The Governor and Executive Council convened at 10:30 a.m., with all members present.

The Governor and Executive Council, on motion of Councilor Griffin seconded by Councilor Spaulding, accepted the minutes of July 10, 2002.

#21 Authorized to amend retroactively agreement with the Town of Antrim, NH (originally approved at G&C meeting of 1/6/99 item 3 and amended most recently 8/22/01 item 9), extending the end date from June 30, 2002 to June 30, 2003. No additional funds required.

#22 Authorized to amend retroactively agreement with the City of Concord, NH (originally approved at G&C meeting of 12/6/00 item 15 and amended 6/20/01 item 12), to modifying project by allocating all of the existing grant funds to rehabilitate the McKenna House and extending the end date from June 30, 2002 to June 30, 2003. No additional funds required.

#22A Authorized to amend Memorandum of Agreement with the Department of Environmental Services (originally approved at G&C meeting of 5/10/00 item 14 and amended 3/6/02 item 8), to extend the end date to December 31, 2003 to increase the number of sampling locations and increase the funding by $10,000 for a new total of $24,834 under the provisions of the Coastal Zone Management Program. Funds are 100% federal.

CONNECTICUT RIVER VALLEY RESOURCE COMMISSION

#23 The Governor and Executive Council on motion of Councilor Burton, seconded by Councilor Spaulding, authorized retroactive, sole source agreement with the Connecticut River Joint Commissions, Charlestown, NH in the amount of $39,285 to hire the equivalent of one full-time staff person, effective upon G&C approval through June 30, 2003.

GOVERNOR'S OFFICE OF ENERGY AND COMMUNITY SERVICES

#24 The Governor and Executive Council on motion of Councilor Burton, seconded by Councilor Wieczorek, authorized to amend contract with Community Action Program Belknap-Merrimack Counties, Concord, NH (originally approved at G&C meeting of 3/20/02 item 18), increasing the amount (due to allocation of Training and Technical Assistance funds from the 2002 US Department of Energy), by $1,400 to an amount not to exceed $223,926 as specified in letter dated July 1, 2002.

#28 Authorized Working Capital Warrant No. 03-03 in the amount of $400,000,000 to cover expenditures for the Month of September, 2002. Further authorized acceptance of Working Capital Warrant No. 03-01 reporting expenditures of $339,864,170.07 for the Month of July and lapse the balance of $60,135,829.93. 28A The Governor and Executive Council on motion of Councilor Spaulding, seconded by Councilor Burton, approved the Report and Findings of Councilor Raymond S. Burton with regard to the proposal for the equipment/renovation project in connection with New Hampton School, New Hampton, NH. 28B The Governor and Executive Council on motion of Councilor Spaulding, seconded by Councilor Burton, approved the Report and Findings of Councilor Raymond Wieczorek with regard to the proposal for the construction, renovation, capital equipment project and refinancing of existing indebtedness in connection with Catholic Medical Center, Manchester, NH.

#35 Authorized contract with Gerard A. Laflamme, Inc., Manchester, NH in an amount not to exceed $19,596 for electrical services at the Administrative Service's Data Center, contract to commence August 14, 2002 and end October 31, 2002.

#36 Authorized Bureau of Purchase and Property to enter into statewide agreement with vendors listed in Attachment A, effective upon G&C approval, as well as permission to implement 6-year term agreements, ending June 30, 2005, as specified in letter dated July 25, 2002.

#37 Authorized to reclassify position #18428 from a Human Resources Specialist II position, LG 24 to a T/I College Associate Professor, LG 22.

#37A The Governor and Executive Council on motion of Councilor Spaulding, seconded by Councilor Burton, with Councilor Wheeler voting NO, authorized contract with United States Cellular Operating Company of Manchester-Nashua, Inc., Bedford, NH with a maximum price limitation (over the life of contract), of $2,000,000 for Wireless Cellular Services. #38 Authorized Division of Personnel contract with Mr. C Victor Gouger, Jr., in an amount not to exceed $10,700 to provide computer training and consultation to government employees and agencies, effective upon G&C approval through June 30, 2003.

#49 Authorized to grant Marie Labrie, a paralegal in the Civil Bureau, an additional 23 days unpaid leave of absence beyond the allowable three month period retroactive from August 12, 2002.

A. DEPARTMENT OF ENVIRONMENTAL SERVICES WETLANDS BUREAU
Authorized construction of breakwater and cantilevered pier accessed by a 4 ft by 6 ft walkway on an average of 100 ft of frontage on Lake Winnipesaukee in Alton. This project does not conflict with Governor and Council Policy.

B. EXECUTIVE COUNCIL
Authorized and directed the attorney general's to engage Attorney Brian Gould of the law firm Brown, Olson and Wilson as legal counsel to the Governor and Executive Council concerning a personnel matter.

The Governor set the next Governor and Executive Council Meeting for Wednesday, September 4, 2002 at 10:30 a.m., at the State House, Concord, New Hampshire.
