The Governor and Executive Council convened at 10:00 a.m. all members present.

The Governor and Executive Council on motion of Councilor Pignatelli, seconded by Councilor Burton, accepted the minutes of March 9, 2005.

The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Pignatelli approved the appointment of several persons nominated for Civil Commissions from the March 9, 2005 meeting.

The Governor placed in nomination the several persons who applied for Civil Commissions.

COMMUNITY DEVELOPMENT FINANCE AUTHORITY
The Governor and Council acted as follows:

#8 Authorized under the Community Development Block Grant program, to amend an agreement with the Town of Plymouth, NH, (previously approved by G&C on 9-22-04, item #4), to assist Pemi Bridge House, Inc., in the development of a homeless shelter facility, by increasing the price limitation by $350,000 for a new total of $700,000. Federal Funds.

#9 Authorized, under the Community Development Block Grant Program, to enter into an agreement with the Town of Walpole, NH, for the purpose of assisting in the retention of jobs, and of a unique manufacturing business, J.H. Dunning, a private company, in the amount of $450,000. Effective upon G&C approval through December 31, 2005. Federal Funds.

OFFICE OF THE ADJUTANT GENERAL
The Governor and Council acted as follows:

#10 Authorized to enter into a retroactive sole source contract with Arch Equipment and Repair of Bow, NH, for the purpose of performing repairs to the dump truck used at the Veterans Cemetery in Boscawen, NH, in the amount of $3,361.74. 81.13% General, 15.78% Federal, 3.09% Other Funds.

#11 Authorized to enter into a contract with N.E. Tree Transplanting of Gilmanton Iron Works, NH, to perform Tree Spade Transplanting Services in support of habitat restoration activities at the State Military Reservation, for a maximum price of $32,000. Effective upon G&C approval through May 31, 2006. 100% Federal Funds.

DEPARTMENT OF ADMINISTRATIVE SERVICES
The Governor and Council acted as follows:

#12 Authorized a Working Capital Warrant in the amount of $410,000,000 to cover expenditures for the Month of April 2005. (2)Further Authorized a Working Capital Warrant reporting expenditures of $318,357,718.43 for the Month of February and recommends the balance of $181,642,281.57 be lapsed.

#13 Authorized to accept and place on file the Employee Benefit Adjustment Fund and in conformance with the G&C action of January 6, 2005, the agency transfers were Authorized for the month of February, as detailed in letter dated March 3, 2005.

#14 Authorized to accept and place on file a list of agency transfers Authorized for Fiscal Year 2005, during the month of February.

#15 Authorized Surplus Distribution Section to enter into a retroactive contract with the Belknap-Merrimack Community Action Program, to provide statewide surplus food distribution for the Emergency Food Assistance Program for a total not to exceed $340,000. Effective October 1, 2004 through September 30, 2006.

#16 Authorized to amend a current contract with Major L. Rodd Inc., dba Rodd Roofing, St. Johnsbury, VT, (previously approved by G&C on 8-18-04), to provide slate roof repair services at the Bancroft Building in Concord, NH, by extending the termination date from September 30, 2004 until March 30, 2005 in an amount not to exceed $13,850.

#17 Authorized to accept and place on file the Fifty Fourth Annual Report, for the Division of Personnel.

TREASURY DEPARTMENT
The Governor and Council acted as follows:

#18 Authorized to accept and place on file the quarterly reports in accordance with RSA 6-B:2, VII relative to the cash position of the State as of September 30, 2004 and December 31, 2004. Informational Item.

#19 Authorized to issue a warrant from funds not otherwise appropriated and the State Treasurer to issue checks in the amount of $19,754.53 to the rightful owners of abandoned or unclaimed funds.

DEPARTMENT OF CULTURAL RESOURCES
#20 The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Spaulding authorized the request the Division of Libraries to accept and expend a grant form the Cogswell Benevolent Trust, Manchester, NH, in the amount of $1,500 for the Summer Reading Experience. 100% Other Funds.

ATTORNEY GENERAL
#20A The Governor and Council on motion of Councilor Pignatelli, seconded by Councilor Spaulding authorized the request the approval be, and it hereby is, given to the Attorney General to nominate Elizabeth A, Dunn to serve on the NH Victims' Assistance Commission. Ms. Dunn's term will be for three years from G&C approval.

