The Governor and Executive Council convened at 10:30 a.m., with all members present.

The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Colantuono, accepted the minutes of July 14, 2000 with the following amendment:

Office of Family Services

Authorize Children, Youth and Families to enter into an agreement with City of Nashua, Health & Community Services Division, Nashua, NH in an amount not to exceed $96,892.00 through June 30, 2002 to provide Child Care Resource and Referral and Consumer Education Services through its Office of Child Care Services, to parents throughout the Nashua District Office.

#4 Authorized to RETROACTIVELY enter into a Agreement with the University of New Hampshire, Cooperative Extension Sea Grant Program, in the amount of $22,786 through June 30, 2001 for operational support to Great Bay/Coast Watch, a volunteer citizen-based water quality monitoring organization and a continuation of efforts to establish a phytoplankton monitoring program in coastal waters.

#5 Authorized to enter into an Agreement with Strafford Regional Planning Commission, 259 County Farm Road, Unit 1, Dover, NH in the amount of $26,000 through June 30, 2001 to assist the towns of Durham and Madbury with the preparation of new zoning ordinances, the Town of Newmarket with a tax map project and the Town of Rollinsford with a computerized storm water inventory.

#6 Authorized to enter into an Agreement with the Nashua Regional Planning Commission, 115 Main Street, Nashua, NH in the amount of $29,568.00 through June 30, 2001 to enable the Nashua Regional Planning Commission to continue it's planning board training program by providing technical assistance and consultation to municipalities on planning related issues, complete the regional plan and distribute the study on the impacts of sprawl in the region.

#7 Authorized to enter into an Agreement with the Lakes Region Planning Commission, 103 Main Street, Meredith, NH in the amount of $25,931.00 through June 30, 2001 to continue the digitizing of local land use and other maps onto the geographic information system for member communities and to provide technical assistance and training for local land use boards.

#8 Authorized to enter into an Agreement with the Strafford Regional Planning Commission, Strafford County Courthouse, 259 County Farm Road, Dover, NH in the amount of $24,245.00 through June 30, 2001 to continue to expand the geographic information system program by providing local mapping an analysis assistance to member communities, and support the development of a sustainable development policy document for the Commission.

#9 Authorized to enter into an Agreement with the Central New Hampshire Regional Planning Commission, 12 Cross Street, Penacook, NH in the amount of $22,357.00 through June 30, 2001 to provide technical assistance to member communities, support educational programs for local officials and continue to digitize local zoning and other maps into the geographic information system.

#10 Authorized to enter into an Agreement with the Southern New Hampshire Planning Commission, 438 Dubuque Street, Manchester, NH in the amount of $32,730.00 through June 30, 2001 to build and expand the Region's geographic information system data base, continue to assist OSP in providing training for local land use boards and to participate, in cooperation with OSP, in the statewide sprawl study.

#11 Authorized to enter into an Agreement with the Rockingham Planning Commission, 156 Water Street, Exeter, NH in the amount of $28,637.00 through June 30, 2001 to continue expanding it's geographic information system database to include preparation of regional coverage's of land use, assist communities by providing training sessions for planning boards; and begin work on a regional housing needs analysis.

#12 Authorized to enter into an Agreement with the North Country Council, Inc., 107 Glessner Road, Bethlehem, NH in the amount of $20,903 through June 30, 2001 to continue providing assistance and consultation to municipalities on planning related issues and to begin the process of updating the regional plan for the North Country.

#13 Authorized to enter into an Agreement with the Upper Valley Lake Sunapee Regional Planning Commission, 77 Bank Street, Lebanon, NH in the amount of $21,890 through June 30, 2001 to provide technical assistance to member municipalities, continue to produce newsletters for statewide distribution and revise the telecommunications amendments of the Regional Plan.

#14 Authorized to enter into an Agreement with the Southwest Region Planning Commission, 20 Central Square, Keene, NH in the amount of $23,739.00 through June 30, 2001 to continue to provide technical assistance, training materials and workshops for constituent communities, supplement Phase 1 of the NH DOT funded Route 202 Corridor Study, and continue developing the geographic information system as a tool for local and regional planning.

