The Governor and Executive Council convened at 10:30 a.m. with all members present
The Governor and Executive Council on motion of Councilor Spaulding, seconded
by Councilor Burton accepted the minutes of August 13, 2003.
The Governor and Executive Council on motion of Councilor Burton, seconded
by Councilor Griffin accepted the minutes of the special meeting held August
21, 2003.
The Governor and Executive Council, on motion of Councilor Spaulding, seconded
by Councilor Burton confirmed the appointment of several persons nominated for
Civil Commissions from the August 13, 2003 meeting.
The Governor placed in nomination the several persons who applied for Civil
Commissions.

OFFICE OF STATE PLANNING
The Governor and Council acted as follows:
#1 Authorized to enter into an agreement with the North Country Council, Bethlehem,
NH, to enable the North Country Council to continue its efforts to address local,
municipal and regional planning issues, in the amount of $20,953. Effective
upon G&C approval through June 30, 2004.
#1A Authorized to enter retroactively into an agreement with the University
of NH, Complex Systems Research Center, Durham, NH, to provide $80,000 to continue
implementation of GRANIT, the states computerized geographic information system.
Effective July 1, 2003 through June 30, 2004. General Funds.
#1B Authorized to enter into an agreement with The Sargent Museum, Concord,
NH, to preserve historical artifacts found at the Wiggin Farm archaeological
site in Stratham, NH, under the provisions of the NH Coastal Program, in the
amount of $4,165. Effective upon G&C approval to June 30, 2004. Federal
Funds.
#1C Authorized to enter into an agreement with the Granite State Designers
and Installers, Concord, NH, to conduct education for homeowners with septic
systems under the provisions of the NH Coastal Program, in the amount of $9,700.

NH CONNECTICUT RIVER VALLEY RESOURCE COMMISSION
#2 The Governor and Council on a roll call vote of: Councilor Burton - yes,
Councilor Spaulding - yes, Councilor Griffin - no, Councilor Wieczorek - yes,
Councilor Wheeler - no, authorized to enter into a retroactive agreement with
the Connecticut River Joint Commissions, Charlestown, NH, to hire the equivalent
of one full-time staff person, in the amount of $39,285. Effective July 1, 2003

