The Governor and Executive Council, on motion of Councilor Colantuono, seconded by Councilor Spaulding, accepted the minutes of September 28, 1999.

#12 Authorized list of agency transfers Authorized for Fiscal Year 2000 during the month of September 1999.

TREASURY DEPARTMENT

Governor and Executive Council acted as follows:

#13 Authorized the Comptroller to issue a warrant from funds not otherwise appropriated and the State Treasurer to issue a check pursuant to RSA 6:20-c to Peter T. Mullin the amount of $197.10.

ATTORNEY GENERAL

Governor and Executive Council acted as follows:

#17 Authorized to accept and expend a grant in the amount of $117,908 from the Federal Violence Against Women Office through January 31, 2001.

DEPARTMENT OF CULTURAL RESOURCES

Governor and Executive Council acted as follows:

#20 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Colantuono, with Councilor Streeter voting NO, authorized Division of Arts to RETROACTIVELY enter into a contract with Julie Gallagher in the amount of $6,000 for Archival Preparation Services in support of the 1999 Smithsonian Folklife Festival for the period of October 8, 1999 to November 30, 1999. SOLE SOURCE

#21 Authorized Division of Historical Resources to RETORACTIVELY enter into a lease agreement with HKH Associates, Inc., Concord, NH in the amount of $82,000 through June 30, 2004, for 4,100 square feet at it's building at 99 Airport Road, for purposes of maintaining an archaeological collections management and curation facility.

#22 Authorized Division of Arts to grant FY 2000 Annual Advancement Grants in the amount of $11,780.00, as specified in letter of September 30, 1999, upon Governor and Council approval.

EMPLOYMENT SECURITY

Governor and Executive Council acted as follows:

#23 Authorized to extend a leave of absence without pay for Paula Blake, for a period of one additional month to November 23, 1999.

#24 Authorized to enter into a service agreement with Concord Camera in the amount of $4,500.00 annually through June 30, 2002 to provide film processing services for NHES.

#25 Authorized to enter into a service agreement with Maurice's Enterprises in the amount of $10,000.00 annually through June 30, 2002 for snow plowing and removal services at NHES's Claremont "NH Works" Job & Information Center.

#26 FAILED-The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Spaulding, with Councilors Colantuono and Streeter voting NO, FAILED to authorize to enter into a service agreement with M. L. Hannay Associates of Portsmouth to provide follow-up training; and a service agreement with the Holiday Inn of Concord, Concord, NH for the training facility; and failed to authorize the Department of Employment Security to expend $3,185.79 in existing federal funds for this training program through November 11, 1999. SOLE SOURCE

DEPARTMENT OF LABOR

#27 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, authorized to establish a temporary salary increase of 25% for the Boiler Inspector position (#10973) for a 2 year period, upon Governor and Council approval.

OFFICE OF CONSUMER ADVOCATE

#28 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Colantuono, authorized to enter into contract with Exeter Associates, Inc., Maryland, d/b/a Exeter Associates of Maryland in New Hampshire in amount not to exceed $15,000.00 through June 30, 2000.

DEPARTMENT OF CORRECTIONS

#29 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Spaulding, with Councilor Streeter voting NO, authorized to enter into contract with Hewlett Packard Company, 2850 Centerville Road, Wilmington, DEL in at a cost of $7,506 effective upon Governor and Council approval through June 30, 2000. SOLE SOURCE

DEPARTMENT OF RESOURCES AND ECOMONIC DEVELOPMENT

Governor and Executive Council acted as follows:

#30 Authorized Division of Parks and Recreation to reclassify vacant position number 8T049 from Accounting Technician (labor grade 11) to Clerk II (labor grade 7). The estimated annual savings is $2,925.00 for this requested action.

#31 Authorized Division of Parks and Recreation to reclassify vacant position number 11550 from Electronic Technician I (labor grade 16) to Journeyman Electrician (labor grade 13). The estimated annual savings $3,016.00 for this requested action.

#32 Authorized Division of Parks and Recreation to accept a donation of a used Marquette Responder from the New Milford Community Ambulance Corp, New Milford, CT to be used at Mt. Washington. The donation of the responder is valued at $475.00.

