GOVERNOR AND EXECUTIVE COUNCIL MINUTES

The Governor and Executive Council convened at 10:00 a.m. with all members present.

The Governor and Executive Council on motion of Councilor Wheeler, seconded by Councilor Griffin, accepted the minutes of May 19, 2004.

The Governor and Executive Council, on motion of Councilor Wheeler, seconded by Councilor Burton approved the appointment of several persons nominated for Civil Commissions from the May 5, 2004 meeting.

The Governor placed in nomination the several persons who applied for Civil Commissions.

The Governor and Executive Council observed a moment of silence in memory of Alphonse Napolitano. Mr. Napolitano was killed last Friday when a motorist crashed through the gates of the drawbridge in Portsmouth where he was working. Mr. Napolitano, who was from Seabrook, had worked for the Deparment of Transportation for 10 years and was 80 years old.

COMMUNITY DEVELOPMENT FINANCE AUTHORITY
The Governor and Council acted as follows:

#3 Authorized under the Community Development Block Grant Program, to enter into an agreement with the County of Grafton, 3801 Dartmouth College Highway, N Haverhill, NH in the amount of $500,000 to help municipalities solve development problems. Effective upon approval to December 31, 2005.

#4 Authorized under the Community Development Block Grant Program, to amend an existing agreement with the City of Laconia, 45 Beacon Street E, Laconia, NH (previously approved by G&C on 12/18/2002, item 13), to assist the Salvation Army in renovating a homeless shelter, by extending the completion date from June 30, 2004 to June 30, 2005. No additional state or federal funds are required by this action.

#5 Authorized under the Community Development Block Grant Program, to amend an existing agreement with the Town of Littleton, 2 Union St., Littleton, NH (previously approved by G&C on 1/23/02, item #1B and amended on 10/9/2002, item #10), for the purpose of purchasing equipment for an assisted living facility, by extending the end date from June 30, 2004 to June 30, 2005. No additional funds are required by this amendment.

#6 Authorized under the Community Development Block Grant Program, to amend an existing agreement with the Town of Newport, 18 Sunapee St., Newport, NH, (previously approved by G&C on 6/26/2002, item #17, for the purpose of assisting Economic Development Corporation of Newport to renovate the Eagle Hotel, by extending the end date from June 30, 2004 to June 30, 2005. No additional funds are required by this amendment.

GOVERNOR’S COMMISSION ON DISABILITY
#7 The Governor and Executive Council on motion of Councilor Wieczorek, seconded by Councilor Burton, authorized Client Assistance Program to enter into a retroactive educational tuition agreement in the amount of $728 for Pamela Prescott, Administrative Assistant I, at the College of Lifelong Learning, University System of New Hampshire, Merrimack Valley Region, 507B South Street, Bow, NH for a course entitled “Critical Thinking”, for the period April 7, 2004 to June 23, 2004. 100% Federal Funds

OFFICE OF THE ADJUTANT GENERAL
The Governor and Council acted as follows:
#8 Authorized Lt. Commander Christopher E. Cieurzo, 13 Merrill Road, Freeport, ME be confirmed to the rank of Major, New Hampshire Air National Guard.

#9 Authorized Kevin M. Major, 49 Snow Lane, Sandown, NH be confirmed to the rank of Lieutenant Colonel, New Hampshire Army National Guard.

#9A Authorized to amend a sole source contract with Reliable Security Guard Agency, Inc., Salem, NH for the provision of adding additional security services at the new Army Aviation Support Facility, Concord, NH. This amendment increases the three-year contract price limitation amount of $444,266.86 by $21,801.60, for a revised total of $466,068.46. DEPARTMENT OF ADMINISTRATIVE SERVICES
The Governor and Council acted as follows:
#10 Authorized to appoint Peter J. Spaulding as a designee of the Executive Council to hold a hearing on the proposal for the normal capital expenditures project in connection with Concord Hospital, Concord, New Hampshire.

#11 Authorized the Report and Findings of Councilor David K. Wheeler with regard to a certain proposal for the major construction, renovation, furnishing, equipment project and the refinancing of existing indebtedness in connection with Franklin Pierce College, Rindge, New Hampshire.

#11A #34A TABLED – The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Wheeler, voted to table the contract with Helmsman Management, LLC, a subsidiary of Liberty Mutual Insurance Company, Bedford, NH. Effective July 1, 2004 for a period of four years, ending July 1, 2008. This contract price for four years of service is $3,303,712. Contract costs shall be charged back to user agencies where funds have been appropriated.

TREASURY DEPARTMENT
The Governor and Council acted as follows:
#12 Authorized to accept in the name of the state, a gift having a total value of approximately $1,460 from the New Hampshire Bankers Association.

#13 Authorized the comptroller to issue a warrant from funds not otherwise appropriated and the State Treasurer to issue checks in the amount of $4,529.70 to the rightful owners of abandoned or unclaimed funds that have escheated to the general fund.

#14 Authorized to exercise a two year renewal option with Public Resources Advisory Group, Inc., 40 Rector Street, Suite 1600, New York, NY for financial advisory services including debt affordability and debt management. The two year renewal will be from July 1, 2004 to June 30, 2006. Expenses will be paid from 030-038-8022-090-9194 per RSA 6-A: 13, unencumbered and not to exceed $500,000 per year.

#14A The Governor and Executive Council on motion of Councilor Wieczorek, seconded by Councilor Spaulding, authorized to transfer $68,900 as specified in letter dated April 27, 2004. Fiscal Committee Approved

DEPARTMENT OF CULTURAL RESOURCES
#15 The Governor and Executive Council on motion of Councilor Griffin, seconded by Councilor Wieczorek, authorized Division of Arts to award Community Arts Project Grants totaling $4,000 to the VAS Arts of NH, Concord for $1,900 and Pontine Movement Theatre, Portsmouth, for $2,100. 100% General Funds

The Governor and Council acted as follows:
#16 Authorized to amend Item F that was authorized and approved by Governor and Council on December 17, 2003 to increase the salary of Senior Assistant General Simon Brown, Position #9U260, by $5,000 from $71,980 to $76,980. Effective upon G&C approval.

#17 Authorized to accept and expend a grant in the amount of $2,986,870 from the US Department of Justice, Bureau of Justice Assistance for the FY 2004 Byrne Formula Grant Program, for programs to improve the functioning of the criminal justice system. Effective upon G&C approval through September 30, 2007. 100% Federal Funds

DEPARTMENT OF CORRECTIONS
#19 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Wheeler, voted to amend and accept part #1 only of the request from the Department of Corrections to transfer $628,462 and not part #2 because it was denied by the Fiscal Committee, as specified in letter dated May 20, 2004. Fiscal Committee Approved

EMPLOYMENT SECURITY
#20 The Governor and Executive Council, on motion Councilor Burton, seconded by Councilor Wheeler, authorized to enter into a service agreement with Capitol Alarm Systems, Inc., in the amount of $4,700 annually for an agreement total of $14,100 for the three year period from July 1, 2004 or the date of G&C approval whichever is later through June 30, 2007, for alarm systems monitoring services at NHES’s thirteen Local Job & Information Centers located throughout the state. 100% Federal Funds

LIQUOR COMMISSION
The Governor and Council acted as follows:

#21 Authorized to utilize the banking services of Sovereign Bank, 489 Lafayette Road, Seabrook, NH as the depositor of funds for the New Hampshire Liquor Store #28, Seabrook, NH.

#22 Authorized to enter into a contract with Interstate Electrical Services Corp., 70 Tremble Cove Rd., N Billerica, MA with a total price limitation of $158,301, for the period July 1, 2004 through June 30, 2007 for providing alarm and fire system service, repair and 24 hour monitoring at the Liquor Commission administrative office building and at various Liquor Store locations. 100% General Funds

DEPARTMENT OF RESOURCES AND ECONOMIC DEVELOPMENT
The Governor and Council acted as follows:

#23 Authorized to assign vehicle D1 in accordance with Adm 305.02 (c) (4) on a 24 hour, seven day a week basis to the DRED Commissioner.

#24 Authorized the Division of Parks and Recreation to accept a county farm barn donated by Friends of Pisgah, Inc. to be used as an addition to the current park Visitor’s Center. (2) Further Authorized to enter into a Memorandum of agreement with the Friends of Pisgah, Inc. to allow them to relocate and install this barn at Pisgah State Park, from the date of G&C approval to project completion.

#25 Authorized the Division of Parks and Recreation to enter into a service agreement in the amount of $6,496 with Bar Excavating, Inc., PO Box 146, Deerfield, NH to demolish the existing house and garage at Northwood Meadows State Park for the period of Governor and Executive Council approval to June 30, 2004. 100% Park Funds

#26 Authorized the Division of Parks and Recreation to accept a sculpture donated by the Weirs Action Committee, c/o Joseph H. Driscoll III, 12 Maple Street, Weirs Beach, NH. (2) Further Authorized a memorandum of agreement with the Weirs Action Committee for the installation and maintenance of this sculpture at Endicott Rock Historic Site. Effective upon G&C approval through December 31, 2007.

#27 Authorized the Division of Parks and Recreation, Bureau of Trails to enter into Grant-in-Aid Trail Maintenance contracts for a total of $235,674.30 with the OHRV clubs and in the amounts as specified in letter of May 10, 2004. Effective upon G&C approval with a completion date of January 1, 2005. 100% Other Funds

NEW HAMPSHIRE FISH AND GAME DEPARTMENT
The Governor and Council acted as follows:

#31 Authorized toe enter into OFF Highway Recreational Vehicle Law Enforcement contracts pursuant to RSA 215-A:23 with the New Hampshire Police Departments in the amount of $335,646 as specified in letter of May 3, 2004. Effective upon G&C approval with a completion date of June 30, 2005.100% Other Funds

#32 Authorized to expend $63,081 in cooperative fencing grants to qualifying commercial

agriculturists as specified in letter of May 5, 2004. Effective from date of G&C approval through May 30, 2005. 97% Federal Funds/3% Other Funds

#33 Authorized to enter into a contract with Robert J. Condit d/b/a Maple Ridge Septic Service, North Sandwich, NH for an amount not to exceed $2,880 for the cleaning of department-owned portable restrooms for the Squam Lake Boat Access facility. Effective July 1, 2004 through October 26, 2004 pending G&C approval.

#33A Authorized to transfer $269,288.66 from the Fish and Game Fund to the dedicated Waterfowl Conservation Account as specified in letter dated May 4, 2004. Fiscal Committee Approved

DEPARTMENT OF ENVIRONMENTAL SERVICES
The Governor and Council acted as follows:

#34 Authorized to accept and expend $6,350 in federal funds from the Drinking Water State Revolving Loan Fund to cover the cost of audit set aside. Effective from G&C approval through June 30, 2004.

#35 Authorized to accept and expend a $50,450 grant, from the US Environmental Protection Agency for data management and air emissions inventory reporting. Effective upon G&C approval through December 31, 2005. 100% Federal Funds

#36 Authorized to enter into a sole source contract with Ecosystems Research Group, Ltd., Norwich VT in the amount of $20,000 to prepare and provide maps of New Hampshire forest sensitivity to acid deposition. Effective upon G&C approval through December 31, 2005.

#37 Authorized to enter into a cooperative agreement with the University of New Hampshire, Durham, NH in the amount of $354,991 for the purpose of conducting a Protected Instream Flow Study and Water Management Plan for the Souhegan Instream Flow Pilot Program. Effective upon G&C approval through September 30, 2006. 100% General Funds

#38 Authorized to award three Used Oil grants to the Towns of Enfield, Milford, and Moultonborough, NH in the amount of $2,500 for each town, for the purpose of improving and operating their Used Oil Collection Center. Effective upon G&C approval through June 2, 2005. 100% Other Funded

#39 Authorized to amend a Water Supply Land Grant to the Town of Brentwood, NH by extending the completion date to December 31, 2004 from June 30, 2004. The original grant was for $224,200 to purchase four conservation easements in source water protection areas to protect water supply land. (Previously approved by G&C on 6/25/2003, item #148 and a deadline extension was approved by G&C on 12/3/2003 item #35). No additional funding is involved in this extension.

