The Governor and Executive Council convened at 10:00 a.m. all members present.

The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Burton, accepted the minutes of the March 6, 1996 meeting.

The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Burton, confirmed the appointment of several persons nominated for Civil Commissions at the March 6, 1996 meeting.

TABLED - The Governor and Executive Council, on motion of Councilor Griffin, seconded by Councilor Rinker, voted to TABLE the contract with Willis Corroon Corporation of Rochester at $4,600 for consulting services in regard to the renewal of health insurance plans for state employees through June 30, 1996.

DEPARTMENT OF REVENUE
The Governor and Executive Council acted as follows:

#27. Authorized out of state travel for the period of April/May/June 1996 for the Collection Division in connection with their normal state duties.

DEPARTMENT OF CULTURAL RESOURCES
#29. The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, authorized to accept and expend a federal ISTEA Grant through the Department of Transportation in the amount of $1,033.05 through June 30, 1997.

DEPARTMENT OF AGRICULTURE, MARKETS & FOOD
#30. The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Streeter, authorized to assign motor vehicles on a 24 hour, seven day a week basis to the State Veterinarian, Entomologist and Director of Pesticide Control.

DEPARTMENT OF JUSTICE
#31. The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, with Councilor Griffin voting NO, authorized to reallocate $9,576.98 and $288,031.74 from two previously accepted federal grants from the federal Department of Justice, further Authorized to grant funds to the Division of State Police in the amount of $335,505.66 and to the Administrative Office of the Courts in the amount of $391,160 through December 31, 1996.

BANKING DEPARTMENT
#32. The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Burton, authorized out of state travel to attend impromptu meetings and consultations with bank regulators from April through June 30, 1996.

INSURANCE DEPARTMENT
#33. The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, authorized to transfer $13,079 as stated in letter of February 26, 1996. Fiscal Committee approved March 6, 1996.

PUBLIC UTILITIES COMMISSION
#34. The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Burton, authorized out of state travel to attend meetings, audits, workshops and conferences for the fourth quarter of FY96.

EMPLOYMENT SECURITY
35. The Governor and Executive Council, on motion of Councilor Rinker, seconded by Councilor Burton, authorized to accept federal funds of $292,077 from the US Department of Labor, Employment and Training Administration Division through March 11, 1997.

DEPARTMENT OF CORRECTIONS
The Governor and Executive Council acted as follows:

#36. Authorized to accept and expend $44,626 from the NH Department of Justice and to establish a Probation/Parole Office position through June 30, 1997 as stated in letter of February 9, 1996. Fiscal Committee approved March 6, 1996.

#37. Authorized to transfer $133,154 as stated in letter of February 22, 1996. Fiscal Committee approved March 6, 1996.

#38. Authorized to amend agreement with General Security Services Corp. by extending the end date from March 22 to September 22, 1996.

#39. Authorized to grant a waiver for the Lebanon District Office from the clean air testing required.

DEPARTMENT OF RESOUCES AND ECONOMIC DEVELOPMENT
The Governor and Council acted as follows:

#40. Authorized to expend $34,783 in excess revenue from the Forest Management and Protection Funds as stated in letter of February 6, 1996.

#41. Authorized to reallocate $22,500 in federal funds under the Cooperative Forestry Assistance Act.

NEW HAMPSHIRE FISH AND GAME DEPARTMENT
The Governor and Council acted as follows:

#42. Authorized to accept a donation of $750 from the NH Antler and Skull Trophy Club. Further Authorized to accept and expend $2,252.25 in matching Pittman-Robertson Federal Aid in Wildlife Restoration Funds.

#43. Authorized to amend the ending date to accept money from the US Fish and Wildlife Services for Anadromous fish restoration in the Connecticut River from June 30, 1996 to June 30, 1997.

#44. Authorized to accept and expend funds of $3,442.57 in Federal Aid in Sport Fish Restoration funds and to establish a Laborer position through June 30, 1996 as stated in letter of February 21, 1996. Fiscal Committee approved March 6, 1996.

#45. Authorized to transfer $25,000 from the Fish and Game Reserve as stated in letter of February 15, 1996. Fiscal Committee approved March 6, 1996.

#46. Authorized up to four personnel assigned to the Atlantic States marine Fisheries Commission to travel throughout New England and mid-Atlantic states to attend up to sixteen meetings through June 30, 1996.

#47. Authorized two personnel assigned to the New England Fishery management Council to travel throughout New England to attend up to twelve meetings through June 30, 1996.