BANKING DEPARTMENT
#21 The Governor and Council on motion of Councilor Burton, seconded by Councilor Wieczorek authorized the request to budget and expend prior year Consumer Credit Administration funds, fees, and fines, in the amount of $112,748 to provide funding for operational expenses in building maintenance, equipment, and temporary personnel services. Effective upon G&C approval through June 30, 2005. 100% Other Funds.

EMPLOYMENT SECURITY
The Governor and Council acted as follows:

#22 Authorized to enter into a service agreement with Granite State Home Improvements, Inc., for vinyl siding and vinyl soffit services at NHES's Concord local office, Concord, NH, in the amount of $10,250. Effective upon GC approval through June 30, 2005. 100% Other Funds.

#23 Authorized to continue one Clerk I, position # 8T062, salary grade 02 on a full-time temporary basis for a additional six months retroactive to January 16, 2005 through July 16, 2005. 100% Federal Funds.

OFFICE OF THE CONSUMER ADVOCATE
#24 The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Spaulding authorized the request to enter into a contract with Stephen G Hill of Hurricane, WV, to provide expert testimony related to the cost of equity to be used in setting Transition Service rates for Public Service Company of NH, in an amount not to exceed $17,025. Effective upon G&C approval through December 31, 2005. 100% Other Funds.

LIQUOR COMMISSION
#25 The Governor and Council on motion of Councilor Burton, seconded by Councilor Spaulding authorized the request to enter into a contract with D&D Restoration LLC, Londonderry, NH, for the sole purpose of repairing the entry canopy on Storrs Street, Concord, NH, for a total of $7,000. Effective upon G&C approval through April 30, 2005. 100% General Funds.

DEPARTMENT OF RESOUCES AND ECONOMIC DEVELOPMENT
The Governor and Council acted as follows:

#26 Authorized Division of Parks and Recreation to accept donations totaling $810 from a list of donors in memory of Mr. Robert Holt. The donations will be deposited into the Parks Fund.

#27 Authorized Division of Forests and Lands to enter into a sole source contract with Hearst-Argyle Television Inc WMUR-TV9 of Manchester, NH, to buy commercial air time to heighten public awareness of wildland fire safety and prevention issues, in the amount of $3,000. Effective upon G&C approval through April 30, 2005. 94.09% General, 5.91% Federal Funds.

#28 Authorized Division of Parks and Recreation to retroactively pay for emergency repairs to the Caterpillar 3306 generator on the summit of Mount Washington, on a sole source basis with Southworth Milton, Scarborough, ME, for a total of $2,803.10. 100% Other Funds.

NEW HAMPSHIRE FISH AND GAME DEPARTMENT
The Governor and Council acted as follows:

#29 Authorized to enter into a sole source contract with Upland Resource Group, Inc., Bristol, VT, for the purpose of developing an estimate of the browse based carrying capacity for moose in northern NH, in the amount of $5,000. Effective upon G&C approval through June 30, 2005. (2)Further Authorized advance payment of $2,500 to Upland Resource Group, Inc., in accordance with the terms of the contract, upon G&C approval. 100% Other Funds.

#30 Authorized to enter into a sole source contract with Stonehearth Open Learning Opportunities, Inc., Conway, NH, to provide certification and re-certification of all the Department's Conservation Officers in the amount of $14,000. DEPARTMENT OF ENVIRONMENTAL SERVICES
The Governor and Council acted as follows:

#33 Authorized to expend $13,298 for annual dues toward the operating expenses of the New England Interstate Water Pollution Control Commission for 2005.

#34 Authorized to pay 2005 membership dues to the Association of State Drinking Water Admnistrators, Washington, DC, in the amount of $6,000. Effective upon G&C approval. 100% Federal Funds.

#35 Authorized to accept and expend $162,528.29 in federal funds from the US Environmental Protection Agency, for the Beach Environmental Assessment and Coastal Health Program. Effective upon G&C approval through September 30, 2006.