the University of NH, Chemical Engineering Department, Pollution Prevention
Partnership Durham, NH, to support the implementation of a Pollution Prevention
Plan in accordance with Federal Executive Order (EO)13148, "Greening the
Government Through Leadership in Environmental Management, in an amount not
to exceed $9,000. Effective upon G&C approval through May 31, 2004. 100%
Federal Funds.
#10 Authorized to enter into a contract with Pinnacle Mapping Technologies,
Inc., Indianapolis, IN, to perform Digital Orthophotos 2003 to provide data
on four NH Army National Guard properties and for environmental assessment of
proposed construction and training activities, for a maximum price of $12,600.
Effective upon G&C approval through February 1, 2004. 100% Federal Funds.
DEPARTMENT OF ADMINISTRATIVE SERVICES
The Governor and Council acted as follows:
#11 Authorized the Report and Findings of Councilor David K. Wheeler with regard
to a certain proposal for the refinancing of existing debt and routine capital
expenditures project in connection with Southern NH Medical Center, Nashua,
NH.
#12 Authorized to accept and place on file a report containing a list of vendors
that agencies have contracted with for the period of April 1, 2003 through June
30, 2003.
#13 Authorized Bureau of General Services to contract with ATC Associates Inc.,
to provide indoor air quality consulting services at the Health & Human
Services Building, Concord, NH, for an amount not to exceed $5,385. Effective
September 4, 2003 through September 26, 2003.
#14 Authorized Division of Personnel to enter into a contract with Mr. C Victor
Gouger, Jr., to provide computer training and consultation to government employees
and agencies, in an amount not to exceed $7,000. Effective September 1, 2003
or upon G&C approval, whichever is later, through June 30, 2004.
#14A Authorized Division of Personnel to enter into a lease agreement with
Franklin Pierce College, Concord, NH, for space for the training courses offered
to government employees, totaling $160,000. Effective September 1, 2003 to July
31, 2008.
#14B Authorized Division of Personnel to enter into a contract with Michael
P. Gillis to provide computer training and consultation to government employees
and agencies, in an amount not to exceed $9,000. Effective September 1, 2003
or the date of G&C approval, whichever is later, through June 30, 2004.
Other Funds.
#14C Authorized Division of Personnel to enter into an agreement with the NH
Technical College System, to provide training and education programs for state
and municipal employees, in an amount not to exceed $40,000. Effective September
1, 2003 through June 30, 2004. Other Funds.
TREASURY DEPARTMENT
The Governor and Council acted as follows:
#15 Authorized to exceed the 3/12th limitation, as specified in letter dated
August 13, 2003. Fiscal Committee approved.
#16 Authorized to issue a warrant from funds not otherwise appropriated and
the State Treasurer to issue checks in the amount of $8,260.57 to the rightful
owners of abandoned or unclaimed funds.
#17-#18 NOT USED
DEPARTMENT OF AGRICULTURE
#19 The Governor and Executive Council on motion of Councilor Spaulding, seconded
by Councilor Wheeler authorized the State Conservation Committee to retroactively
amend a grant with Cheshire County Conservation District, Walpole, NH, (previously
approved by G&C on 9-25-02), to provide education and funding opportunities
for properties that are already protected to develop forest management plans
and/or natural resource inventories, by extending the completion date to June
30, 2004 from June 30, 2003. 100% Other Funds.
DEPARTMENT OF CULTURAL RESOURCES
The Governor and Council acted as follows:
#20 Authorized Division of Historical Resources to accept and expend funds
totaling $12,000, of which $5,636.52, are carried forward from FY03. The balance
of $6,363.48 is anticipated to be earned through donations to the State Conservation
and Rescue Archaeology Program ("SCRAP") received during State Fiscal
Year 2004.
#21 Authorized Division of Historical Resources to award a federally funded
historic barn restoration grant in the amount of $6,000, to the NH Farm Museum,
Milton.
ATTORNEY GENERAL
The Governor and Council acted as follows:
#22 Authorized to accept and expend a grant from the National Governors Association,
as pass through from the Federal Department of Justice, to be used for the planning
of information sharing projects in the State of NH, in the amount of $25,000.
Effective upon G&C approval through May 31, 2004. 100% Federal Funds.
#23 NOT USED
#24 Authorized to conduct a two-day conference at The Highlander Inn scheduled
for September 29 and 30, 2003 entitled, "Narcotics Investigation 2003"
at a cost not to exceed $5,200.80. (2)Further Authorized to enter into an agreement
with The Highlander Inn for necessary conference facilities and food services
for the two-day advanced training conference as part of the cost noted above.
100% Federal Funds.
#25 DENIED - The Governor and Council on motion of Councilor Griffin, seconded
by Councilor Spaulding, with Councilor Wieczorek voting - no, voted to DENY
the petition of Bryan E. Lipps requesting a pardon hearing for the offenses
of Burglary and Criminal Liability to Kidnapping. Mr. Lipps is not eligible
for an annulment.
#26 DENIED - The Governor and Council on motion of Councilor Spaulding, seconded
by Councilor Wieczorek, voted to DENY the petition of Michael A. N. Mavenyengwa
requesting a pardon hearing for the offense of Simple Assault (2 counts). Mr.
Mavenyengwa is not eligible for an annulment.
#27 DENIED - The Governor and Council on motion of Councilor Spaulding, seconded
by Councilor Wieczorek, voted to DENY the petition of Joseph S. Haas, Jr. requesting
a pardon hearing for the offense of Indirect Criminal Contempt of Court.
#28 DENIED - The Governor and Council on motion of Councilor Griffin, seconded
by Councilor Spaulding, voted to DENY the petition of Jennifer Fernald requesting
a pardon hearing for the offense of Second Degree Assault (2 counts). Ms. Fernald
is not eligible for an annulment.
LIQUOR COMMISSION
#29 The Governor and Executive Council on motion of Councilor Burton, seconded
by Councilor Wieczorek authorized to exceed the 3/12th limitation for various
accounts, as specified in letter dated August 13, 2003. Fiscal Committee approved.
BANKING DEPARTMENT
#30 The Governor and Executive Council on motion of Councilor Wieczorek, seconded
by Councilor Burton authorized an annual salary increment of $4,458 to Bank
Commissioner Peter C. Hildreth. Effective September 20, 2003.
DEPARTMENT OF LABOR
#31 The Governor and Executive Council on motion of Councilor Wieczorek, seconded
by Councilor Griffin with Councilor Wheeler voting - no, authorized to accept
and expend federal funds in the amount of $36,909 from the US Department of
Labor, Mine Safety and Health Administration to administer, develop, and promote
a successful miner-training program. Effective retroactive to July 1, 2003 through
September 30, 2003. 100% Federal Funds.
EMPLOYMENT SECURITY
The Governor and Council acted as follows:
#32 Authorized to enter into a retroactive sole source service agreement with
Xerox Corporation for laser printer maintenance services at NHES's administrative
office in Concord, NH, for an annual amount of $52,770 for a three-year agreement
total of $158,310. Effective July 1, 2001 through June 30, 2004. 100% Federal
Funds.
#33 Authorized to enter into a retroactive amended agreement to expend funds
from the South Carolina Employment Security Commission for voluntary participation

gas plant facility, construct associated sheet pile contamination cut-off wall

federal navigation channel and the dredge spoil off-loading location on the
south side of the Chocheco River in Dover. The Department of Environmental Services
