GOVERNOR AND EXECUTIVE COUNCIL MINUTES
State House, Concord, New Hampshire
December 3, 2003 10:00 a.m.

The Governor and Executive Council convened at 10:00 a.m. with all members present The Governor and Executive Council on motion of Councilor Spaulding, seconded by Councilor Burton accepted the minutes of November 19, 2003.

The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Spaulding confirmed the appointment of several persons nominated for Civil Commissions from the November 19, 2003 meeting.

The Governor placed in nomination the several persons who applied for Civil Commissions.

In accordance with Part II, Article 74 of the New Hampshire Constitution, the Governor and Council, on motion of Councilor Spaulding, seconded by Councilor Griffin asked the Attorney General's Office to prepare a question to be submitted to the Supreme Court regarding the constitutionality of RSA 490:1. Copies of the question will be sent to all Executive Councilors when submitted.

The Governor and Council, on motion of Councilor Spaulding, seconded by Councilor Burton, voted to set the date for a special election for state representative in Merrimack County District No.34.

The Governor and Council, on motion of Councilor Spaulding, seconded by Councilor Burton, voted to set the date for a special election for state representative in Rockingham County District No.77.

DEPARTMENT OF ADMINISTRATIVE SERVICES
The Governor and Council acted as follows:

#5 Authorized a list of agency transfers, as detailed in letter dated November 3, 2003, Authorized for Fiscal Year 2004 during the month of October.

#6 Authorized quarterly allotments for state departments and agencies for Fiscal Year ending June 30, 2004, as detailed in letter dated November 13, 2004. (2)Further Authorized to make necessary adjustments in the quarterly allotments not to exceed the total funds available for expenditures for the fiscal year.

#7 Authorized Bureau of General Services to pay the sole source Scott Lawson Group Ltd., Concord, NH, for emergency remediation of microbial contaminated HVAC unit and asbestos-containing material, for $11,925. Effective retroactive to October 3, 2003 through October 5, 2003 at the State House, Concord, NH.

#8 Authorized Bureau of Court Facilities to enter into a contract with Lance Williams & Son Logging & Trucking, Tuftonboro, NH, for snow and ice removal services at the Carroll County Courthouse in the amount of $30,000. Effective November 1, 2003 through April 30, 2006 or the date of G&C approval.

NH DEPARTMENT OF AGRICULTURE, MARKETS & FOOD
The Governor and Council acted as follows:

#9 Authorized to budget and expend prior year unexpended revenues of Agriculture Product/Scale Testing funds in the amount of $24,892. Effective upon G&C approval through June 30, 2004. 100% Other Funds.

#10 Authorized Division of Animal Industry to accept and expend grant funds from the USDA Animal and Plant Health Inspection Service, to be used to provide financial assistance to the state for a Foot and Mouth Disease Swine Feeder Program, in the amount of $19,000. Effective upon G&C approval through September 16, 2004. 100% Federal Funds.

TREASURY DEPARTMENT
The Governor and Council acted as follows:

#11 Authorized to issue a warrant from funds not otherwise appropriated and the State Treasurer to issue checks in the amount of $13,901.11 to the rightful owners of abandoned or unclaimed funds.

#12 Authorized to renew the sole source contract with Bottomline Technologies, Inc., Portsmouth, NH, for support services for Electronically Sent Payments, Electronic Remittance Advice Delivery System and PayView software modules, in the amount of $6,674. Effective January 1, 2004 through July 6, 2004.

ATTORNEY GENERAL
#13 DENIED - The Governor and Council on motion of Councilor Griffin, seconded by Councilor Spaulding, voted to deny the petition of Steven J. Nowaczyk requesting a pardon hearing for the offense of Witness Tampering. Mr. Nowaczyk is not eligible for an annulment.

EMPLOYMENT SECURITY
#19 The Governor and Council on motion of Councilor Burton, seconded by Councilor Wieczorek Authorized to enter into a service agreement with CLD Paving, Inc., for snow plowing and removal services at NHES's Laconia local office, for an agreement total not to exceed $45,000. Effective upon G&C approval through June 30, 2006. 100% Federal Funds.

