The Governor and Executive Council convened at 10:30 a.m., with all members present.

The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Griffin, accepted the minutes of October 4, 2000.

The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Colantuono, confirmed the appointment of several persons nominated for Civil Commissions from the October 4, 2000 meeting.

#8 Authorized to hold the "Basic Public Information Officer's Course" on October 24, 25 and 26, 2000 at the Royalty Inn in Gorham, NH at a total cost not to exceed $4,300.00.

#9 Authorized a RETROACTIVE waiver from Administrative Rule 308.05C(2) for travel outside a 300 mile radius for Director Woodbury P. Fogg, to travel out of state to Halifax, Nova Scotia to the 25th Annual Conference of the New England Governors and the Eastern Canadian Premiers for 5 days from July 15, 2000 through July 19, 2000.

#10 Authorized a Memorandum of Understanding between the Office the NH Division of Fire Standards and Training in the amount of $34,505.20 through December 31, 2000.

#30 Authorized Division of Arts to award Annual Advancement Grants in the amount of $22,000 to the organizations and in the amounts as specified in letter of October 3, 2000.

NEW HAMPSHIRE RETIREMENT SYSTEM

The Governor and Executive Council acted as follows:

#31 Authorized to RETROACTIVELY approve under Administrative Services Rule 311.07(a)(6)(a) to pay the Sheraton Harborside Portsmouth in the amount of $3,128.89 for an organized meeting under Rule 308.04(a) held on September 11 and 12, 2000.

#31A Authorized to establish 1 Telephone Operator position through June 30, 2001 as specified in letter dated September 11, 2000. FISCAL COMMITTEE APPROVED

LIQUOR COMMISSION

#32 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, authorized to RETROACTIVELY AMEND a contract with Waste Management of New Hampshire, 25 Monadnock Highway, North Swanzey, NH, by extending the contract period for two years from June 30, 2000 to June 30, 2002 and increase the contract price limitation from $20,796.00 to $37,031.25, an increase of $16,235.25.

EMPLOYMENT SECURITY

The Governor and Executive Council acted as follows:

#33 Authorized to reclassify position #11072 salary grade 11, Executive Secretary Steno to Program Assistant I, salary grade 11.

#34 Authorized to enter into a Memorandum of Understanding with the NH Workforce Opportunity Council, Inc., in an amount of $2,700.00 through May 31, 2001 or 9 months from the date of Governor and Council approval, whichever is later, for services related to assisting the State of New Hampshire in the implementation of the Workforce Investment Act including the continued implementation and expansion of the One-Stop System.

#35 Authorized to enter into a Memorandum of Understanding with the NH Workforce Opportunity Council, Inc., in an amount of $75,000.00 through August 31, 2001 or one year from the date of Governor and Council approval, whichever is later, for services related to assisting the State of New Hampshire in the implementation of the Workforce Investment Act including the continued implementation and expansion of the One-Stop System.

#36 Authorized to enter into a service agreement with Bisson/Atlas Moving & Storage, in the amount of $8,333.33 annually for a three year total not to exceed $25,000.00 through June 30, 2003 for general moving and storage services at NHES's offices statewide.

#37 Authorized to enter into a service agreement with Hampshire Pest Control Co., Inc., in the amount not to exceed $6,740.00 annually and not to exceed $20,220.00 through June 30, 2003 for statewide pest control services at NHES's offices statewide.

#38 Authorized to enter into a service agreement with RGL Enterprises in the amount not to exceed $1,975.00 through December 31, 200 for ceiling renovation services at the NHES's administrative offices at 10 West Street, Concord.

#39 Authorized to enter into a service agreement with Young's Paving in the amount of $5,000.00 through June 30, 2003 for paving and patching services at NHES offices statewide.

PUBLIC UTILITIES COMMISSION

The Governor and Executive Council acted as follows:

#40 Authorized to enter into a short-term AMENDMENT to the existing lease contract with the Trustees of the Gloria A. Alosa, Revocable Trust, for property located at 8 Old Suncook Road, Concord, NH, by extending the expiration date from October 31, 2000 to April 31, 2001 and establish a monthly lease amount of $18,000.00 for a total not to exceed $108,000.00.

#41 Authorized to enter into a short-term AMENDMENT to the existing lease contract with the Trustees of the Gloria A. Alosa, Revocable Trust, for property located at 117 Manchester, Concord, NH, by extending the expiration date from October 31, 2000 to April 31, 2001 and establish a monthly lease amount of $1,250.00 for a total not to exceed $7,500.00.

DEPARTMENT OF CORRECTIONS

The Governor and Executive Council acted as follows:

#42 Authorized to accept donations of various sewing materials and notions with a total value of $755. The donations were made from July 1, 2000 to July 30, 2000 from various individuals as listed on attachment of letter of September 27, 2000.

