The Governor and Executive Council convened at 10:00 a.m. with all members present.

The Governor and Executive Council on motion of Councilor Burton, seconded by Councilor Spaulding accepted the minutes of March 10, 2004.

The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Wheeler confirmed the appointment of several persons nominated for Civil Commissions from the March 10, 2004 meeting.

COMMUNITY DEVELOPMENT FINANCE AUTHORITY
The Governor and Council acted as follows:

#16 Authorized under the Community Development Block Grant Program, to enter into an agreement with the City of Claremont, NH, for the purpose of assisting Pleasant Valley Estates Cooperative to replace the existing individual on-site septic systems by connecting to the public wastewater treatment facility, in the amount of $325,000. Effective upon G&C approval through June 30, 2005.

#17 Authorized under the provisions of the Community Development Block Grant Program, to enter into an agreement with the Town of Lancaster, NH, to study water and sewer infrastructure, in the amount of $12,000. Effective upon G&C approval through June 30, 2005.

#18 Authorized under the Community Development Block Grant Program, to enter into an agreement with the Town of Winchester, NH, for the purpose of assisting Southwestern Community Services Inc., in the development of the "Warwick Meadow" senior housing project, in the amount of $275,000. Effective upon G&C approval through June 30, 2005.

#19 Authorized under the Community Development Block Grant Program, to enter into an agreement with the Town of Meredith, NH, to help municipalities solve development problems, in the amount of $350,000. Effective upon G&C approval through December 31, 2005.

OFFICE OF THE ADJUTANT GENERAL

#21 The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Spaulding, authorized to amend a contract with Pinnacle Mapping Technologies, Inc., (previously approved by G&C on 9-3-03), for performing digital aerial photos to provide data on four NHANG properties and for environmental assessments, by extending the contract end date retroactive from February 1, 2004 to May 31, 2004. 100% Federal Funds.

DEPARTMENT OF ADMINISTRATIVE SERVICES
The Governor and Council acted as follows:

#22 Authorized a Working Capital Warrant in the amount of $370,000,000 to cover expenditures for the month of April 2004. (2)Further Authorized the acceptance of a Working Capital Warrant reporting expenditures of $337,798,768.08 for the month of February and recommends the balance of $12,201,231.92 be lapsed.

#23 Authorized to partner with the City of Concord to conduct an appraisal and structural assessment of the Storrs Street Parking Garage, for an amount not to exceed $10,000.

#24 Authorized to amend a statewide contract with System Automation Corporation, Calverton, MD, (previously approved by G&C on 10-22-03, item #12), for a statewide professional licensing system including software licensing, maintenance, support, training, and installation services, by establishing a price limitation of $711,000 and by extending the expiration date of the contract from June 30, 2004 to June 30, 2005, consistent with the State's first option to renew contained in the original contract.

#25 Authorized to appoint Councilor David K Wheeler as a designee of the Executive Council to hold a hearing on the proposal, as detailed in letter dated March 9, 2004, for the major construction, renovation, furnishing, and equipment project in connection with St. Joseph Hospital, Covenant Health Systems and The Surgi-Center at St. Joseph Hospital, Nashua, NH.

#26 Authorized to accept and place on file the list of agency transfers, as detailed in letter dated March 2, 2004, Authorized for Fiscal Year 2004 during the month of February.

#26A Authorized to amend a contract with MAXIMUS, Inc., Reston, VA, (previously approved by G&C on 6-25-03, item #25), for the planning, system documentation, and system selection for a statewide Enterprise Resource Planning System, by extending the initial nine-month term of the contract from March 31, 2004 to September 30, 2004.

#26B Authorized Bureau of Court Facilities to enter into a retroactive agreement with the Rockingham County Board of Commissioners, for security services of a bailiff provided by the Rockingham County Sheriff Department, in an amount not to exceed $21,500. Effective January 1, 2004 through December 31, 2004.

DEPARTMENT OF AGRICULTURE, MARKETS & FOOD
The Governor and Council acted as follows:

#27 Authorized to accept and expend grant funds in the amount of $25,000 from the Agricultural Marketing Service of the US Department of Agriculture to implement the Organic Certification Cost-Share Program. Effective upon G&C approval through September 30, 2004. 100% Federal Funds.

#28 Authorized to enter into a sole source service agreement for analytical services with the University of NH's Agricultural Experiment Station, Analytical Services Laboratory, Durham, NH, for an amount not to exceed $35,000. Effective retroactive to January 1, 2004 through December 31, 2004. 100% Other Funds.

TREASURY DEPARTMENT
The Governor and Council acted as follows:

#29 Authorized to issue a warrant from funds not otherwise appropriated and the State Treasurer to issue checks in the amount of $5,483.64 to the rightful owners of abandoned or unclaimed funds.