#15 Authorized to enter into an Agreement with the Town of Colebrook, NH in the amount of $12,000 through December 31, 2001 to enable the town to conduct a preliminary engineering study to evaluate the feasibility of replacing old, small diameter water mains and deteriorated sewer mains in three separate target areas in Colebrook.

#16 Authorized to enter into an Agreement with the County of Carroll, NH in the amount of $375,000 through December 31, 2001 to make improvements. The funds for this contract are from the Community Development Block Grant Fund and will be used to make improvements to the Carroll County water system.

#17 Authorized to enter into an Agreement with the Town of Walpole, NH in the amount of $12,000 through June 30, 2001. The funds for this contract are from the Community Development Block Grant Fund and will be used to conduct a preliminary engineering design study of water system improvements for the North Walpole Village District water system.

#18 Authorized to enter into an Agreement with the Town of Newport, NH in the amount of $12,000 through December 31, 2001. The funds for this contract are from the Community Development Block Grant Fund and will be used to evaluate the feasibility of either renovating an existing building or constructing a new facility to allow for the expansion of day care services.

#19 Authorized to RETROACTIVELY AMEND an existing Agreement with the Town of Antrim, PO Box 517, Antrim, NH [Initially approved on January 6, 1999, Agenda 3], by extending the completion date from June 30, 2000 to June 30, 2001. No additional state or federal funds are required by this action.

#20 Authorized to AMEND an existing Agreement with the Town of Conway, NH [Initially approved on January 5, 2000 (Item #11)], by increasing the price limitation by $250,000 for a new total of $500,000.

#21 Authorized to RETROACTIVELY AMEND an existing Agreement with the Town of Londonderry, 50 Nashua Road, Suite 100, Londonderry, NH [Initially approved on December 16, 1998 (Item #8)], by extending the end date from December 31, 1999 to December 31, 2000. No additional funds are required.

#21A Authorized to AMEND an existing Agreement with the Town of Pittsburg, NH [Initially approved on April 26, 2000, Item #3A], by increasing the total Community Development Block Grant awarded by $110,000 from $215,000 to $325,000. OFFICE OF EMERGENCY MANAGEMENT

The Governor and Executive Council acted as follows:

#22 Authorized to accept and expend Hazard Mitigation Grant Program funds from the Federal Emergency Management Agency in the amount of $88,962 through June 18, 2002.

#23 The Governor and Executive Council, on motion of Councilor Spaulding, seconded Councilor Colantuono, with Councilor Streeter voting NO, authorized to enter into a one-year contract with the New Hampshire Association of Broadcasters in an amount not to exceed $46,000 through March 30, 2001 to purchase airtime for, and produce, radio and television Non-Commercial Service Announcements on emergency management programs, projects and public information on emergency preparedness. DEPARTMENT OF ADMINISTRATIVE SERVICES

The Governor and Executive Council acted as follows:

#33 Authorized Bureau of Court Facilities to enter into contract with Al Melanson Company, Inc., PO box 523, Keene, NH for a lump sum price of $47,521.00 for the purpose of re-roofing Nashua District Court, Nashua, NH with the Bureau of Public Works' approval and supervision.

#34 Authorized Bureau of General Services to contract with Simplex Time Recorder Co., Bedford, NH in an amount not to exceed $343,500.00 through August 8, 2003 for fire alarm system testing and maintenance services at several state facilities.

#35 Authorized Bureau of General Services to AMEND a current with Public Communications Services, Los Angeles, CA through December 14, 2002 for inmate calling services.

#43 The Governor and Executive Council, on motion of Councilor Colantuono, seconded by Councilor Streeter, authorized to issue a warrant from funds not otherwise appropriated and the State Treasurer to issue checks in the amount of $11,788.35.

ATTORNEY GENERAL

#44 The Governor and Executive Council, on motion of Councilor Colantuono, seconded by Councilor Burton, authorized a salary increment of $2,663 to Christopher H. M. Carter, Assistant Attorney General (Position #9U307, Appropriation #010-020-2612-013-0100), effective August 20, 2000.

NEW HAMPSHIRE RETIREMENT SYSTEM

#45 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, authorized to reclassify position number 13749, Data Entry Clerk II, labor grade 5 to an Account Clerk III, labor grade 8 effective August 9, 2000.