#43 Authorized to accept a donation of $100 to the NH State Prison for Women from Church Women's United c/o Alice Roberts, 63 Green Street, Concord, NH.

#44 Authorized to hire Jason M. Winters, DMD to fill the vacant position of Senior Dentist at the Northern New Hampshire Correctional Facility at the year rate of $65,187, Step 1, Group Q, effective upon Governor and Council approval.

#45 Authorized to add Susan Thorner, 55 Mountain Road, S. Berwick, Me to the approved list of Nurse Practitioners. On June 21, 2000 Item 60, Governor and Council approved the total allocation for Nurse Practitioners in the amount of $63,700.

#46 Authorized to Edward E. Eldridge, Jr., MD, Old Wolfeboro Road, Alton, NH to the approved list of Internists. On June 21, 2000, Item #60, Governor and Council approved the total allocation for Internist in the amount of $212,420 for Fiscal Year 2001.

#47 Authorized to pay $689,000.00 in overtime for permanent personal services out of salaries for vacant positions due to pending recruitment for the period of July 1, 2000 through September 30, 2000. Funds had been expended from overtime allocation at a greater than anticipated rate and permission to transfer expenditures back to permanent personal services is required.

DEPARTMENT OF RESOURCES AND ECONOMIC DEVELOPMENT

The Governor and Executive Council acted as follows:

#48 Authorized Division of Parks and Recreation to extend Brian Clark temporary employee beyond his one year anniversary date of full time employment.

#49 Authorized to enter into an agreement with L. G. Cushing & Sons, Inc., Walpole, NH in the total contract amount of $10,290.00 to install non-activated wells at Dry River Campground, and Harts Location, Crawford Notch State Park.

#50 Authorized to enter into a contract with Monadnock Business Ventures, Inc., Peterborough, NH for a contract total of $125,000 though December 31, 2001 for the establishment of a bandwidth initiative for the Monadnock Region. SOLE SOURCE

#51 Authorized to extend the completion date of two Memoranda of Agreement to accomplish coordinated research regarding New Hampshire complex floodplain systems and development of a New England classification of Atlantic White Cedar Swamps and Silver Maple Floodplain Forests. The first Memorandum of Agreement with the Department of Environmental Services covers the transfer of federal funds for the project. The second with The Nature Conservancy for NH Natural Heritage Inventory ecologists to conduct the project. The attached amendments will only extend the completion date to June 30, 2001; no other changes are made to the Agreement.

FISH AND GAME DEPARTMENT

#52 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, with Councilor Streeter voting NO, authorized to enter into a contract with AirScan, Inc., Titusville, FL in the amount of $74,445.00 through December 31 2000 for the purpose of conducting an aerial infrared survey of moose in northern New Hampshire. SOLE SOURCE

#53 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, authorized to enter into a contract with AMSCO, Inc., Londonderry, NH for $48,000.00 to construct a cofferdam to enable the Department to construct a public boat access facility at Squam Lake in Holderness, NH, effective upon approval of Governor and Executive Council.

DEPARTMENT OF ENVIRONMENTAL SERVICES

The Governor and Executive Council acted as follows:

#54 Authorized Waste Management Division to assign the vehicles to the individuals, as specified in letter of September 20, 2000, on a 24-hour, 7 days per week basis under the provisions of Adm. Rule 305.01(c)(4) for the period ending September 31, 2001. These vehicles will be used for an Oil Spill Response Program to respond to oil spills and complaints.

#55 Authorized additional moving expenses in the amount of $1,821.90 for David R. Wunsch, Ph. D. from Lexington, Kentucky to New Hampshire. Dr. Wunsch is the new State Geologist.

#56 Authorized a waiver from the provisions of Administrative Rule 607.03(c) to increase the number of fleet vehicles allocated to the Department by one. The additional vehicle a surplused 4X4 pickup truck will be assigned to Waste Management Programs and used for hazardous materials emergency response, remote site access and movement of equipment.

#57 Authorized to accept $48,037 in federal funds from the US Environmental Protection Agency under the Performance Partnership Grant carryover funds through June 30, 2001.

#58 Authorized to RETROACTIVELY accept $87,270 in federal funds from the US Environmental Protection Agency under Section 104 of the Clean Water Act for the purpose of surveying the estuarine waters of New Hampshire and developing state infrastructure and capacity for long-term estuarine monitoring.

#59 Authorized to enter into a grant agreement with Scruton's Dairy Farm, 208 Meaderboro Road, Rochester, NH in the amount of $51,000.00 through December 31, 2001. This project entails the installation of "Phase III" BMPs at Scruton's Diary Farm as specified in letter of October 5, 2000.

