The Governor and Executive Council met on Wednesday February 18, 2009 in the Executive Council Chamber at the State House in Concord, NH and considered an agenda of over 65 items.

The next scheduled Governor and Council Meeting will be held on Wednesday March 4, 2009 at 10:00 AM in the Executive Councilor Chamber at the State House, Concord, NH.

The following authorized items might be of interest to District Three constituents.

COMMUNITY DEVELOPMENT FINANCE AUTHORITY
Authorized to amend an existing agreement with the Town of Brentwood, NH, (previously approved by G&C on 6-13-07, item #6)m for the purpose of changing the sub-recipient beneficiary name in the amount of $500,000. 100% Federal Funds.
Authorized to enter into an agreement with the Town of Exeter, NH, to determine the need for affordable senior housing in Exeter in the amount of $12,000. Effective upon G&C approval through June 30, 2010. 100% Federal Funds.

DEPARTMENT OF ADMINISTRATIVE SERVICES
Authorized to accept and place on file the Report and Findings of Beverly Hollingworth with regard to the making of certain improvements and the refinancing of certain indebtedness in connection with the University System of New Hampshire, Lee, NH. (Huntress Hall-Keene State, $2,800,000)
Authorized Surplus Distribution Section to amend a contract with the Community Action Program Belknap-Merrimack Counties Inc., Concord, NH, (previously amended by G&C on 1-14-09, item #12), to continue the coordination and distribution of the statewide surplus Emergency Food Assistance Program, by increasing the amount by $43,668 from $434,025 to $477,693, and by extending the end date from February 28, 2009 to September 30, 2009.

OFFICE OF THE ADJUTANT GENERAL
Authorized Lieutenant Colonel Richard P. Greenwood, Stratham, NH, be nominated for promotion to the rank of Colonel, NH Air National Guard. This officer meets all prerequisites for this grade, having been found to be physically, mentally, morally, and professionally qualified.

TREASURY DEPARTMENT
Authorized to amend Schedule B of the Restated Investment Management Agreement between the Strategic Advisers Inc., (d/b/a Fidelity Strategic Advisers and Fidelity Investments) and the NH State Treasurer, as Trustee of the NH Higher Education Savings Plan Trust. The amendment, which will enable a reduction or waiver of certain Fidelity management fees under certain circumstances, will become effective upon G&C approval. This amendment applies only to the fees collected under the Fidelity Advisory 529 plan. As a result of the recent economic downturn, and the resulting low rates of return on cash and money market investments, it is possible that participants in the Advisor 529 Plan who invest in the portfolio of cash and money market funds could experience a negative return on their investment after Fidelity administrative fees are deducted.

DEPARTMENT OF ENVIRONMENTAL SERVICES
Authorized Douglas & Susan MacLennan’s request to construct a tidal docking structure consisting of a permanent pier connecting to a ramp connecting to a float on frontage on the Oyster River in Durham, NH.
Authorized Sagamore Landing Condominium Association’s request to reconstruct permitted tidal docking structure by reducing fixed pier, connecting to a ramp, connecting to a float, connecting in a T configuration to an expanded float system consisting of a float, connecting to a float section to the easterly side of the center float; and connecting to a float section to the westerly side of the center float. Reconstruction provides a total of 7 slips on frontage on Sagamore Creek in Portsmouth. Relocate two stabilizing pilings to correspond with new float ends.

DEPARTMENT OF HEALTH AND HUMAN SERVICES
Division of Public Health Services
Authorized Bureau of Community Health Services, Maternal and Child Health Section to exercise a contract renewal and to amend with Visiting Nurse Association and Hospice of VT and NH Inc., White River Junction, VT (previously approved by G&C on 6-13-07, item #184), to provide Child and Family Health Support Services, by increasing the amount by $40,976 from $40,976 to $81,952, and by extending the end date to June 30, 2011. 52% General, 48% Federal Funds.
Authorized Bureau of Community Health Services, Rural Health and Primary Care Section to enter into an agreement with Katrin Bergeron-Killough, MD, Exeter, NH, to receive reimbursement for payment of educational loans through the state Loan Repayment Program in an amount not to exceed $13,750. Effective upon G&C approval through June 30, 2011. 100% General Funds. The State Loan Repayment Program (SLRP) was established by the DPHS under the provisions of Chapter 410, Laws of NH 1994. The purpose of the program is to increase the number of primary health care providers serving in the State’s health professional shortage areas and in medically underserved areas. Rockingham County is one of the geographic areas to be served.
#46Authorized Bureau of Community Health Services, Rural Health and Primary Care Section to enter into an agreement with Maria Martin, Physician Assistant, Rochester, NH, to receive reimbursement for payment of educational loans through the state Loan Repayment Program in an amount not to exceed $40,000. Effective upon G&C approval through June 30, 2012. 100% General Funds. The State Loan Repayment Program (SLRP) was established by the DPHS under the provisions of Chapter 410, Laws of NH 1994. The purpose of the program is to increase the number of primary health care providers serving in the State’s health professional shortage areas and in medically underserved areas. The geographic area to be served is Rochester, Dover and Strafford County.
Authorized Bureau of Community Health Services, Sexually Transmitted Disease and Human Immunodeficiency Virus Section, to exercise a contract renewal and to amend with Avis Goodwin Community Health Center, Dover, NH (previously approved by G&C on 5-16-07, item #106), to provide voluntary, confidential HIV counseling, testing, and referral services and STD testing and treatment, by increasing the amount by $72,480 from $72,480 to $144,960, and by extending the end date to June 30, 2011. 50% General, 50% Federal Funds. Funds in this agreement will be used to continue DPHS efforts to provide comprehensive HIV counseling, testing, and referral servies and to ensure the availability of STD testing, and treatment services. It is anticipated that this agency will provide 600 clients with STD and HIV clinical services per year. The geographic areas to be served are Dover, Rochester and the surrounding towns.
Division for Children, Youth & Families
Authorized to retroactively amend an agreement with Easter Seals NH Inc., Manchester, NH, (previously approved by G&C on 12-12-06, item #123), for the provision of administrative case review services, by increasing the price by $1,074,668 to $2,027,508, and by extending the end date from December 31, 2008 to December 31, 2010. 100% Federal Funds. This action was requested to provide administrative case reviews for children and youth who are in the care and custody of the Department, either through DCYF or the Division for Juvenile Justice Services and in foster or out-of-home care.
This contract was not fully funded. During SFY’s 2007 and 2008 the contractor provided services at its own expense during the final months of the calendar year. This amendment increases the contract price by ten percent (10%) over the SFY 2008 amount to fully fund the services provided under this agreement.
