GOVERNOR AND EXECUTIVE COUNCIL MINUTES

Special Governor and Executive Council Meeting
July 23, 2002 11:30 a.m.

The Governor and Executive Council Convened at 11:30 a.m. with all members present.

LATE ITEM:

A. DEPARTMENT OF TRANSPORTATION
The Governor and Executive Council on motion of Councilor Spaulding, seconded by Councilor Wieczorek, authorized to enter into contract #616317 (WALPOLE, STP-X-T-000S(309), 12895), with R. M. Piper, Inc., of Plymouth, NH on the basis of a low bid of $4,436,084.41, to provide for pavement and bridge rehabilitation and safety work along NH Route 12, effective upon G&C approval to final date of completion: November 7, 2003.

The Governor discussed the possibility of canceling or postponing the Governor and Executive Council meeting scheduled for September 11, 2002.

Pursuant to RSA 91-A:3, II (a) and (c), the Governor and Executive Council on motion of Councilor Wheeler, seconded by Councilor Wieczorek, voted to go into non-public session. A roll call vote was requested: the results were as follows: Councilor Burton - Yes: Councilor Spaulding - Yes: Councilor Griffin - Yes: Councilor Wieczorek - Yes: Councilor Wheeler - Yes.

During the non-public session the Governor and Executive Council discussed a personnel matter. Present were: Governor's Special Counsel Martin Honigberg, Deputy Attorney General Stephen Judge, Senior Assistant Attorney General Wynn Arnold, Director of Personnel Tom Manning, and Associate Attorney General Ann Larney, and Assistant Secretary of State Karen Ladd as recording secretary.

The Governor and Executive Council on motion of Councilor Wieczorek, seconded by Councilor Burton, voted to come out of non-public session. A roll call vote was requested: the results were as follows: Councilor Burton - Yes: Councilor Spaulding - Yes: Councilor Griffin - Yes: Councilor Wieczorek - Yes: Councilor Wheeler - Yes.

The Governor and Executive Council on motion of Councilor Spaulding, seconded by Councilor Griffin, pursuant to RSA 7:12, requested the office of the Attorney General to initiate the process of securing legal counsel to represent the Governor and the Executive Council relative to the personnel issue that was discussed in non-public session.

The governor announced the next Governor and Executive Council Meeting to be held on Wednesday, August 14, 2002 at 10:30 a.m. in Harrisville, NH.