DEPARTMENT OF LABOR
#20 The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Burton Authorized to accept and place on file the Biennial Report for the period of July 1, 2001 through June 30, 2003.

#22 The Governor and Council on motion of Councilor Griffiin, seconded by Councilor Wieczorek Authorized to retroactively co-sponsor with the NH Municipal Association a one-day conference entitled "Municipal Safety Showcase" held in the field in Bow, NH, on September 18, 2003 at a cost not to exceed $3,953. (2)Further Authorized to retroactively enter into a contract with Muddy River Smokehouse of Portsmouth, NH, to provide catering services in support of the one-day conference noted above. 100% Federal Funds.

LIQUOR COMMISSION
#23 DENIED - The Governor and Council on motion of Councilor Griffin, seconded by Councilor Spaulding, with Councilor Burton voting - no, voted to deny to accept and expend Enforcing Underage Drinking grant funds totaling $29,644 from the Office of Juvenile Justice and Delinquency Prevention of the US Department of Justice through the NH Department of Justice, for the purchase of approximately 22 false identification scanners. Effective upon G&C approval through May 31, 2004. 100% Other Funds.

DEPARTMENT OF CORRECTIONS
The Governor and Council acted as follows:

#24 Authorized to enter into a contract with the Melanson Company, Inc., for roof repair services at the Lakes Region Facility in Laconia, NH, in the amount of $5,100. Effective upon G&C approval through January 31, 2004. 100% General Funds.

#25 Authorized to enter into a sole source contract with SimplexGrinnell/Tyco, Westbrook, ME, for maintenance, testing and repair of the Building Service and Fire Protection Equipment connected to the Detection, Alarm, and Communications Systems at the Department of Corrections facility in Berlin, NH in the amount of $11,653.50. Effective January 1, 2003 through December 31, 2004. 100% General Funds.

#25A Authorized to expend an amount not to exceed $21,500 from the Correctional Industries Revolving Account to purchase equipment and equipment-related items, as specified in letter dated November 19, 2003. Fiscal Committee approved.

DEPARTMENT OF RESOURCES AND ECONOMIC DEVELOPMENT
The Governor and Council acted as follows:

#26 Authorized Division of Parks and Recreation to accept and expend donations in the amount of $85 from the Odiorne Family Reunion Fund, Intervale, NH, in memory of Paul Condon.

#27 Authorized Division of Parks and Recreation to renew the membership for the 2003/2004 season with the NH Campground Owner's Association, in the amount of $7,784.50. General, Other Funds.

#28 Authorized Division of Parks and Recreation, Cannon Mountain to enter into the service agreement, as detailed in letter dated November 3, 2003, on a sole source basis with Ingersoll-Rand of Davidson, NJ, for machine start-up service and repairs of the snowmaking air compressors, in the amount of $6,375. #29 Authorized Design, Development, and Maintenance to enter into a contract with Scott's Construction dba SCI Group, Newport, VT, for the construction of the wastewater disposal system at Cannon Mt. Tramway, Franconia, NH, on the basis of a low bid of $230,500, through June 30, 2004. Capital Funds.

#30 Authorized Trails Bureau to enter into Grant-in-Aid Trail Maintenance Contracts (Winter Trail Grooming) with the OHRV Clubs as detailed in letter dated November 7, 2003, in the total amount of $1,268,000.68. Effective upon G&C approval through May 1, 2004.

#31 Authorized Division of Travel and Tourism Development to award grants, as detailed in letter dated November 14, 2003, under the out-of-state Joint Promotional Program, for a total amount of $171,372.04. 100% General Funds.

DEPARTMENT OF ENVIRONMENTAL SERVICES

#33 Authorized to enter into a grant agreement with the Town of Durham Department of Public Works, Durham, NH, for storm drainage system mapping, in the amount of $11,285. Effective upon G&C approval through December 31, 2004. 100% Federal Funds.

#34 Authorized to award a Used Oil grant to the Town of Sunapee, NH, for the purpose of improving their Used Oil Collection Center, for $2,500. Effective upon G&C approval through December 3, 2004.

