Meeting Minutes of May 7, 2007
The May 7, 2007 meeting of the New Hampshire Board of Dental Examiners convened at 3:00 p.m. with the following members present:

The Board voted to approve the minutes of April 2, 2007 as amended.

- SB 164 – The House voted to adopt SB 164 as proposed by the Board.
- Rules
- Eight Year Re-adoption – The Board voted to adopt final proposal 2006-142 containing Den 200 relative to practice and procedure. This completes the Board’s required eight year re-adoption of its dental administrative rules.
- Rule Package 2007 – I – There will be a public hearing in June pursuant to RSA 541-A on changes to the Board’s administrative rules.
- Continuing Education –The Board voted to approve the employment of a licensed New Hampshire anesthesiologist by Gabrill Boustani, DMD, MSD to administer conscious sedation pursuant to Den 304.02. Dr. Boustani will need to apply for a conscious sedation permit.
- New Job Opportunity – The Board’s Administrative Assistant, Tina Kelley, is resigning to take a position as the Administrator of the Board of Allied Health Professionals. Ms. Kelley’s humor, enthusiasm, attention to detail and superb judgment will be very difficult to replace. The Board applauds her promotion and wishes her the very best in her new and challenging position. The Board knows she will do very well.
- Tobacco Secession – The Board received an inquiry from the Academy of General Dentistry (AGD) as to whether dentists in New Hampshire may prescribe tobacco secession products. Pursuant to New Hampshire RSA 317-A:20 a person is practicing dentistry when he/she treats or prescribes for any of the lesions, diseases, disorders or deficiencies of the oral cavity and adjacent associated structures. Tobacco is a major cause of gum disease and oral cancer. Therefore it is appropriate and within the scope of practice of dentists to help patients stop tobacco use. The Board voted to inform the AGD that prescribing tobacco secession products is within dentist’s scope of practice in New Hampshire.

QUALIFICATION AND LICENSURE
- Anesthesia Evaluation
The Board voted to accept as successful the evaluation of the oral and maxillo-facial surgery practice of Mark M. Scura, DMD and Erik Reitter, DDS as it pertains to the administration of general anesthesia and sedation.
- Biennial Registration
- Summary – The biennial registration for dental hygienists went well. Those who were late paid a late fee pursuant to Den 301.06. Some hygienists requested a waiver of the late fee.

Tracy D. Simmons – The Board voted to grant a waiver.
Linda Charon – The Board voted to grant a waiver.

* Jennifer Piper – The Board voted to deny a waiver.
Lynn Von Oldenberg – The Board voted to reduce the late fee.

Members of the Board voted unanimously to go into non-public session for the purpose of discussing investigations of alleged licensee misconduct, noting that such a non-public session is authorized by RSA 91-A:3 and the Board’s executive and deliberative privileges.