#48. Authorized to accept the summary of the results of the research project with UNH on the applicability on infrared aerial survey technology to determine moose population densities.

DEPARTMENT OF ENVIRONMENTAL SERVICES
The Governor and Council acted as follows:

#49. Authorized to accept an additional $38,000 from the US Environmental Protection Agency for the Public Drinking Water Program through September 30, 1996.

#50. Authorized to budget additional water user fees of $4,200 through June 30, 1996.

#51. Authorized contract with the City of Laconia at $50,000 to develop and implement the Lake Opechee stormwater System Rehabilitation project through December 30, 1997.

#52. TABLED - The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Griffin, voted to TABLE the contract with the Lake Sunapee Protective Association of Georges Mills at $25,000 to improve water quality until the Governor and Executive Council meeting on April 10, 1996.

#53. Authorized to accept and place on file, the 1995 Annual Report of the Water Supply and Pollution Control Council.

#54. Authorized out of state travel for two Special Investigations Section staff from April 1 through June 30, 1996.

#55. Authorized to accept $86,657 from the US Environmental Protection Agency and to establish a Supervisor VII position through June 30, 1997 as stated in letter of February 14, 1996. Fiscal Committee approved March 6, 1996.

DEPARTMENT OF HEALTH AND HUMAN SERVICES
#56. TABLED - The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Griffin, voted to TABLE the agreement with M.L. Hannay of Portsmouth at $20,000 for a training program entitled "Managing the Change Process" and to expend up to $9,000 in related services for this training through June 30, 1996.

DIVISION OF PUBLIC HEALTH SERVICES
The Governor and Executive Council acted as follows:

#57. Authorized to accept and expend funds of $10,120 from the Maternal and Child Health Block Grant to fund the NH Planning Initiative: Home Visiting for At-Risk Families through June 30, 1996.

#58. Authorized to accept and expend $135,517 in Title X funds from the US Department of Health and Human Services through June 30, 1996.

#59. Authorized to transfer $40,450 if FY97 and $44,500 in FY98 funds to convert one full time temporary Lab Scientist II position to that of full time and continue one part time Lab Assistant I position through December 31, 1996 as stated in letter of January 18, 1996. #60. Authorized to continue a Program Specialist II position through June 30, 1997 as stated in letter of January 23, 1996. Fiscal Committee approved March 6, 1996.

#61. Authorized contract with NE Technology Group, Inc. of Cambridge, MA at $72,900 to assist in a health education program video through December 31, 1996.

#62. Authorized to amend contract with the Trustees of Dartmouth College of Hanover by increasing dollar amount by $10,000, from $113,000 to $123,000 through June 30, 1996.

#63. Authorized to amend agreement with Coos County Family Health Services, Inc. of Berlin by increasing dollar amount by $92,495, from $455,059 to $547,554 through June 30, 1997.

#64. Authorized to amend agreement with Planned Parenthood of Northern NE, Inc. of Williston, VT by increasing dollar amount by $2,901, from $16,500 to $19,401 through June 30, 1996.

#65. Authorized to amend agreement with Northern NH Mental Health and Developmental Services of Conway by increasing dollar amount by $2,900, from $22,000 to $24,900 through June 30, 1996.

#66. TABLED - The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, voted to TABLE the agreement with Tucker Alan, Inc. of Seattle WA at $25,000 to provide litigation support and expert witness testimony regarding HB32 through July 1, 1996.

#67. Authorized agreement with Country Squire Investigations & Security of Bow at $16,694.10 to provide uniformed and armed security guards for the Food Stamp Program through June 30, 1998.

DIVISION OF ELDERLY AND ADULT SERVICES
#68. The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, authorized agreement with Richard E. Mullaly of West Lebanon at $500 per case to provide legal services for two years.

DEPARTMENT OF EDUCATION
The Governor and Council acted as follows:

#69. Authorized to grant funds totalling $60,416 to eligible non-profit recipients through November 30, 1996 as stated in letter of February 16, 1996.

#70. Authorized to grant funds of $4,695.30 to Notre Dame College through August 30, 1996 as part of the Dwight D. Eisenhower Professional Development Program.

#71. Authorized to expend additional revenue of $51,816,54 through June 30, 1996.

#72. Authorized to reclassify position of Word Processor Operator I, LG 8 to Library Associate, LG 13.

#73. Authorized to conduct a one day conference focusing on School-to-Work partnerships at the Holiday Inn at the Center of NH in Manchester at $13,358.

