments address fees and are in the rule making process.
- Board Meetings for 2008 – The Board voted to accept the 2008 schedule.
- Continuing Education Form – The Board voted to accept amendments to the biennial registration form.
- Home Addresses – The New Hampshire Dental Hygienists Association is seeking the home addresses of New Hampshire dental hygienists. The Board voted to table this matter until October to determine the legal issues, if any, and the Board–s options.
- General Practice Residencies – The Board has been asked to address ways to facilitate the admission of dental residents to ADA accredited general practice residencies in New Hampshire. This will probably require a statutory change. The Board voted to refer the matter to its Statutory Committee.
- Access to Care – Representative Kennedy has asked the Board for its input regarding volunteer retired dentists improving access to care. The Board voted to send a letter to Representative Kennedy expressing its support for the concept but also stating that the most significant limiting factors for volunteers are facilities and equipment not liability insurance.
- Conscious Sedation Evaluations – The Board voted to send a follow-up letter to the 3 dentists who did evaluations 5 years ago. The Board has received no reply to last month’s letter asking if they were still interested in doing evaluations.
- AAOMS Guidelines – The American Association of Oral and Maxillofacial Surgeons recommends that dentists be ACLS qualified if they employ physicians, dentists or nurse practitioners from hospital anesthesiology staffs to practice in their dental offices. The Board concurs and voted to amend its rules to make ACLS training a requirement so more capable assistance would be available to the anesthesiologist during an untoward event.

A dentist is proposing to establish a dental assisting school which would meet on Saturdays for 10 weeks. He is seeking Board accreditation. The Board voted to establish an ad hoc committee to study the proposal.
- Fee Waiver
The Board voted to waive the late registration fee for Mahmoud F. Nasr, DDS.
- Foreign Dental Graduates
E. Castillo – The Board voted to deny his request to administer local anesthesia.
* R. Medina – The Board voted to grant permission to perform coronal polishing.
- Interrupted Practice
The Board voted not to waive Den 301.04, the requirements for an active license after a period of non-practice, for Sheila Swartz, RDS and Philip Marcus, DMD.

Members of the Board voted unanimously, unless otherwise indicated.
Members of the Board voted unanimously to go into non-public session for the purpose of discussing investigations of alleged licensee misconduct, noting that such a non-public session is authorized by RSA 91-A:3 and the Board’s executive and deliberative privileges.