#36 Authorized to accept and expend $458,224 in federal funds from the US Environmental Protection Agency under the State Response Program for the clean up of hazardous waste sites. Effective upon G&C approval through September 30, 2005.

#38 Authorized to retroactively enter into a joint funding agreement with the US Geological Survey, Pembroke, NH, to conduct biological water quality monitoring in the Exeter River watershed for $24,914. Effective October 1, 2004 through September 30, 2005. 100% Federal Funds.

#40 Authorized to enter into a sole source agreement with the University of NH, Complex Systems Research Center, Durham, NH, to digitize twenty one 1:24,000-scale surficial geology maps, in the amount of $22,200. #46 Authorized to amend a sole source contract with Weston Solutions, Inc., Manchester, NH, (previously approved by G&C on 4-7-04, item #45), for operations and maintenance, data evaluation and litigation services, by increasing the contract by $128,209 from $2,880,523 to $3,008,732 and extending the completion date from March 31, 2005 to March 31, 2006.

#47 Authorized to amend a Public Water System Emergency Interconnection grant award to the City of Dover, NH, (previously approved by G&C on 9-8-04, item #71), to include the Town of Newmarket to the list of participating communities, by increasing the grant to $50,000 from $45,000 and extending the completion date to December 31, 2005 from June 30, 2005.

#48 Authorized to award a Household Hazardous Waste grant to the City of Portsmouth, NH, for the purpose of conducting a household hazardous waste collection project, for an amount not to exceed $5,221.63. Effective upon G&C approval through December 31, 2005. 100% Other Funds.

#49 Authorized to enter into an agreement with the Blue Ocean Society for Marine Conservation, Greenland, NH, for implementation of the Watershed Restoration Plan for Hodgson Brook, in the amount of $69,505. Effective upon G&C approval through October 31, 2007. 100% Federal Funds.

#53 Authorized to approve an original loan agreement with Hanover Water Works to finance the design and construction of a new surface water treatment facility and finished water storage tank subject to conditions as outlined in documents substantially in the form as detailed in letter dated February 14, 2005, in the amount of $6,500,000. #54 Authorized with Council Spaulding and Councilor Pignatelli voting no, Frank Giebutowski's request to amend a permit (previously approved by G&C on 5-21-03), to reconfigure a seasonal pier associated with the proposed dug-in boathouse on property located at Lake Winnipesaukee in Wolfeboro.

#67 Authorized to conduct a one-day conference for approximately 60 NH health educators on April 8, 2005, for a total cost of $5,727.13. (2)Further Authorized to enter into a short-form contract with the Centennial Inn, Concord, NH, to provide the necessary conference facilities and food services for approximately 60 participants on April 8, 2005, in an amount not to exceed $1,759.38 as part of the cost above. #68 Authorized to conduct the New England Partners Collaborative Conference for representatives from the New England and New York region funded through the Centers for Disease Control grant for Improving Health, Education, and Well-Being of Young People for collaborative efforts involving professional development, for a total cost not to exceed $6,797.84. (2)Further Authorized to enter into a contract with the New England Center, Durham, NH, to provide the necessary conference facilities and food services for approximately eighteen participants during the period from March 29-30, 2005 in an amount not to exceed $5,429 as part of the cost above. (3)Further Authorized to pay fees for one presenter during the period from March 29-31, 2005 in an amount not to exceed $350 as part of the cost above. #69 Authorized to enter into a contract with Debra D. Grabill, sole proprietor, Hanover, NH, to coordinate the NH State Improvement Grant II secondary education and transition initiative, for an amount not to exceed $56,160. Effective upon G&C approval through June 30, 2006. (2)Further Authorized to exercise a renewal option on this contract for up to three additional fiscal years, subject to the contractor's acceptable performance of the terms therein. POLICE STANDARDS & TRAINING COUNCIL
#70 The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Burton authorized the request to accept and expend grant funds from the NH Highway Safety Agency, for a grant entitled Crash Investigation Training, in the amount of $9,316. Effective upon G&C approval through June 30, 2005. (2)Further Authorized to enter into a service agreement with the Institute of Police Technology and Management of the University of North Florida to teach a specialized in-sevice class during FY05 to police officers at the NH Police Standards & Training Council facility in Concord: "Pedestrian/Bicycle Crash Investigation" in the amount of $8,500. 100% Other Funds.