#33 Authorized Division of Parks and Recreation, Cannon Mountain to enter into a Sponsor Agreement with New England Jeep Dealers Advertising Association. NEJDAA is donating the use of a vehicle for a one year in return for promotion at Cannon Mountain and participation in the Jeep "Ski Wheel" program (October 1999 to September 8, 2000).

#34 Authorized Division of Parks and Recreation to renew Cannon Mountain Aerial Tramway membership for the 1999/2000 season with White Mountains Attractions Association in the amount of $7,500.00.

#35 Authorized Division of Parks and Recreation to enter into the service agreement with James E. Niehues of Vancouver, Washington, for a total contract of $4,700.00 for the creation of trail map artwork for Cannon Mountain.

#36 Authorized Division of Parks and Recreation to enter into the Equipment Lease Agreement with Bickford's Sport Center in an amount not to exceed $13,660.00 through March 31, 2001 for the lease of 9 snowmobiles.

#37 Authorized Division of Forests and Lands to accept an allotment of federal funds for the federal fiscal years October 1, 1998-September 30, 2000, under the Cooperative Forestry Assistance Act of 1978, PL 95-313, Nursery and Tree Improvement in the amount of $5,000.

#38 Authorized to award the grants to the organizations, in the amounts, and for the completion dates as specified in letter of September 28, 1999, under the Joint Promotional Program

FISH AND GAME DEPARTMENT

#39 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, with Councilor Streeter voting NO, authorized to enter into a sole source contract with Syntegra Tech, Inc, Bow, NH in the amount of $17,000.00 through December 31, 1999. The purpose of this contract is to modify several databases in order to complete Y2K conversion projects. SOLE SOURCE

DEPARTMENT OF ENVIRONMENTAL SERVICES

Governor and Executive Council acted as follows:

#40 Authorized to REACTIVELY AMEND a grant agreement with the City of Keene, 580 Main Street, Keene, NH through September 30, 20000. This is a time extension request and involves no new funds.

#41 Authorized Water Division to RETROACTIVELY AMEND a contract with Comprehensive Environmental Inc., 21 Depot Street, Merrimack, NH through May 30, 2000. This is a time extension request and involves no new funds.

#42 Authorized approval of the Supplemental Loan Agreement between the Department of Environmental Services and the Town of Boscawen in the principal amount of $917,772.36 under the provisions of RSA 486:14 and NH Admin Rules Env-C 500 effective upon approval by Governor & Council.

#43 Authorized approval of the Loan Agreement between the Department of Environmental Services and the City of Portsmouth in the amount of $6,700,000 under the provisions of RSA 486:14 and NH Admin Rules Env-C 500 effective upon approval by Governor & Council.

#44 Authorized approval of the Supplemental Loan Agreement between the Department of Environmental Services and the City of Manchester in the amount of $5,850,000 under the provisions of RSA 486:14 and NH Admin Rules Env-C 500 effective upon approval by Governor & Council.

#45 Authorized approval of the Loan Agreement between the Department of Environmental Services and the City of Manchester in the amount of $2,500,000 under the provisions of RSA 486:14 and NH Admin Rules Env-C 500 effective upon approval by Governor & Council.

#46 TABLED-The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Colantuono, voted to TABLE the request to accept $60,000 form the US Geological Survey effective upon approval by Governor & Council through June 30, 2000. (2) Further to enter into the contracts in the amount of $85,000 as specified in letter of September 29, 1999 for geologic mapping services through June 30, 2000. SOLE SOURCE

#47 Authorized to RETROACTIVELY accept federal funds in the amount of $36,908 under the United States Environmental Protection Agency Voluntary Cleanup Program Cooperative Agreement, through August 31, 2000.

#48 Authorized Water Resources council to execute a long-term lease with the Town of Pittsburg through the year 2049 for the use of approximately 4 acres of State-owned land. DES proposes to lease this property to the Town for the consideration of $1.00.