#40 Authorized to enter into a grant agreement with the New Hampshire Lakes Association, Inc., Concord, NH in the amount of $150,000 for the purpose of milfoil prevention activities. Effective upon G&C approval through May 30, 2005. (2) Further Authorized to award an advance payment in the amount of $20,000 to the NHLA in accordance with the terms of the grant agreement. (3) Authorized to enter into a grant agreement with the Ossipee Lake Alliance, Inc., Freedom, NH in the amount of $14,800 for the purpose of milfoil prevention activities. Effective upon approval of G&C through December 31, 2005. (4) Further Authorized to award an advance payment in the amount of $1,875 to the OLA in accordance with the terms of the grant agreement.

#41 Authorized to enter into matching grant agreements with the following Associations and Commissions, in the amounts as listed, for the purpose of milfoil control effective upon G&C approval through September 30, 2004:

Northwood Lake Watershed Association for $10,491.25, Town of Brookline Conservation Commission for $4,887.50, Town of Winchester Conservation Commission for $5,250, Balch Lake Improvement Committee, Inc. For $3,377, Town of Middleton Conservation Commission, for $2,500, Island Marine Association for $1,612.50, Meredith Nautical Club, Inc. for $1,762.50 and Monomonac Lake Property Owners Association for $1,750.

#42 Authorized an amendment to a loan agreement with the Town of Raymond, by increasing the amount by $1,000,000 from $1,500,000 to $2,500,000 to finance a new ground water supply and storage facility under the provision of RSA 486:14 and NH Admin. Rules Env-C 500. Effective upon by G&C approval.

#43 Authorized a Supplemental Loan Agreement with the City of Nashua, which lowers the Amended Loan Agreement by $55,493.21 from $1,572,406.69 to $1,516,913.48, to finance a multi-site landfill closure under the provisions of RSA 486:14 and NH Administrative Rules Env-C 500. Effective upon G&C approval.

#44 Authorized a Supplemental Loan Agreement with the City of Manchester, which lowers the Original Loan Agreement $2,245,153.79 from $4,560,000 to $2,314,846.21, to finance the design and construction of the Varney Street basin separation under the provisions of RSA 486:14 and NH Administrative Rules Env-C 500. Effective upon G&C approval. 80% Federal Funds and 20% General Funds

#45 Authorized William Stewart’s request to construct a 6ft X 20ft pier supported by pilings leading to a 3ft X 36ft ramp and a 10ft X 20 float, on approximately 198 feet of frontage in property located along the Piscataqua River Back channel in New Castle. This project does not conflict with G&C policy on density.

DEPARTMENT OF HEALTH AND HUMAN SERVICES
The Governor and Council acted as follows:

#45A Authorized request to transfer $4,576,193 from general funds not otherwise appropriated into the New Hospital DSH Program; accept $13,976,872 in federal funds and expend $13,243,057 of these federal funds; accept and expend $4,945,357 in other funds, and transfer $2,978,689 of general funds between various accounts within the Department as specified in letter dated May 20, 2004. Fiscal Committee Approved

B. The Governor and Executive Council on motion of Councilor Griffin, seconded by Councilor Spaulding, authorized to enter into an agreement with the Town of Rye, 10 Central Road, Rye, NH, in the amount of $60,000 to construct viewing platforms, walking and wildlife viewing trails, interpretive signage and materials for Awcomin Marsh, effective upon approval by Governor and Council through September 30, 2004. Funds are available in account 010-002-3651-092-0415, Job #02P25002 and are 100% federal.

#88 The Governor and Executive Council, on motion of Councilor Wieczorek, seconded by Councilor Burton voted to remove Item #88 which was tabled on March 24, 2004 Governor and Executive Council Meeting. Councilor Wieczorek, seconded by Councilor Spaulding, voted to approve the request to enter into an agreement with NH Legal Assistance, Manchester, NH, to provide services to homeless individuals, in an amount not to exceed $25,000. Effective retroactive to January 1, 2004 through December 31, 2004. 100% Federal.

Next Council meeting is scheduled for Wednesday, June 23, 2004 at 10:00 a.m. at the State House in Concord, NH.