#30 The Governor and Council on motion of Councilor Wheeler, seconded by Councilor Burton, and further on a roll call vote of: Councilor Burton - yes, Councilor Spaulding - yes, Councilor Griffin - yes, Councilor Wieczorek - yes, and Councilor Wheeler - yes, authorized to negotiate the sale and issue of general obligation bonds to refund outstanding bonds to produce net present value debt service savings of at least three percent of the par value of the refunded bonds.

ATTORNEY GENERAL
The Governor and Council acted as follows:

#31 Authorized to appoint Catherine L Bernhard, as an Assistant Attorney General. Effective upon G&C approval through September 30, 2004.

#32 Authorized to appoint Peter K Odom as an Assistant Attorney General. Effective upon G&C approval through October 31, 2005.

#33 Authorized to conduct a two-day conference at the Mount Washington Hotel and Resort scheduled for May 20 and 21, 2004 entitled the Tenth Statewide Conference on Domestic and Sexual Violence at a cost not to exceed $43,580. (2)Further Authorized to enter into an agreement with the Mount Washington Hotel for necessary conference facilities and food services for the two-day advanced training conference in the amount of $29,005 as part of the cost above. (3)Further Authorized to expend funds in support of the conference totaling $4,475, $3,025 of which for printing expenses; and $1,450 for mailing and supplies for the period of G&C approval through December 31, 2004. (4)Further Authorized to expend funds in support of the conference totaling $10,100 for presenter speaking fees, travel and other expenses. 100% Federal Funds.

#34 WITHDRAWN - The Governor withdrew the request to enter into sub-grants for programs aimed to promote gun safety totaling $131,764 with the agencies as detailed in letter dated March 11, 2004. Effective upon G&C approval through September 30, 2005.

#35 Authorized to enter into sub-grants, as detailed in letter dated March 10, 2004, totaling $162,316 to be used to provide equipment and training to criminal justice personnel. Effective upon G&C approval through October 21, 2005. 100% Federal Funds.

DEPARTMENT OF CULTURAL RESOURCES
The Governor and Council acted as follows:

#36 Authorized Division of Libraries, to accept and expend a grant from the Byrne Foundation, Etna, NH, for the Summer Reading Experience, in the amount of $3,100. 100% Other Funds.

#37 Authorized Division of Libraries to retroactively enter into a lease agreement with GB American Inc., Lancaster, NH, for the use of 1500 square feet of office space, in the amount of $97,920. Effective January 1, 2004 through December 31, 2008. 100% Federal Funds.

#38 Authorized to award a Conservation Number Plate Grant in the amount of $10,000 to the City of Nashua, for the preservation of the Hunt Memorial Building. 100% Other Funds.

#39 Authorized to award a Conservation Number Plate Grant in the amount of $10,000 to the Town of Jaffrey, for the preservation of the Jaffrey Meetinghouse. 100% Other Funds.

BANKING DEPARTMENT
#40 The Governor and Council on motion of Councilor Spaulding, seconded by Councilor Wieczorek, authorized to amend a lease with Gloria A Alosa Revocable Trust, Concord, NH, (previously approved by G&C on 10-8-03, item #31), to provide a short-term "hold over" agreement for up to nine months, by extending the date of April 1, 2004 to up to nine months, expiring no later than January 1, 2005, and the new amount is prorated to a monthly rent of $6,400 with a total amount not to exceed $57,600. 100% Other Funds.

PARI-MUTUEL COMMISSION
#41 The Governor and Council on motion of Councilor Wheeler, seconded by Councilor Spaulding, authorized to accept and place on file the Annual Report for the Calendar Year ending December 31, 2003.

PUBLIC UTILITIES COMMISSION
#42 The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Burton, authorized to amend a lease agreement with Gloria A Alosa, Revocable Trust, Concord, NH, for occupancy, by extending the expiration date of March 31, 2004 to June 30, 2004, with a monthly lease amount of $18,900 for the three-month holdover period, thereby increasing the total price limitation by $56,700 from $216,000 to $272,700. 100% Other Funds.

OFFICE OF THE CONSUMER ADVOCATE
The Governor and Council acted as follows:

#43 Authorized to amend a lease agreement with Gloria A Alosa, Revocable Trust, Concord, NH, for occupancy, by extending the expiration date of March 31, 2004 to June 30, 2004, with a monthly lease amount of $1,312.50 for the three-month holdover period, thereby increasing the total price limitation by $3,937.50 from $15,000 to $18,937.50. 100% Other Funds.

#44 Authorized to enter into a contract with LaCapra Associates to assist in analyzing the cost studies and rate design proposed by Public Service Company of NH in its current rate case, the amount not to exceed $16,750. Effective upon G&C approval through December 31, 2004. 100% Other Funds.