DEPARTMENT OF SAFETY
The Governor and Council acted as follows:

#71 Authorized the Division of Motor Vehicles and the office of Information Technology to amend an existing agreement with Bearing Point, formerly KPMG Consulting, by extending the completion date of the Municipal Agent Automation Program from July 31, 2005 to October 15, 2005. Effective upon G&C approval.

#72 Authorized the Division of Motor Vehicles to pay annual dues in the amount of $5,000 to the Commercial Vehicle Safety Alliance, Washington, DC. Effective upon G&C approval.

#73 Authorized the Division of Motor Vehicles to reclassify position #10475 from a Driver Licensing Officer, labor grade 14 to a Highway Patrol and Enforcement Officer I, labor grade 19. Effective upon G&C approval.

#74 Authorized Division of Emergency Services, Communications, and Management, Bureau of Emergency Management to hold a workshop for "Hazardous Weather & Flood Preparations" and "Warning Coordination" on April 12, 13, and 14, 2005 at the Red Jacket Mountain View, LLC, North Conway, NH, for an amount not to exceed $7,943.25. (2)Further Authorized a contract with the Red Jacket Mountain View, LLC, North Conway, NH, for a function room, meals, and rooms in the amount of $7,943.25. Effective upon G&C approval through April 14, 2005.

#75 Authorized Division of Emergency Services, Communications and Management to accept and expend unbudgeted revenue in the amount of $100,548 received as part of the yearly assessment for the Seabrook Station. Effective upon G&C approval through June 30, 2005.

#76 Authorized Division of State Police to accept and expend a grant in the amount of $45,704.33 from the NH Highway Safety Agency entitled "NH State Police Join the NH Clique Seat Belt Campaign" to fund seatbelt enforcement patrols. Effective May 1, 2005 through September 30, 2005.

#77 Authorized Division of State Police to reallocate a US Department of Justice, FY 2004 BSA Congressionally Mandated Award (Operation Street Sweeper) in the amount of $1,484,216, (previously approved by G&C on 11-10-04, item #132).

#78 Authorized Division of State Police to retroactively accept and expend a grant in the amount of $22,897.50 from the NH Highway Safety Agency entitled "NH State Police DWI Patrols" to fund DWI enforcement patrols. Effective February 24, 2005 through September 15, 2005.

#79 Authorized Division of State Police to retroactively accept and expend a grant from the NH Department of Justice in the amount of $25,525.50 for the purpose of achieving lab certification. Effective January 26, 2005 through September 30, 2005.

#80 Authorized Division of State Police to retroactively amend a grant in the amount of $196,927 from the US Department of Justice entitled "In-Car Camera Grant", (previously approved by G&C on 3-24-04 Late Item A), by extending the grant period from March 24, 2004 through August 19, 2005.

#81 Authorized Division of Safety Services to contract with Breton Construction, LLC, Laconia, NH, to complete construction of a drive in level approach for building access at the Belmont facility on Route 106, in the amount of $4,200. Effective upon G&C approval through June 30, 2005.

#82 Authorized Division of Motor Vehicles to enter into a sole source memorandum of agreement with the NH Technical Institute, Concord, NH, to provide classroom and parking lost space for the Motorcycle Rider Training Program, in the amount of $24,750. Effective April 1, 2005 through December 31, 2005.

#83 Authorized with Councilor Pignatelli voting no, Division of State Police to amend an existing sole source contract with Maillet Construction, New Ipswich, NH, for snow plowing/shoveling for State Police Troop B located in Milford, by increasing the contract amount by $5,000 from $8,000 to $13,000. Effective upon G&C approval through June 30, 2005.

#84 Authorized with Councilor Wieczorek voting no, Division of State Police to amend an existing agreement with Bearing Point, by increasing the scope of work on the Criminal Justice Information System and increasing the cost of the agreement from $2,447,000 to $3,023,880 an increase of $576,880.