#49 Authorized Water Division to expend funds not to exceed $91,000 from the State Dam Maintenance Fund through December 31, 2001, for the repair of the Upper Kimball Pond Dam in Chatham.

#50 Authorized Water Division to enter into an agreement with Frank J. Pescinski d/b/a Pescinski Painting, 423 Currier Road, Hill, NH in an amount not to exceed $15,000 for interior metalwork painting of one digester cover.

#51 Authorized Water Division to AMEND an existing agreement with North Country Council, Inc., the Cottage at the Rocks, 107 Glessner Road, Bethlehem, NH through September 30, 2000. This is a time extension request and involves no new funds.

#52 Authorized Water Division of RETROACTIVELY AMEND and extend for an additional five years the term of an existing multi-year agreement with White Mountain Resource Management, Inc., PO Box 1081, Ashland, NH for turn-key management services for biosolids generated at the Franklin Wastewater Treatment Plant. This amendment will raise the total cost of the contract from $390,678.47 to $1,090,518.46. The original agreement is effective through June 30, 2000, and the amended completion date is June 30, 2005. The effective date of this Amendment is June 30, 1999.

DEPARTMENT OF HEALTH AND HUMAN SERVICES
Office of Administration

Governor and Executive Council acted as follows:

#53 Authorized to make an unencumbered payment in the amount of $3,331 to Pelmac Industries, Inc., Auburn, NH effective upon approval by Governor and Council for emergency security repairs at the Nashua District Office. SOLE SOURCE

#54 Authorized to RETROACTIVELY make an unencumbered payment in the amount of up to $25,164 to Systems Management, Inc., 1001 Sampson Street, New Castle, PA, for services retroactive to October 1, 1999 through November 30, 1999 for the provision of cleaning and janitorial services for the Department's Concord leasehold property located at 115, 117, and 129 Pleasant Street in Concord, NH.

Office of Community and Public Health

Governor and Executive Council acted as follows:

#55 Authorized to enter into a contract with Patricia Martin, CNM, Dalton, NH through October 30, 2000 for an amount not to exceed $10,000 for an additional year service for a loan reimbursement.

#56 Authorized to enter into contract with Ellen Ross, PA-C, Whitefield, NH through June 30, 2001, for an amount not to exceed $20,000 for a two-year service for the loan reimbursement.

Office of Family Services

#57 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, authorized RETROACTIVE reimbursement for Sharon Face, Program Manager in the DHHS Nashua District Office, in the amount of $84.24 for her overnight lodging expense at the Sheraton Nashua Hotel that was incurred on May 13, 1999.

Children, Youth & Families

#58 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, authorized to enter into an agreement with AHurd Consultants LLC, Kingston, NH in the amount of $20,500.00 through September 15, 2000 to provide adoption search consultation services to reduce the waiting list for services to adopted individuals and birth families.

Behavioral Health

Governor and Executive Council acted as follows:

#59 Authorized to enter into an agreement with SAU #36, White Mountains Regional School District, 16 Highland St, Whitefield, NH in an amount not to exceed $33,800.00 through June 30, 2000 to provide for the continuation of a Student Assistance Program to meet the needs of the students in the SAU.

#60 Authorized to RETORACTIVELY enter into an agreement with the Community Services Council of NH, 2 Industrial Park Drive, Concord, NH in an amount not to exceed $106,723 retroactive to July 1, 1999 through June 30, 2000. These funds will pay for the operating and supportive service costs of a six-bed community residence for handicapped homeless persons who have suffered traumatic brain injuries.

#61 Authorized to RETROACTIVELY enter into an agreement with Strafford Guidance Center, Inc., 130 Central Avenue, Dover, NH in an amount not to exceed $83,161.00 retroactive to July 1, 1999 through June 30, 2001. These funds will be used for the operation of Tideview Estates Condominium that services six handicapped homeless persons.

#62 Authorized the Glencliff Home For The Elderly to RETROACTIVELY enter into a contract with Pillsbury Funeral Homes, Inc., 101Union Street, Littleton, NH in an amount not to exceed $16,425.00 retroactive to July 1, 1999 through June 30, 2001.