#35 Authorized to award a Public Water System Emergency Interconnection grant to the Bartlett Village Water Precinct, Bartlett, NH, to complete a project to better protect public water supplies from future potential terrorist attacks, in the amount of $15,000. (2)Further Authorized to award a Public Water System Emergency Interconnection grant to the Town of Exeter, NH, to complete a project to better protect water supplies from future potential terrorist attacks, in the amount of $15,000. #36 Authorized to amend a Water Supply Land Grant to the Town of Brentwood, NH, (previously approved by G&C on 6-25-03, item #148), to purchase four conservation easements in source water protection areas to protect water supply land, by extending the completion date to June 30, 2004 from December 31, 2003.

#37 Authorized to amend an existing sole source contract with Eastern Analytical, Inc., Concord, NH, (previously approved by G&C on 6-27-02, item #119), for laboratory analytical services by $60,000 from $50,000 to $110,000. Effective upon G&C approval through June 30, 2004.

#38 Authorized to amend existing contracts, (previously approved by G&C on 3-6-02, item #53), as detailed in letter dated November 3, 2003, for petroleum release initial response action services to reflect current market rate conditions and modify the overtime provision. Effective upon G&C approval through June 30, 2006.

#39 Authorized Aphrodite E Samora's request to dredge to permanently remove an existing jetty and an existing permanent dock, and fill to construct breakwater, in dogleg configuration with a gap at the shoreline and a cantilevered pier adjacent to an existing 2-slip dug in docking structure on frontage on property located at Barndoor Island on Lake Winnipesaukee in Alton.

#40 Authorized Stephanie Herring's request to construct a set of stairs leading to a permanent pier supported by pilings an a ramp leading to a float, providing two slips on frontage on property located along the Piscataqua River in Dover.

#40A Authorized to transfer $16,000, as specified in letter dated November 19, 2003. Fiscal Committee approved.

#40B Authorized Public Service of NH's request to amend permit to stabilize an additional 14,000 sq ft of eroded shoreline using Class C rock riprap on property located along the Piscataqua River in Portsmouth (previously approved by G&C on 2-5-03).

NEW HAMPSHIRE FISH AND GAME DEPARTMENT
The Governor and Council acted as follows:

#41 Authorized to retroactively exercise a two-year option to extend and continue under a memorandum of agreement with the NH Department of Corrections Correctional Industries, Concord, NH, (previously approved by G&C on 10-24-01, item #44), to provide administrative support functions of registration activities for the NH Off Highway Recreational Vehicle program from the date of July 1, 2003 through June 30, 2005.

#42 Authorized to accept and expend $38,625 in federal funds from the US Department of Agriculture for use in chronic wasting disease monitoring and surveillance in wild white-tailed deer. Effective upon G&C approval through June 30, 2004. (2)Further Authorized to enter into a contract with Cornell University, College of Veterinary Medicine, Animal Health Diagnostic Laboratory of Ithaca, NY, to perform immunohistochemical testing of wild white-tailed deer obex tissue for the presence of chronic wasting disease for a cost not to exceed a maximum of $11,250. Effective upon G&C approval through June 30, 2004.

DEPARTMENT OF HEALTH AND HUMAN SERVICES
The Governor and Council acted as follows:

Office of Community & Public Health
#43 Authorized Division of Chronic Disease Prevention to retroactively provide reimbursement to Lindsay Dearborn, Program Manager, NH Asthma Program, for in-state travel costs incurred on May 29, 2003, in the amount of $82.80. 100% Federal.

#43A Authorized to accept and expend $3,863,558 in federal funds, as specified in letter dated November 19, 2003. Fiscal Committee approved.

Division for Juvenile Justice Services

Division of Behavioral Health
#44 Authorized to enter into an agreement with Friends of Veterans, Inc., White River Junction, VT, to provide services to homeless individuals in an amount not to exceed $60,000. Effective upon G&C approval through June 30, 2005.

