GOVERNOR AND EXECUTIVE COUNCIL MINUTES

The Governor and Executive Council convened at 10:00 a.m. with Councilor Spaulding, Councilor Griffin, and Councilor Pignatelli present. Councilor Burton and Councilor Wieczorek were absent.

The Governor and Executive Council on motion of Councilor Griffin, seconded by Councilor Spaulding, accepted the minutes of February 25, 2005.

The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Pignatelli approved the appointment of several persons nominated for Civil Commissions from the February 25, 2005 meeting.

COMMUNITY DEVELOPMENT FINANCE AUTHORITY
The Governor and Council acted as follows:

#1   Authorized to retroactively amend, under the Community Development Block Grant program, an existing agreement with the Town of Northfield, NH (previously approved by G&C on 1-7-04, item #6), to upgrade deficient sewer systems within the Mill Hill Mobile Home Park, by extending the end date from December 31, 2004 to December 31, 2005.

#2   Authorized under the Community Development Block Grant program to retroactively amend an agreement with the Town of Northumberland, Groveton, NH, (previously approved by G&C on 7-10-02, item #12A, amended on 1-21-04, item #5), to make improvements to municipal water and sewer distribution systems, by extending the completion date from December 31, 2004 to June 30, 2006 and increasing the price limitation by $350,000 for a new total of $700,000. Federal Funds.

#3  Authorized under the Community Development Block Grant program to enter into an agreement with the Town of Antrim, NH, for the purpose of assisting Antrim Girls' Shelter in the renovation and expansion of the existing facility in the amount of $350,000. Effective upon G&C approval through June 30, 2006. Federal Funds.

#4  Authorized under the Community Development Block Grant program to enter into an agreement with the County of Belknap, Laconia, NH, for the purpose of assisting Laconia Area Community Land Trust, Inc. in the development of the "Mechanic Street School Housing" project, in the amount of $425,000. Effective upon G&C approval through June 30, 2006. Federal Funds.

#5  Authorized under the provisions of the Community Development Block Grant Program, to enter into an agreement with Cheshire County, Keene, NH, for the purpose of assisting the Keene Housing Authority in the development of an affordable housing project, in the amount of $480,000. OFFICE OF ENERGY AND PLANNING
The Governor and Council acted as follows:

#6  Authorized to retroactively accept and expend a grant in the amount of $20,000 from the US Department of Energy for the Granite State Clean Cities Coalition program to promote the use of alternative fuel vehicles in NH motor vehicle fleets. Effective October 1, 2003 through December 31, 2005. 100% Federal Funds.

#7  Authorized to retroactively accept and expend a grant in the amount of $39,874 from the US Department of Energy for the Rebuild NH Schools Circuit Rider Project (VI) program, to provide technical assistance in energy efficiency and conservation technologies and measures to municipal officials and school districts. Effective October 1, 2004 to September 30, 2006. 100% Federal Funds.

#8  Authorized to conduct a one day conference on Saturday, April 9, 2005 at the Radisson Hotel, Center of NH to provide training to local land use board members in accordance with RSA 673:3-a; total cost of the conference not to exceed $13,412.45. Effective upon G&C approval. 100% Other Funds.

#9  Authorized to enter into an agreement with Southwest Region Planning Commission, Keene, NH, for the purpose of conducting two workshops for training on the National Flood Insurance Program and four community assistance visits for a total of $5,000. OFFICE OF INFORMATION TECHNOLOGY
#10  The Governor and Council on motion of Councilor Pignatelli, seconded by Councilor Spaulding authorized the request the Office of Information Technology to transfer $38,989, as specified in their letter dated February 23, 2005. Fiscal Committee approved.

OFFICE OF THE ADJUTANT GENERAL
The Governor and Council acted as follows:

#15  The Governor and Council on motion of Councilor Pignatelli, seconded by Councilor Spulding authorized the request to issue a warrant from funds not otherwise appropriated and the State Treasurer to issue checks in the amount of $2,912.62 to the rightful owners of abandoned or unclaimed funds.