Office of Program Support

#62A The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, with Councilor Streeter voting NO, authorized Division of Child Support Services, to make RETROACTIVE, nencumbered payments estimated to be up to $66,163.39 to Fleet National Bank, Boston, MA for payment of banking services on the Child Support Collections Account. SOLE SOURCE

NEW HAMPSHIRE HOSPITAL

#63 Authorized to increase the annual salary of Michael Gaylor, M.D., Physician/Psychiatrist/Medical by $3,000.00 for being board certified.

#64 Authorized to increase the annual salary of Steven Cauble, M.D., Physician/Psychiatrist/Medical by $3,000.00 for being board certified.

DEPARTMENT OF YOUTH DEVELOPMENTAL SERVICES

#65 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, authorized to accept and expend $11,235.00 in additional funds from the NH State Department of Education for a grant entitled "Supplemental Instructional Resources" through June 30, 2000.

DEPARTMENT OF EDUCATION

Governor and Executive Council acted as follows:

#66 Authorized Division of Adult Learning and Rehabilitation to conduct a 3 day conference focusing on learning and planning through the "Authentic Task Approach" to be held at the Inns at Mill Falls in Meredith, NH, November 15-17, 1999 in an amount not to exceed $34,892.70.

#67 Authorized Division of Adult Learning and Rehabilitation to enter into a contract with Steven Mayo Corporation, 28 Tinker Road, Merrimack, NH in an amount not to exceed $35,720.00 through June 30, 2000 to provide home modifications to a client's residence.

#68 Authorized Division of Adult Learning and Rehabilitation, to enter into a contract with Dean Giftos, DDS in an amount not to exceed $23,400 through September 30, 2001 to provide dental consultation.

#69 Authorized to enter into a contract with Brewster Bartlett, Loudon, NH in an amount not to exceed $33,307 through June 30, 2000 to compile a Roadkill Count Physical Science Curriculum to use in New Hampshire Schools.

#70 Authorized to enter into a contract with Law Office of Peter Foley in an amount not to exceed $31,000.00 through June 30, 2001 to conduct special education hearings, state board of education hearings, vocation rehabilitation hearings, and alternative dispute resolution sessions.

#71 Authorized to RETROACTIVELY enter into a contract with New Hampshire Assistive Technology Center, Laconia, NH in an amount not to exceed $1,334,000 through June 30, 2001 to provide state-wide coordination of supplemental educational supports and services for students with sensory impairments and to provide technical assistance for these students to each local school district in New Hampshire.

Governor and Executive Council acted as follows:

#84 Authorized to enter into contracts with 13 appraisal firms to prepare appraisals associated with the Statewide acquisition program for a total cost of $1,250,000.00 for the expiration of 3 years, whichever comes first.

#85 Authorized to increase the contingency for Contract #336183 with Pike Industries, Inc., Belmont, NH by $220,000.00 from $209,595.29 to $429,595.29. This changes the April 19, 1999 original resolution encumbrance of $3,203,813.79 (bid amount of $2,994,218.50 plus 7% contingency of $209,595.29) to a revised amount of $3,423,813.79.

#86 Authorized to enter into an Agreement with Jalbert Leasing, Inc., PO Box 190, Dover, NH to operate the Portsmouth Transportation Center located at 185 Grafton Drive, Portsmouth, NH for 5 years with a 5 year renewal option, unless terminated earlier.

#87 Authorized to extend the original Equipment Lease Agreement dated September 2, 1994 with the New Hampshire Central Railroad, Inc., PO Box 248, Colebrook, NH through December 31, 2004, and to AMEND the agreement to conform with other similar agreements.

#94 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Colantuono, authorized request of William J. Miller to remove an unpermitted deck, repair existing breakwater with associated structures. Construct a piling supported by a pier with a walkway over the water to create a "u-shaped" docking system. Install an ice cluster off the end of the pier and retain the existing personal watercraft lift structure attached to the shore on property located on Rattlesnake Island in Alton.

The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, with Councilor Colantuono voting NO on Item B, approved the following tuition requests:
