The Governor and Executive Council convened at 10:30 a.m., with all members present.

The Governor and Executive Council presented a Commendation to Suzanne N. Keach, Executive Assistant to the Executive Council for 37 years of service-upon her retirement. Suzanne received a standing ovation.

The Governor and Executive Council, on motion of Councilor Colantuono seconded by Councilor Burton, accepted the minutes of June 20, 2001.

The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, confirmed the appointment of several persons nominated for Civil Commissions from the June 20, 2001 meeting.

The Governor placed in nomination the several persons who applied for Civil Commissions.

The Governor and Executive Council acted as follows:

#15 Authorized reclassification of Librarian III, Labor Grade 24 to an Information Technology Manager II, Labor Grade 29.

#16 Authorized agreement with Jason Thibodeau, Concord in the amount of $11,743.42 for the cleaning of department offices for the period of May 1, 2001 through June 30, 2002.

ATTORNEY GENERAL

The Governor and Executive Council acted as follows:

#18 Authorized to enter into grants of $141,781 to allow the NH Department of Safety to contract for services in order to integrate the Automated Fingerprint Identification System with the Criminal Justice Information Systems Arrest and Criminal Incidents Module effective upon G&C approval through September 30, 2001.

#19 The Governor and Executive Council on motion of Councilor Burton, seconded by Councilor Colantuono, with Councilor Wheeler voting NO, authorized to enter into a subgrant (previously authorized) in the amount of $30,000 to Court Appointed Special Advocates (CASA) to complete expansion into Cheshire and Sullivan Counties effective upon G&C approval through June 30, 2002.

#20 The Governor and Executive Council on motion of Councilor Burton, seconded by Councilor Colantuono, with Councilor Wheeler voting NO, authorized to enter into a subgrant (previously authorized) in the amount of $45,000 to expand and enhance the Family Violence Prevention Council's NH Corporate Citizenship Initiative through the addition of a full time Project Coordinator effective upon G&C approval through June 30, 2002.

NEW HAMPSHIRE RETIREMENT SYSTEM

#21 The Governor and Executive Council on motion of Councilor Colantuono, seconded by Councilor Burton, authorized reclassification of Clerk IV , salary grade 11 position to Accountant I salary grade 15 RETROACTIVE to May 24, 2001.

PUBLIC UTILITIES COMMISSION

#22 The Governor and Executive Council on motion of Councilor Spaulding, seconded by Councilor Burton, authorized to accept a gift on behalf of the State in the amount of $887.02 for travel expenses for Nancy Brockway, Commissioner to attend a committee meeting held by the National Council on Competition and the Electric Industry.

EMPLOYMENT SECURITY

#23 The Governor and Executive Council on motion of Councilor Burton, seconded by Councilor Spaulding, authorized to reclassify Claims Processor I, Salary Grade 8 position to Interviewer I, salary grade 15.

DEPARTMENT OF CORRECTIONS

The Governor and Executive Council acted as follows:

#24 Authorized to accept donations with thanks from various individuals listed on attached sheets of letter dated May 31, 2001 with a total value of $1574.48 of sewing material and notions to be used by inmates.

#25 Authorized contract with Aztec Technology Partners Inc.,-New England Region (Bay State Computer Division), with a price limitation of $9,159 for computer support for Northern NH Correctional Facility in Berlin, NH effective upon G&C approval through July 5, 2001 for a period of one year. SOLE SOURCE

#26 Authorized assignment of vehicle on a 24 hour, seven day a week basis to the Corrections Commissioner. Further Authorized exemption to administrative rule, which requires standard identification of all state-owned vehicles , assigned to the Corrections Commissioner.

DEPARTMENT OF RESOURCES AND ECONOMIC DEVELOPMENT

The Governor and Executive Council acted as follows:

#27 Authorized agreement of the Division of Travel and Tourism Development with Ski New Hampshire in the total amount of $10,000 to represent the NHDTTD at travel trade shows in the United Kingdom effective upon G&C approval through June 30, 2003.

#27A Authorized to exercise two-year renewal option on current contract with Barradas, Yeaton & Wold, Inc., (previously approved at G&C meeting of June 22, 1999), Portsmouth, NH to receive an additional $2,000,000 appropriation each year in the Fy02/03 biennial budget for advertising and promotion services involving broadcast and print media effective upon G&C approval through June 30, 2003. SOLE SOURCE

#28 Authorized agreement of the Division of Travel and Tourism Development with Mail Call, Amherst, NH in the total amount of $380,000 for telemarketing/fulfillment services effective upon G&C approval through June 30, 2003.

#29 Authorized agreement of the Trails Bureau with Cross Machine, Inc., Berlin, NH in the amount of $54,702.59 to fabricate and install a trail section of a bridge on the railroad trestle in Gorham, NH effective upon G&C approval through October 2, 2001.

#30 Authorized agreement of the Division of Forests and Lands with Sky Bright, Inc., Post Office Box 7405, Gilford, NH for the total contract cost of $3,000 for aerial surveillance of forest pest damaged areas effective upon G&C approval through September 30, 2001.

#31 Authorized to amend contract of the Division of Travel and Tourism Development with Glen Group, Inc., (previously approved at G&C meeting of June 21, 2000), Jackson, NH by $89,900 for a new total of $239,900 for production of the official New Hampshire Guidebook, Visitor Guides, Events Guides and Electronic Guidebook effective upon G&C approval through June 30, 2004.

FISH AND GAME DEPARTMENT

The Governor and Executive Council acted as follows:

#32 Authorized to accept and expend $75,000 of Federal Aid in Sport Fish Restoration Funds to reduce future hatchery costs and improve operational efficiency effective upon G&C approval through June 30, 2002.

#33 Authorized to enter into contract with Kaas Companies, LLC., 60 Rogers Street, Unit 5A, Manchester, NH in an amount not to exceed $21,300/year for Fiscal Years 2002 and 2003 to provide for placement and weekly cleaning of portable toilets, as well as cleaning of Department-owned vault toilets. RETROACTIVE

#34 Authorized to amend agreements with Audubon Society of New Hampshire and the University of New Hampshire, Office of Sponsored Research (previously approved at G&C meeting of June 8, 2000, Item #25A and amended May 9, 2001), as set forth in the Department of Environmental Services and NH Fish and Game Department's Memorandum of Agreement. SOLE SOURCE
(2) Further Authorized to amend existing contract with Audubon Society of NH (previously approved at G&C meeting of June 8, 2000, Item #25A), by increasing the contract price from $26,600 to an amount not to exceed $30,600 and by extending the termination date from June 30, 2002 to June 30, 2003. (3) Further Authorized to amend existing contract with University of New Hampshire, Office of Sponsored Research (previously approved at G&C meeting of June 8, 2000, Item #25A), by increasing the contract price from $40,400 to an amount not to exceed $64,000 and by extending the termination date from June 30, 2002 to June 30, 2003. DEPARTMENT OF ENVIRONMENTAL SERVICES

The Governor and Executive Council acted as follows:

#35 Authorized to reclassify Water Pollution Sanitarian I, salary grade 16 position to Environmentalist II, salary grade 18.

#36 Authorized to contract with HAZMATEAM, Inc., Hudson, NH in the amount of $4950 to provide a training course on "Hazardous Waste Management" for certified employees at municipally owned and operated solid waste facilities. SOLE SOURCE

#37 Authorized Waste Management Division to conduct an organized meeting and to enter into a service agreement with Geneva Point Center, Inc., in the amount of $4,106.25 to provide facilities and services for the 2001 Solid Waste Conference on September 19, 2001 effective upon approval by Governor and Council. Further Authorized the department to accept vendor fees in the approximate amount of $1,500, which shall be used to offset meal and rental costs.

#38 Authorized to enter into a Memorandum of Agreement between the department and the Department of Resources and Economic Development in the amount of $50,400 to conduct a study of open peatland communities in New Hampshire effective upon G&C approval through September 30, 2004.