Division of Child Support Services
#45 Authorized to enter into a sole source agreement with the Supreme Court of the State of NH, Administrative Office of the Courts, Concord, NH, for the administration of the Marital Masters program, in an amount not to exceed $2,172,000. Effective January 1, 2004 through December 31, 2006. 100% Federal.

Division of Alcohol & Drug Abuse Prevention and Recovery
#46 Authorized to amend an existing agreement with National Council on Alcoholism and Drug Dependence of Greater Manchester, NH, (previously approved by G&C on 6-4-03, item #114), to provide administrative and fiscal oversight for activities directed toward the establishment of half-way houses organized on the national Oxford House Model, to increase the contract amount from $381,822 by $40,000 to $421,822. Effective upon G&C approval through June 30, 2004. 100% Federal.

DEPARTMENT OF EDUCATION
The Governor and Council acted as follows:

#47A Authorized to transfer $2,341,166, as specified in letter dated November 19, 2003. Fiscal Committee approved. 100% Federal Funds.

#48 Authorized to amend a contract with Susan E. Marshall, Concord, NH, sole proprietor, (previously approved by G&C on 1-23-02, item #57, renewed 6-12-02, item #122), to provide technical assistance and writing services in the preparation for the re-adoption of minimum standards rules, to increase the contract from $28,800 by $8,000 to an amount not to exceed $36,800. (2)Further Authorized the payment of services rendered and approved in lieu of withholding at least 25% of the total value of the contract. 100% General Funds.

#49 WITHDRAWN - The Governor withdrew the request to exercise its renewal option with Measured Progress, Inc., Dover, NH, (previously approved by G&C on 8-9-00, item #140, renewed on 8-14-02, item #209), to administer the statewide educational assessment at grades 3, 6, and 10 in Reading and Mathematics, in an amount not to exceed $2,341,167. Effective upon G&C approval through December 31, 2004. (2)Further Authorized to reduce from 25% to 7.5% the percentage of the total contract price to be withheld until the satisfactory completion of all services, including acceptance of all reports and the receipt of the detailed listing of expenses incurred for the contract period. 100% Federal Funds.

NH COMMUNITY TECHNICAL COLLEGE SYSTEM
The Governor and Council acted as follows:

#49A Authorized the confirmation of Lynn Kolchenstein as the Interim President of the NH Technical Institute, Concord, beginning upon confirmation, at salary level II, step 3, $80,213.

#49B Authorized the confirmation of Thomas Wisbey as the President of the NH Community Technical College, Manchester/Stratham, beginning upon confirmation, at salary level II, step maximum, $89,128.

#49C Authorized Manchester/Stratham to establish a Consultant position through January 31, 2005, as specified in letter dated October 15, 2003. Fiscal Committee approved. 100% Federal Funds. Retroactive.

#49D Authorized Concord to establish a Consultant position through September 30, 2004, as specified in their letter dated October 15, 2003. Fiscal Committee approved. 100% Federal Funds. Retroactive.

DEPARTMENT OF SAFETY
The Governor and Council acted as follows:

#50 Authorized Division of State Police to accept and expend a $2,522.41 grant entitled "Forensic Science Conference" from the NH Highway Safety Agency. Effective upon G&C approval through March 31, 2004.

#51 Authorized Division of Motor Vehicles to accept and expend a $22,269.23 grant from the Highway Safety Agency titled "Fatal Accident Reporting Systems". Effective upon G&C approval through September 30, 2004. 100% Federal.

#54 Authorized Division of State Police to accept and expend a $1,309,659.65 grant from the Department of Justice, to purchase portable and mobile radios for county and local fire and emergency medical services agencies. Effective upon G&C approval through June 30, 2004. 100% Federal Funds.

#55 Authorized Division of Motor Vehicles to enter into the second of two 3 year lease extensions with Mareld Company, Inc., Nashua, NH, (previously approved by G&C on 10-4-00, item #92), for Motor Vehicle Office space in Merrimack, NH, at a cost of $21,493.50 per year. #56 Authorized Division of Motor Vehicle a retroactive one-year lease amendment with One Dow Court Inc., (previously approved by G&C on 10-4-85, item #78), for sub-station space, for $33,075. Effective November 1, 2003 through October 31, 2004. 100% Highway.

