Meeting Minutes of February 5, 2007

The February 5, 2007 meeting of the New Hampshire Board of Dental Examiners convened at 3:00 p.m. with the following members present:

The Board voted to approve the minutes of January 8, 2007 as amended.

PUBLIC MINUTES

  1. Statute and Rules

    1. Statutory Proposals

      1. Office of Administrative Hearing – Legislation addressing this issue will not be proposed this legislative session but rather in September, 2007 for the 2008 legislative session.
      2. SB 164 – This bill has been requested by the Board of Dental Examiners. There will be a hearing on Wednesday, February 14, 2007 in room 103 (SH) at 2:00 pm.
      3. HB 170 – This bill would remove dental professionals from the Board to create a majority of public members. A hearing will be held on February 8, 2007 at 9:30 am in room 306 (LOB).

    2. Rule Proposals

      1. Eight Year Re-adoption
        • Den 200 – This section of the Board’s administrative rules deals with legal aspects of Board proceedings. The Board is consulting with several state attorneys regarding amendments.
        • Den 300, 400, and 500 – A final proposal has been submitted for hearing before the Joint Legislative Rules Committee.
      2. 2007-I – This rule package will be addressed as soon as Den 300, 400, and 500 are re-adopted.

  2. Scope of Practice – The Board received an inquiry about updating history and physicals at the hospital level, and whether it is within the scope of practice of a pedodontist. The Board voted to inform the dentist that it is within his scope of practice only if he is fully trained to perform the procedure.

  3. Spring APU Training – The Administrative Prosecutions Unit of the Consumer Protection Agency will conduct a full day training session on board legal proceedings for board members. Several members of the Board will be attending.

  4. Continuing Education Request – The Board voted to give full continuing education credit to a dental hygienist for the study of forensic odontology.

  5. Teeth Whitening Centers – In answer to a question regarding tooth whitening by hygienists, the Board’s rules require that this procedure be done under direct supervision.

  6. Screening system – In answer to a query, the Board voted to inform a dentist that a hygienist could use a certain oral cancer screening system.

  7. Electronic Dentistry – An Oral and Maxillofacial Radiologist asked if he needed a new Hampshire Dental license to offer second opinion services to New Hampshire dentists. The answer is no because he would have no direct contact with patients and New Hampshire dentists would retain responsibility and authority for treatment planning and treatment.

Members of the Board voted unanimously to go into non-public session for the purpose of discussing investigations of alleged licensee misconduct, noting that such a non-public session is authorized by RSA 91-A:3 and the Board’s executive and deliberative privileges.