DEPARTMENT OF ADMINISTRATIVE SERVICES
#16  The Governor and Council on motion of Councilor Spaulding, seconded by Councilor Griffin authorized the request of the Bureau of Court Facilities to renew a retroactive license for use with the County of Coos, Board of Commissioners, West Stewartstown, NH, for annual rent in the amount of $32,792.64. Effective September 1, 2004 through August 31, 2007.

DEPARTMENT OF REVENUE ADMINISTRATION
#17  The Governor and Council on motion of Councilor Pignatelli, seconded by Councilor Spaulding authorized the request to hire John Frasier as Chief, Multi-State Audit Bureau, Unclassified position #9U148, and be placed at the maximum step for Group EE ($66,779). Effective upon G&C approval.

DEPARTMENT OF CULTURAL RESOURCES
#18  The Governor and Council on motion of Councilor Spaulding, seconded by Councilor Pignatelli authorized the request of the Division of Libraries, to accept and expend a grant from the Byrne Foundation, Etna, NH, in the amount of $3,200 for the Summer Reading Experience. Effective upon G&C approval through September 30, 2005. 100% Other Funds.

DEPARTMENT OF AGRICULTURE, MARKETS & FOODS
#19  The Governor and Council on motion of Councilor Griffin, seconded by Councilor Spaulding authorized the request to accept and expend grant funds of $25,000 annually, from the NH Department of Environmental Services through a memorandum of agreement, as program grants for educational, technical and financial assistance to agricultural landowners implementing best management practices to improve water quality totaling $50,000. Effective upon G&C approval through June 30, 2006. 100% Other Funds.

ATTORNEY GENERAL - DEPARTMENT OF JUSTICE
The Governor and Council acted as follows:

#20  Authorized to enter into a sub-grant with the NH Department of Safety, Division of State Police, to be used to provide training for users of the State Police Online Telecommunications Systems, known as SPOTS, in the amount of $83,994. Effective upon G&C approval though September 30, 2005. 100% Federal Funds.

#21  Authorized to enter into a sub-grant with the NH Department of Corrections, to be used to assist with acquiring a new Offender Records Management System, in the amount of $336,343.16. This funding is coming from a fiscal year 2002 Byrne Memorial Law Enforcement Block Grant program award. Effective upon G&C approval through September 30, 2005. (2)Further Authorized to enter into a sub-grant with the NH Department of Corrections, to be used to assist with acquiring a new Offender Records Management System, in the amount of $463,021. This funding is coming from a fiscal year 2003 Byrne Memorial Law Enforcement Block Grant program award. Effective upon G&C approval through September 30, 2006. 100% Federal Funds.

#21A  Authorized to conduct a five-day skill-building course entitled "The Childhood Trust Forensic Interviewer Training" for professionals involved in the county multidisciplinary Child Advocacy Center investigation teams, scheduled for March 14-18, 2005, to be held at The Courtyard by Marriott and Grappone Conference Center in Concord, NH, at a cost not to exceed $11,378. (2)Further Authorized to enter into an agreement with the Courtyard by Marriott in an amount not to exceed $11,178, for conference facilities and food services for the five-day skill building course as part of the cost above. (3)Further Authorized to expend funds in support of the conference above as detailed in letter dated March 2, 2005, for supplies needed, totaling $200. Effective upon G&C approval through July 1, 2005. 100% Federal Funds.

PUBLIC UTILITIES COMMISSION
#22  The Governor and Council on motion of Councilor Pignatelli, seconded by Councilor Spaulding authorized the request to reclassify position #14377, PUC Examiner, Salary Grade 25, to a Utility Analyst III, Salary Grade 28. 100% Other Funds.

HIGHWAY SAFETY AGENCY
#23  The Governor and Council on motion of Councilor Spaulding, seconded by Councilor Griffin authorized the request to enter into a sole source contractual agreement with the NH Fisher Cats baseball team to coordinate a highway-safety related advertisement campaign during the 2005 season home games in the amount of $11,500. Effective upon G&C approval through September 15, 2005. 100% Federal Funds.

LIQUOR COMMISSION
#24  The Governor and Council on motion of Councilor Spaulding, seconded by Councilor Griffin authorized the request to accept and expend a grant totaling $3,800 from the NH Highway Safety Agency for the project entitled "NH Liquor Commission - Fatal choices Golf Cart". Effective upon G&C approval through September 15, 2005. Agency Income.

EMPLOYMENT SECURITY
The Governor and Council acted as follows:

#25   Authorized to continue one Program Technician, position #8T065, salary grade 19 on a full time temporary basis for an additional period through June 30, 2005. 100% Federal Funds.

#26  Authorized to enter into a service agreement with Capital City Paving, Inc., for paving services at NHES's Manchester local office, in the amount of $11,500. Effective upon G&C approval through June 30, 2005. 100% Federal Funds.

DEPARTMENT OF CORRECTIONS
#26A  The Governor and Council on motion of Councilor Spaulding, seconded by Councilor Griffin authorized the request to accept and expend a Federal Byrne grant in the amount of $67,599.84 received from the NH Department of Justice to be utilized as a funding component for the Offender Management System. Effective upon G&C approval through June 30, 2005. (2)Further Authorized to enter into a contract with Xwave New England of Augusta, Maine Xwave New England in the amount of $1,396,000 to provide software licensing, software implementation services, training services and software support and maintenance services for an Offender Management System. Effective April 1, 2005 through March 31, 2007 and contains four options to renew for an additional period of two years each, upon G&C approval. 52% Federal, 41.5% General, 6.5% Other Funds.

DEPARTMENT OF RESOURCES AND ECONOMIC DEVELOPMENT
The Governor and Council acted as follows:

#27  Authorized to accept a donation for one trade show from Public Service of NH valued at $2,280. The event is the spring CoreNet Global Real Estate Summit being held in Toronto, Canada from April 15, 2005 to April 20, 2005.

#28  Authorized Division of Forests and Lands to establish four Laborer positions, one Secretary Typist II position, and one Clerk III position through June 30, 2005, as specified in letter dated February 23, 2005. Fiscal Committee approved.

(2)Further Authorized to expend the above $200,000 to the Nature Conservancy in exchange for fee title to 943 acres of contiguous working forestland, appraised at $810,000 in Langdon and Charlestown, to be named "Fall Mountain State Forest"; subject to the conditions set forth in a Donation Agreement between DRED and the Nature Conservancy, and subject to a conservation easement to be held by the Nature Conservancy with an executory interest held by the Land and Community Heritage Investment Program.

#31  Authorized Division of Forests and Lands to accept and expend $31,450 of federal funds to provide assistance for training and equipment to rural fire departments. Effective upon G&C approval through September 30, 2005.

NEW HAMPSHIRE FISH AND GAME DEPARTMENT
#32  The Governor and Council on motion of Councilor Spaulding, seconded by Councilor Pignatelli authorized the request to transfer $35,000, as specified in their letter dated February 23, 2005. Fiscal Committee approved.

DEPARTMENT OF ENVIRONMENTAL SERVICES
The Governor and Council acted as follows:

#33  Authorized to accept and expend $3,485 from the NH Department of Agriculture, Markets and Food/Division of Pesticide Control for the Homeowner IPM/Pesticide Reduction Pilot project. Effective upon G&C approval through December 31, 2005.

#34  Authorized to accept and expend $60,595 in federal flow through funds from the Department of Safety for the purpose of purchasing equipment for responding to terrorist incidents. Effective upon G&C approval through April 30, 2005.

#35  Authorized to accept and expend $12,000 in donations from the FPL Energy Seabrook Station, Seabrook, NH. Effective upon G&C approval. 100% Other Funds.

