Meeting Minutes of June 4, 2007

The June 4, 2007 meeting of the New Hampshire Board of Dental Examiners convened at 3:00 p.m. with the following members present:

PUBLIC MINUTES

Public Hearing – 3:00 P.M. Dr Hrinda, the Board’s president, presided over a public hearing regarding an initial draft of amendments to the Dental Administrative Rules pursuant to RSA 541-A. Subjects addressed in the rule amendments included licensure, tooth whitening, sedation, voluntary services and the reporting of out-of-state disciplinary actions to the Board. There was no verbal or written testimony from the public. Dr. Hrinda closed the public hearing at 3:05 P.M. The Board voted to submit the public hearing draft of the proposed rule amendments as the text for its final proposal.

Briefing-3:15 P.M. Attorney Catherine Bernhard, Attorney Katherine Cooper and investigator LeeAnne Haney, RDH of the Administrative Prosecution Unit (APU), Consumer Protection Agency briefed the Board regarding the support provided by the APU to the Board. The Board strives to keeps its adjudicative function separate from the investigative and prosecutorial functions of the APU. The Board is greatly appreciative of the support it receives from the APU in furthering the Board’s charge to protect the public.

    1. Statutory Proposals

      1. SB 164 – The Board’s proposed amendments to RSA 317-A were approved by the Governor and becomes effective on July 1, 2007.

    2. Rules

      1. Rule Package 2007-I – The initial proposal was the subject of a public hearing as addressed above.

  2. Academy of General Dentistry (AGD) regarding Continuing Education – RSA 317-A (The Dental Practice Act) requires the Board to adopt rules regarding professional continuing education. Monitoring continuing education is labor intensive and strains the Board’s resources. The AGD has a continuing education form which is customized for New Hampshire. Though not entirely satisfactory, the AGD form will be helpful to the Board when it evaluates the continuing education of general dentists. Specialty dental associations may have similar forms. The Board will address continuing education at it’s next monthly meeting. The Board’s goal is to simplify the reporting and auditing of continuing education while meeting professional and public safety requirements.

  3. Conscious Sedation Evaluation Committee – Every five years, the Board requires an evaluation of dentists who hold a permit to administer conscious sedation. The Board has established a consultant committee to do an evaluation of the facility, equipment, drugs and staff as they relate to the use of conscious sedation in the dental office. The Board will ensure that all evaluations are up-to-date.

QUALIFICATION AND LICENSURE

  1. Anesthesia Evaluation

    The Board voted to accept as successful the evaluation of the oral and maxillofacial surgery practice of Robert C. Kuepper, DDS as it pertains to the administration of general anesthesia and sedation.

  2. Examination Waiver Request

    The Board voted to waive the requirement that the Northeast Regional Board local anesthesia written examination be passed by Justine Anastasoff, RDH before she receives permission to administer conscious sedation. Ms Anastasoff has passed similar exams.

Members of the Board voted unanimously, unless otherwise indicated.

Members of the Board voted unanimously to go into non-public session for the purpose of discussing investigations of alleged licensee misconduct, noting that such a non-public session is authorized by RSA 91-A:3 and the Board’s executive and deliberative privileges.
