Meeting Minutes of April 2, 2007

The April 2, 2007 meeting of the New Hampshire Board of Dental Examiners convened at 3:00 p.m. with the following members present:

The Board voted to approve the minutes of March 5, 2007 as amended.

PUBLIC MINUTES

HEARING – 4:10 p.m. – George I Enescu, DDS
(Adjudicatory/Disciplinary Proceeding)

The vice president of the Board, Eliot L. Paisner, DMD commenced a public hearing in this matter pursuant to RSA 317-A:17, RSA 317-A:18 and Dental Administrative Rules Den 206 and Den 210. The issue addressed was whether Dr. Enescu failed to meet the requirements stipulated in the Board’s Decision and Order of December 21, 2006, which were to be met by March 5, 2007.

Hearing counsel Katherine Cooper presented no witnesses or exhibits as she reviewed the response of Dr. Enescu to the Board’s December 21, 2006 Decision and Order.

Dr. Enescu represented himself with no other witnesses or exhibits.

Dr. Paisner closed the hearing at 5:20 p.m.

  1. Statutes and Rules

    1. Statutory Proposals

      1. SB 164 – The Senate voted the Board’s bill as "Ought to Pass" and referred it to the House.

    2. Rules

      1. Eight Year Re-adoption – There will be a hearing on Den 200 by the Joint Legislative Committee on Administrative Rules on April 20, 2007.

      2. Rule Package 2007 – I – The Board approved an initial draft of this package of proposed rules. The Board will begin the rule making process.

  2. Continuing Education Form – The Board voted to send a letter to the Academy of General Dentistry (AGD) delineating the ways the AGD continuing education form does not meet New Hampshire requirements.

  3. Conscious Sedation Evaluation Committee – The Board voted to ask the chairman of its consultant Anesthesia/Sedation Evaluation Committee whether the Committee would assume responsibility for the periodic evaluation of dentists administering conscious sedation only. Dentists who use conscious sedation in New Hampshire must follow American Dental Association (ADA) or specialty Guidelines. Guidelines are currently being revised by the ADA.

  4. Scope of Oral and Maxillofacial Surgery

    1. AAOMS Statement of Scope of Practice – Informational.

    2. AAOMS Inquiry – In answer to a question regarding cosmetic facial fillers, the Board voted to refer the AAOMS to RSA 317-A:20 which defines the practice of dentistry in New Hampshire.

  5. Advertising – The Board addressed an inquiry about a proposed advertisement. The Board’s legal counsel advised the Board that the inquiry was a petition for a declaratory ruling and, to be considered, the petition must follow the requirements stated in PART Den 212. The Board voted to inform the petitioner of this and include a copy of PART Den 212 with its letter.

    10. AADE Meeting – Dr. Smith attended this meeting in Chicago on March 26th and the 27th, 2007. He reported to the Board the status of post examination analysis done by various regional examining boards. Much attention has been given to the analysis of the examiner’s performance, usually after the examination. At least one regional board is able to do its analysis of examiners during the examination.

  1. CONSCIOUS SEDATION PERMIT

    The Board declined to issue a permit to John Herring, DDS to administer conscious sedation because the Board needs specific documentation of his training as it conforms to the guidelines of the American Dental Association.

Members of the Board voted unanimously, unless otherwise indicated.

Members of the Board voted unanimously to go into non-public session for the purpose of discussing investigations of alleged licensee misconduct, noting that such a non-public session is authorized by RSA 91-A:3 and the Board’s executive and deliberative privileges.