DEPARTMENT OF CORRECTIONS
The Governor and Council acted as follows:

#45 Authorized to grant a salary increment for Robert MacLeod, Administrative Director, Division of Medical and Forensic Services, increasing his salary from Group HH, Step 3, $75,806 annually, to Group HH, Step 4, $80, 019 annually. Effective retroactive to October 26, 2003, his anniversary date of employment.
#46 Authorized Dennis D Race, Administrator of Industries, retroactively requesting permission to travel to Atlantic City, NJ, by private automobile in lieu of common carrier, to attend the Northeast Correctional Industries Association's annual conference, October 5-8, 2003.

#47 Authorized to accept a donation of approximately 100 "advanced reading copies" of books from Pat Thomas of Bayswater Books in Center Harbor, NH. These books have not yet been published for sale resulting in no monetary value.

#48 Authorized to accept a donation of 101 books from Jim Reinhardt of Londonderry, NH. The total value of this donation is $10.10.

#49 Authorized to accept a donation of a video from Mr. Clifford Rams of Omaha, NE. The total value of this donation is $19.95.

#50 Authorized with Councilor Griffin voting - no, to accept a donation of craft supplies, books, puzzles, plants and greeting cards from various individuals as detailed in letter dated March 4, 2004. The total value of this donation is $6,258.

#51 Authorized to accept and expend a grant from the US Department of Justice, to be used to implement a comprehensive system for sex offender management for offenders under community supervision in the amount of $249,908. Effective upon G&C approval through June 30, 2005. 100% Federal Funds.

#52 Authorized to amend a sole source contract with Path Lab Inc., (previously approved by G&C on 4-17-02, item #37), for laboratory services at the NH State Prison facilities, increasing the price limitation from $356,866 to $556,866, an increase of $200,000. 100% General Funds.

DEPARTMENT OF RESOURCES AND ECONOMIC DEVELOPMENT
The Governor and Council acted as follows:

#53 Authorized Division of Parks and Recreation to pay the invoice, as detailed in letter dated February 23, 2004, in the amount of $4,020 for emergency service of the snowmaking compressor from Ingersoll Rand Company, Davidson, NC. 100% Other.

#54 Authorized Division of Forests and Lands to accept and expend a donation from Granite State Electric, a National Grid Company, Northborough, MA, for the purpose of encouraging tree care and maintenance in NH communities services by Granite State Electric, in the amount of $5,000.

#54A Authorized Design, Development, and Maintenance to enter into a contract with Ray's Electric Inc., Berlin, NH, for the electrical upgrade for Umbagog State Park Campground and RV Stations, on the basis of a low bid of $24,950. Effective upon G&C approval through June 4, 2004.

FISH AND GAME DEPARTMENT
The Governor and Council acted as follows:

#55 Authorized to grant a retroactive unpaid educational leave to Steve Fuller, Terrestrial Ecologist for the Nongame and Endangered Wildlife Program, Concord, NH, from November 14, 2003 through February 12, 2004. (2)Further Authorized an unpaid educational leave to allow Steve Fuller to finish his Doctoral dissertation, from G&C approval through May 1, 2004.

#56 Authorized to accept and expend $6,697.69 from Mr. Denis Amico for expenses resulting from his son's, Mark Amico, rescue by Fish and Game Personnel on October 26, 2003, and to provide these funds to the NH Outdoor Council, for the purpose of providing search and rescue equipment or training of volunteers from the date of G&C approval.

#57 Authorized to enter into a sole source contract with Donald L. Stevens dba Atlantic Aquasport, Rye, NH, to provide SSI Advanced Open Water Scuba certification for five new members of the Law Enforcement Dive Team, in the amount of $3,000. #59 Authorized to accept transfer of 21 acres of land in Durham, NH, from The Nature Conservancy. The parcel of land known as the Newsky property is located on Dame Road in Durham.

DEPARTMENT OF ENVIRONMENTAL SERVICES
The Governor and Council acted as follows:

#61 Authorized to reclassify position #13048, Administrative Secretary, LG 14 to an Administrative Supervisor, LG 17, due to the recent reorganization within the Office of the Director of the Air Resources Division.

#97 The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Spaulding, voted to authorize the request to amend the Consultants List (previously approved by G&C on 6-25-03, item #263, amended on 9-17-03, item #94), by adding Kenneth Braiterman, Penacook, NH at the rate of $50 per hour, Daniel Bailey, Contoocook, NH, at the rate of $50 per hour and Jennifer A Edgerly, Methuen, MA, at the rate of $40 per hour. Effective upon G&C approval through June 30, 2005.

Next Governor and Executive Council meeting is scheduled for Wednesday, April 7, 2004 at 10:00 a.m. at the State House in Concord, NH.