#60 Authorized Water Division to enter into an agreement with Frank J. Pescinski d/b/a Pescinski Painting, 423 Currier Road, Hill, NH in an amount not to exceed $16,500 for interior metalwork painting of one digester cover.

#61 Authorized to enter into an agreement with Northeast Rural Water Association, 187 St. Paul Street, Burlington, VT in the amount of $86,000 through September 30, 2001. (2) Authorized to enter into an agreement with Northeast Rural Community Assistance Program, 218 Central Street, Winchendon, MA in the amount of $99,835 through September 30, 2001 to establish the specific contracts for Drinking Water Technical Assistance Services.

#62 Authorized to accept a payment of $77,577 in federal funds from the US Environmental Protection Agency under Section 104(b)(3) of the Clean Water Act for the purpose of implementing the microbial source-tracking project in the Bellamy River and Hampton Harbor watersheds. (2) Authorized to AMEND an existing agreement with UNH-JEL, Adams Point Road, Durham, NH [Initially approved on June 22, 1999], by increasing the total amount to be paid for services by $70,423 to $133,423.

#63 Authorized to enter into an agreement with the University of New Hampshire Office of Sponsored Research, Service building, Room 109, 51 College Road, Durham, NH in the amount of $20,000 through October 21, 2001 for research tasks outlined in agreement.

#64 Authorized to RETROACTIVELY AMEND the existing agreement with the University of New Hampshire Office of Sponsored Research, Service Building, Room 109, 51 College Road, Durham, NH [Initially approved on January 19, 2000 (Item #46)], by extending the completion date from October 1, 2000 to September 30, 2001. No additional state funds are required by this action.

#65 Authorized Water Division to enter into contract AMENDMENT #3 with Dufresne-Henry, Inc., 175 Canal Street, Unit 5, Manchester, NH in the amount of $38,372 and to extend the contract completion date to December 31, 2001.

#66 Authorized Water Resource Council to AMEND a current service agreement with Ainsworth Land Management, 38 Williams St., Lancaster, NH effective upon approval, by extending the termination date to September 30, 2002. [Initially approved on December 15, 1999 (Item #52)].

#67 Authorized Water Division to AMEND a grant agreement with the City of Keene, 580 Main Street, Keene, NH through December 31, 2000. This is a time extension request and involves no new funds.

#68 Authorized the Supplemental Loan Agreement between the Department and the Town of Hampton in the principal amount of $664,952.23 under the provisions of RSA 486:14 and NH Admin. Rules Env-C 500 effective upon approval by Governor and Council.

#68A Authorized to enter into a grant agreement with the Town of Wolfeboro, South Main Street, Wolfeboro, NH in the amount of $34,004.00 through April 30, 2001 to stop the discharge of stormwater, contaminated with sediments, from entering Crescent Lake.

BOARD OF DENTAL EXAMINERS

#69 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, authorized to expend $1,250.48 in examination fees collected for examination, related services and supplies as long as fees charged to applicants are equivalent to 125% of direct expense of examination.

DEVELOPMENTAL DISABILITIES COUNCIL

#70 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, authorized to enter into an agreement with the New Hampshire Regional Action Committees, 18 Low Street, Concord, NH in the amount of $24,000.00 through September 30, 2001.

DEPARTMENT OF HEALTH AND HUMAN SERVICES

#70A The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, with Councilor Colantuono voting NO, authorized to accept and expend $6,123,378 in federal funds and transfer $3,060,159 of these funds as agency income, as specified in letter dated September 27, 2000. FISCAL COMMITTEE APPROVED

#70B The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, with Councilor Colantuono voting NO, authorized to accept and expend $18,159,757 in federal funds and $10,069,071 in private local funds and transfer $8,187,544 of the additional revenue, as specified letter dated October 10, 2000. #98 Authorized to enter into an agreement with McFarland-Johnson, Inc., The Concord Center, 10 Ferry Street, Unit 11, Suite 210, Concord, NH for a total lump-sum fee of $61,281.85 for engineering services for final design of improvement of Us Route 3/NH Route 11 and Kendall Street Intersection in the City of Franklin.

#99 Authorized to enter into a joint Memorandum of Agreement with the Department of Environmental Services to implement (1) a non-commercial sustaining announcement campaign dedicated to transportation and air quality issues and (2) an evaluation and assessment component of the outreach media campaign. The total combined cost of both projects shall not exceed $609,575.00.

#100 Authorized to enter into an Agreement with Vanasse Hangen Brustlin, Inc., for a Time and Materials Fee not to exceed $500,000.00 for special statewide bridge design.