#57 Authorized Division of State Police to contract with Anthony J LaBounty of E. Swanzey, NH, for snowplowing Troop C and Motor Vehicles sub-stations in Keene, NH, for $6,000. Effective upon G&C approval through June 30, 2004. 100% Highway.

#60 Authorized Division of Fire Standards and Training/EMS to enter into a $20,188 sole source maintenance contract with Symtron Systems Inc., Fair Lawn, NJ. Effective upon G&C approval through June 30, 2004, with options to renew for two additional years.

#60A Authorized Division of State Police to reallocate the federal grant monies, as detailed in letter dated November 6, 2003, (originally approved by G&C on 12-14-02, item #102 and 3-6-02, item #76). Effective upon G&C approval through December 31, 2003.

DEPARTMENT OF TRANSPORTATION
The Governor and Council acted as follows:

#61 Authorized to accept and place on file the Bureau of Right of Way's Contemplated Award List for the period October 30, 2003 through November 10, 2003.

#62 Authorized Division of Aeronautics to continue membership with the National Association of State Aviation Officials, Silver Spring, MD, and pay membership dues of $5,555.08 for fiscal year 2004. 100% General Funds.

#63 Authorized Bureau of Rail and Transit to accept and expend funds from the Federal Emergency Management Agency in the amount of $7,570.50 for repairs to the Cheshire Branch railroad line in the town of Westmoreland. (2)Further Authorized to reimburse the Bureau of Highway Maintenance for expenses related to these repairs in an amount not to exceed $7,570.50.

#64 Authorized Bureau of Right of Way to quitclaim whatever interest the State of NH may have in the Old NH Route 101 Highway Easement that is more than 33 feet Southerly of Candia Rd center line, as now traveled in the Town of Auburn to Daniel E. Jaskolka and Diane F. Jaskolka where it abuts other land of said Jaskolka.

#65 Authorized Bureau of Municipal Highways and the NH Department of Environmental Services to enter into a memorandum of agreement, as detailed in letter dated October 29, 2003, allowing DES to assume sole responsibility for coordination and management of the Alternative Fuel Vehicle Project, which is funded with federal Department of Transportation Congestion Mitigation and Air Quality grant funds. Effective upon G&C approval. (2)Further Authorized to increase its previously Authorized encumbrance by $110,685 from $594,172 to $704,857, to allow the AFVP to continue until the next round of CMAQ projects are selected in 2004. (3)Further Authorized DES to accept and expend $157,572.04 for coordination and management of the AFVP as detailed in letter dated October 29, 2003.

#73 Authorized Bureau of Construction contract with Jay-Mor Enterprises, Inc., Pelham, NH, on the basis of a low bid of $65,773.20, for demolition of four buildings: three at locations along NH 175A in the Town of Holderness in preparation for the future Holderness-Plymouth 11849 bridge replacement project and the Plymouth contract involves demolition of a building in the Town of Plymouth for the completed 12884 resurfacing project on NH Route 3A 0.25 miles south of the intersection with NH Route 25. Effective upon G&C approval through April 30, 2004. 100% Federal.

#74 Authorized Construction Bureau to increase the contract with Alvin J. Coleman & Son, Inc., Conway, NH, (previously approved by G&C on 8-13-03, item #193), by $296,454.07 for an original contract encumbrance of $4,490,642.63. (2)Further Authorized to increase the contract encumbrance to $4,787,096.70 for the replacement of the Rte 25 bridge over the Bearcamp River and the reconstruction of Rte 25 from the Tamworth/Ossipee town line to the Rte 16/25 intersection.

DEPARTMENT OF CORRECTIONS
The Governor and Council on motion of Councilor Griffin, seconded by Councilor Wieczorek, voted to approve the request to accept and expend a grant in the amount of $47,967.54 from the NH State Department of Education to provide funding for education materials and equipment to assist prison inmates by providing career and educational training opportunities that provide for successful reentry into the workforce and society. 100% Other Funds.