DEPARTMENT OF CULTURAL RESOURCES

The Governor and Executive Council acted as follows:

#46 Authorized Division of Libraries to expend $80,000 for FY 01 automated library and information services provided by the New England Library and Information Network, Newton, Mass.

#47 Authorized Division of Historical Resources to accept and expend carry forward funds from a federal ISTEA Grant through the Department of Transportation in the amount of $57,218.94 through June 30, 2001.

#48 Authorized Division of Historical Resources to accept and expend funds totaling $7,000.00, of which $5,409.73, are carried forward from FY00. The balance of $1,590.27 is anticipated to be earned through donations to the State Conservation and Rescue Archaeology Program received during State Fiscal Year 2001.

#49 Authorized Division of Libraries to expend carry forward funds in the amount of $5,603.04 for the Women's Oral History Project.

#50 Authorized Division of Libraries to accept and expend a grant from Target Department Stores, Inc., Concord, NH totaling $1,500.00 for Kids, Books and the Arts.

#51 Authorized Division of Arts to award FY 2001 Annual Advancement Grants in the amount of $21,525.00, $7,000 to Currier Gallery of Art, Manchester, $7,000 to Pontine Movement Theatre, Portsmouth, and $7,525 to N Country Chamber Players, Littleton through July 31, 2001.

PUBLIC UTILITIES COMMISSION

#52 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, authorized to accept a gift on behalf of the State in the amount of $801.50 for travel related expenses. Commissioner Nancy Brockway will be traveling to the Energy and the Environment in St. Louis, Mo., with the cost of all travel expenses paid for by The National Association of Regulatory Utility Commissioners.

PARI-MUTUEL COMMISSION

#53 The Governor and Executive Council, on motion of Councilor Burton, seconded Councilor Spaulding, authorized to enter into a six-year lease/purchase agreement with Agilent Technologies, Englewood, CO for a total amount of $107,203.30 for the purpose of obtaining a scientific instrument, a gas chromatograph/mass spectrometer, for it's racing laboratory. SOLE SOURCE

JOINT BOARD OF LICENSURE AND CERTIFICATION

#54 The Governor and Executive Council, on motion of Councilor Colantuono, seconded by Councilor Spaulding, authorized the option of a two-year extension of the lease agreement with McCarthy Properties for office space located at 57 Regional Drive, Concord, NH. The current lease expires January 31, 2001. This extension will be in the amount of $9.50 per square foot.

LIQUOR COMMISSION The Governor and Executive Council acted as follows:

#55 Authorized to accept and expend a grant totaling $2,600 from Mothers Against Drunk Driving for the project entitled "Bicycle Patrols" through June 30, 2001.

#56 Authorized to utilize the banking services of Citizens Bank, 340 Wilson Street, Manchester, NH as a depository of funds for the New Hampshire State Liquor Store #10, Manchester, NH.

DEPARTMENT OF CORRECTIONS

The Governor and Executive Council acted as follows:

#57 Authorized to RETROACTIVELY increase the salary of Sid Bird Warden at the Northern New Hampshire Correctional Facility in Berlin, NH from Salary Grade O, Step 4, $62,623 to Step 5, $65,508 an increase of $2,885 effective July 1, 2000.

#58 Authorized to RETROACTIVELY continue the 14% salary enhancement for Nurse Practitioners at the Department of Corrections effective July 1, 2000 to July 1, 2002.

#59 Authorized to reimburse Commissioner Phil Stanley for a cost not to exceed $11,821.83 for moving expenses from his home in Kirkland, Washington to Concord, NH as a result of Mr. Stanley being selected, nominated and confirmed as the Commissioner of Corrections for New Hampshire.

#209 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Griffin, with Councilor Streeter voting NO, voted to remove Item #209 which was tabled at the June 21, 2000 Governor and Executive Council Meeting. Councilor Griffin, seconded by Councilor Spaulding, with Councilor Streeter voting NO, voted to approve the request to enter into a contract with Sodexho Operations, LLC 9801 Washington Blvd., Gaithersbury, MD in the amount of $2,231,918 through June 30, 2002 to provide management services for the Hospital's Food and Nutrition, Environmental/Laundry and Linen Services. The Council requested a progress report be submitted to the Governor and Executive Council, every six months for the two-year term of the contract.