DEPARTMENT OF POSTSECONDARY TECHNICAL EDUCATION
The Governor and Executive Council acted as follows:

#74. Authorized to extend temporary full time TI/C Associate Professor position from June 6, 1996 through June 5, 1997.

#75. Authorized to RETROACTIVELY accept and expend grant fund of $55,000 and to continue a Secretary Typist and Computer Applications Programmer II positions through June 30, 1996 as stated in letter of February 26, 1996. Fiscal Committee approved March 6, 1996.

#76. Authorized agreement with the NH Job Training Council to accept and expend grant funds of $139,462 and to provide coordinate services for the development and implementation of the Manufacturing Extension Partnership program through February 28, 1997.

#77. Authorized to accept and expend grant funds of $1,150 from the NH College & University Council through September 15, 1996.

Technical Institute
#78. Authorized to accept and expend additional donations of $6,322.05 from individuals using the Comprehensive Dental Program through June 30, 1996.

POLICE STANDARDS & TRAINING COUNCIL
#79. The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, authorized agreement with the NH State Police to provide a staff member at the 109th Police Academy for ten weeks at $4,700.

POSTSECONDARY EDUCATION COMMISSION
#80. The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, authorized contract with Stephen C. Shaw at $3,000 to provide technical assistance and writing services in the development revision and dissemination of the rules through December 31, 1996.

SWEEPSTAKES COMMISSION
The Governor and Executive Council acted as follows:

#81. Authorized out of state travel for the fourth quarter of FY96 in the execution of the Tri-State Megabucks program.

#82. Authorized contract with Scientific Games, Inc. at $1,700,000 to purchase instant game tickets as stated in letter of January 20, 1996. Fiscal Committee approved March 6, 1996.

DEPARTMENT OF SAFETY
The Governor and Council acted as follows:

Authorized to transfer $20,000 as stated in letter of February 14, 1996. Fiscal Committee approved March 6, 1996.

#84. Authorized to transfer $100,000 from the Highway Fund Surplus Account as stated in letter of January 30, 1996. Fiscal Committee approved March 6, 1996.

#85. Authorized to accept federal funds of $8,706.19 from the NH Highway Safety Agency and to establish a Statistical Clerk I position through September 30, 1996 as stated in letter of February 21, 1996. Fiscal Committee approved March 6, 1996.

#86. Authorized to accept federal funds of $1,882.88 from the NH Highway Safety Agency through April 30, 1996.

#87. Authorized to accept federal funds of $1,271.51 from the NH Highway Safety Agency and further Authorized out of state travel for Captain David McCarthy to attend the Operation CARE National Conference on April 13-17, 1996 at a cost of $1,135.07.

NH PORT AUTHORITY
#88. The Governor and Executive Council, on motion of Councilor Griffin, seconded by Councilor Streeter, authorized to expend $18,000 of additional mooring fees in the Harbor Management Program as stated in letter of February 22, 1996. Fiscal Committee approved March 6, 1996.

DEPARTMENT OF TRANSPORTATION
The Governor and Council acted as follows:

#89. Authorized to expend $18,000 from the Special Railroad Fund to purchase crossites to be installed on the state owned portion of the Mountain Division Railroad Line as stated in letter of February 20, 1996. Fiscal Committee approved March 6, 1996.

#90. Authorized to expend $7,500 from the Special Railroad Fund to repair culverts on the state owned Concord to Lincoln Railroad Line as stated in letter of February 20, 1996. Fiscal Committee approved March 6, 1996.

#91. Authorized to expend $24,000 from the Special Railroad Fund to reimburse various state owned railroad lines for weed control as stated in letter of February 23, 1996. Fiscal Committee approved March 6, 1996.

#92. Authorized to pay Small Claims for the period of April, May and June 1996.

#93. Authorized to accept the Equipment Acquisition Plan Status Report for the period ending February 29, 1996.

#94. Authorized to accept the Contemplated Award List for the period of February 17 through March 1, 1996.

#95. Authorized to appoint a Commission to hold a hearing on an alteration to Main Street in the Town of Rumney. The Commission will consist of: John Sanborn of Plymouth, John Fogarty of Center Ossipee and Cynthia Poole of New Durham.

#96. Authorized to appoint a Commission to hold a hearing on an alteration to Stinson Lake Road in the Town of Rumney. The Commission will consist of: John Sanborn of Plymouth, John Fogarty of Center Ossipee and Cynthia Poole of New Durham.

#97. AMENDED - The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Rinker, authorized to appoint a Commission to hold a hearing for alteration to NH Rte. 25 and Limekiln Road in the Town of Haverhill.