#85 Authorized with Councilor Pignatelli voting no, Division of State Police to amend an existing sole source contract with Anthony J LaBounty, East Swanzey, NH, for snow plowing/shoveling for State Police Troop C located in Keene, by increasing the amount from $8,000 to $13,000. Effective upon G&C approval through June 30, 2005.

#86 Authorized an agreement between Division of Emergency Services, Communications, and Management, Bureau of Emergency Management and the Town of Alton, for activities associated with enhancing local all-hazard planning, for $28,000. Effective upon G&C approval through March 31, 2005.

#87 Authorized Division of Fire Standards & Training and Emergency Medical Services to enter into a sole source contract with Economy Plumbing and Heating, Inc., dba Controtech, Keene, NH, to provide annual inspection and maintenance service on the boilers at the Fire Academy, for $7,284. Effective April 1, 2005 through March 31, 2006.

#88 Authorized the application permit of Stone Gate Acres Association located on Newfound Lake in Hebron, NH, for a congregate mooring field, for a total of 20 moorings.

#89 Authorized the application permit of the Mallards' Landing Association located on Winnisquam Lake in Belmont, NH, for a congregate mooring field, for a total of 33 moorings.

#90 Authorized the application permit of Granliden Community Association located on Sunapee Lake in Sunapee, NH, for a congregate mooring field, for a total of 18 moorings.

DEPARTMENT OF TRANSPORTATION
The Governor and Council acted as follows:

#91 Authorized the Bureau of Right of Way's petition for a hearing on alteration to NH Route 108 in the Towns of Durham and Newmarket, and to appoint a commission to layout the new highway at this location with a suggested budget of $8,836.50.

#92 Authorized to accept and place on file the Bureau of Right of Way's Contemplated Award List for the period of February 17, 2005 through March 2, 2005.

#93 Authorized Division of Aeronautics to accept and expend $241,429 in Federal Funds for the AIP-41 airport development project. (2)Further Authorized to provide additional participation to the City of Manchester, NH, for the Aip-41 airport development project to reconstruct and mark the runways at the Manchester Airport in the amount of $254,841.72. Effective upon G&C approval.

#94 Authorized to accept and expend $76,169 in Federal Funds for the AIP-20 airport development project. (2)Further Authorized to provide additional participation to the Pease Development Authority, for the AIP-20 airport development project to construct a terminal parking lot at the Pease International Tradeport Airport in the amount of $84,632.22. Effective upon G&C approval.

#95 Authorized Bureau of Rail & Transit to renew a lease agreement with MaryEllen Szetela and Stanley Szetela, dba Arthur's Memorials, North Conway, NH, to lease a parcel of Land associated with the State-owned Mountain Division of Railroad Line in Conway for $1,000 per year. Effective upon G&C approval through March 31, 2010.

#96 Authorized Bureau of Rail & Transit to renew a lease agreement with Craig O Weed, Hinsdale, NH, for a parcel of land on the State-owned Ashuelot Branch Railroad Line in Hinsdale for $100 per year for a period of five years.

#97 Authorized Bureau of Highway Maintenance contract with Larry G. Cushing & Sons, Inc., Walpole, NH, on the basis of a low bid of $24,989.20 for a drilled well and pump on the property of Robert Mazza, Kingston, NH. Effective upon G&C approval.

#98 Authorized Bureau of Construction to enter into a contract with The Lane Construction Corp., Meriden, CT, on the basis of a single bid of $4,865,879.35, for pavement rehabilitation and safety work along NH Route 9 in Chesterfield. Effective upon G&C approval through October 14, 2005.

#99 Authorized Bureau of Public Works to enter into a contract with Harvey Construction Corporation of NH., Bedford, NH, for construction of Mechanical Services Facility on NH Route 106 in Concord, NH for the lump sum price of $10,070,000. (2)Further Authorized for payment to the NH DOT, Bureau of Public Works for engineering services provided for the project in the amount not to exceed $75,000.

#100 Authorized Bureau of Public Works to enter into a contract with P.J. Stella Construction Corporation, Wakefield, MA, for construction of materials and research facility in Concord, NH, for the lump sum price of $5,767,000. (2)Further Authorized for payment to the NH DOT, Bureau of Public Works for engineering services provided for the project in the amount not to exceed $100,000.