#39 Authorized Waste Management Division to enter into grant agreement with Lakes Region Planning Commission in an amount not to exceed $24,502.75 for the purpose of conducting a household hazardous waste collection project effective upon G&C approval through January 15, 2002.

#40 Authorized approval of the following resolution:

RESOLVED: That the Governor and Executive Council, having examined the findings and recommendations of the Water Council relative to the applications by the following Municipalities for grants in the amount listed, hereby find that said grants are in the Public interest, approve same under the provisions of RSA 486:1, III, and Authorized the payment of such grants as provided for under said Chapter.

#41 Authorized Water Division to amend grant agreement with Town of Salem (previously approved at G&C meeting of July 14, 2000), 21 Cross Street, Salem, NH This is a time extension request and (paid entirely from federal funds), involves no new funds. RETROACTIVE

#42 Authorized to extend contract with Franklin Environmental Services, Inc. (previously approved at G&C meeting of April 7, 1999 with contract price of $649,073), for the removal of non-compliant underground storage tanks for one year until June 30, 2002, current contract expires June 30, 2001, contract price remains unchanged. RETROACTIVE

#43 Authorized grant agreement with Grafton County Conservation District (previously approved at G&C meeting of December 1, 1999), RR 2, Post Office Box 148B, Woodsville, NH in the amount of $1,000 to cover the remainder of project (addressing polluted runoff in the Clark Brook watershed), that was not finished under the old grant agreement, effective upon G&C approval through December 31, 2001.

#44 Authorized grant agreement with City of Laconia Watershed Advisory Committee in the amount of $15,000 to complete a project to protect drinking water from contamination effective upon G&C approval through June 1, 2002.

#45 Authorized grant agreement with City of Somersworth, Department of Public Works, 157 Main Street, Somersworth, NH in the amount of $10,000 to prepare base maps of the town storm drainage system effective upon G&C approval through December 31, 2002.

#46 Authorized supplemental State Revolving Loan Program Agreement (attached to letter dated June 12, 2001), with Carroll County in the principal amount of $152,500 for the purpose of financing the improvements to the County's wastewater treatment facility effective upon approval by Governor & Council.

#47 Authorized grant agreement with Souhegan Watershed Association, (previously approved at G&C meeting of June 24, 1998), 157 Naticook Road, Merrimack, NH in the amount of $694 to cover the remainder of project ( will include the reprinting of The Green Guide publication and a final project report documenting all work performed on project) effective upon G&C approval through December 31, 2001.

# 48 Authorized Water User Contracts ( copies included with letter dated June 6, 2001), with Public Service Company of New Hampshire, Inc. (PSNH), to compensate DES for benefits provided to PSNH at Garvins Falls, Hooksett and Amoskeag hydroelectric generating stations from water stored and delivered from the Winnipesaukee, Squamand Newfound Projects. All contracts have a term of 15 years from the date of Governor and Council approval.

DEPARTMENT OF HEALTH AND HUMAN SERVICES

The Governor and Executive Council acted as follows:

Office of Information Systems

#49 The Governor and Executive Council on motion of Councilor Burton, seconded by Councilor Colantuono, with Councilor Wheeler voting NO, authorized Division for Children, Youth and Families to amend agreement with National Council on Crime and Delinquency, (previously approved at G&C meeting of September 6, 2000), Madison, Wisconsin by increasing the amount by $50,000 to a new Price Limitation of $249,347 for Structured Decision Making services, and extending the end date to October 31, 2001.

#50 The Governor and Executive Council on motion of Councilor Burton, seconded by Councilor Colantuono, with Councilor Wheeler voting NO, authorized to amend agreement with Levi, Ray and Shoup, Inc., (previously approved at G&C meeting of August 18, 1999), 2401 West Monroe Street, Springfield, Illinois by increasing the agreement amount by $45,065 to $169,893 for software maintenance, and extending the end date effective upon G&C approval through June 30, 2004.