#36  Authorized to accept and expend $2,500 in federal funds from the US Department of Energy for education and outreach events related to the Granite State Clean Cities Coalition. #37  Authorized to award a Household Hazardous Waste grant to the Pemi-Baker Solid Waste District, Bethlehem, NH, for the purpose of conducting a household hazardous waste collection project, for an amount not to exceed $5,331.33. (2)Further Authorized to award a Household Hazardous Waste grant to the Southeast Regional Refuse Disposal District, North Hampton, NH, for the purpose of conducting a household hazardous waste collection project, for an amount not to exceed $5,680.06. (3)Further Authorized to award a Household Hazardous Waste grant to the Upper Valley Lake Sunapee Regional Planning Commission, Lebanon, NH, for the purpose of conducting a household hazardous waste collection project, for an amount not to exceed $5,689.68. #38  Authorized a loan agreement with the Town of Hooksett, NH, to finance upgrades to the treatment plant and a composting operation under the provisions of RSA 486:14 and NH Admin. Rules Env-C 500, in the amount of $3,500,000. Effective upon G&C approval.

#39  Authorized to enter into an agreement with Exeter River Local Advisory Committee, Exeter, NH, to conduct outreach activities that support the Alewife Festival in Exeter, in the amount of $5,800. Effective upon G&C approval through June 30, 2005. 100% Federal Funds.

#40  Authorized to retroactively amend an agreement with Rockingham Planning Commission, Exeter, NH, (previously approved by G&C on 3-10-04, item #20), to conduct Smart Growth Audits for coastal communities, by extending the completion date to June 30, 2005 from December 31, 2004. 100% Federal Funds.

#41  Authorized SMSD Realty Trust's request to fill, and construct breakwater, in an "L" configuration, with a gap at the shoreline, and a cantilevered pier extending from a cantilevered pier accessed by a walkway on frontage on property located on lake Winnipesaukee in Alton.

NEW HAMPSHIRE BOARD OF NURSING
#42  The Governor and Council on motion of Councilor Griffin, seconded by Councilor Spaulding authorized the request to conduct an organized meeting at the Courtyard by Marriot, Grappone Conference Center, Concord, NH, on April 20, 2005, for an estimated cost of $12,567. (2)Further Authorized to enter into an agreement with the Courtyard by Marriot, Grappone Conference Center, Concord, NH in the amount of $11,867, for the purpose of providing the participants attending the meeting with lunch and refreshments. #56  Authorized to enter into a sole source contract with Measured Progress, Inc., Dover, NH, to provide technical assistance in determining the technical adequacy of the alternate assessment and to develop the technical assistance processes and products that will ensure that states will get the support they need to continue after this project ends in an amount not to exceed $395,591. Effective upon G&C approval through May 31, 2006. 100% Federal Funds. (2)Further Authorized the payment for services rendered and approved on the basis of invoices which are supported by a summary of activities that have taken place in accordance with the terms of the contract, along with a detailed listing of expenses incurred in lieu of withholding 25% of the total value of the contract. Effective February 1, 2005 through September 15, 2005.

#69  Authorized Division of Fire Standards & Training and Emergency Medical Services to enter into a sole source contract with Interstate Emergency Unit, Stratham, NH, to provide two Firefighter I certification courses in Rockingham County, in the amount of $46,588. #70  Authorized Division of State Police to amend the contract price limitation with L&B Tailoring, Concord, NH, (previously approved by G&C on 8-18-04, item #177), for alterations and repairs to uniforms, by increasing the amount from $8,000 to $12,000 for the remaining of this fiscal year. Effective March 9, 2005 through September 30, 2005.

#91  Authorized Bureau of Bridge Design to enter into an agreement with GM2 Associates, Inc., Glastonbury, CT, for engineering services for preliminary and final design for a new soundwall and rehabilitation of the two island pond road bridges over interstate 93, for a total fee not to exceed $208,270.85. Effective March 9, 2005, or upon G&C approval, whichever is later, through January 6, 2006.

#92  Authorized Bureau of Construction to enter into a contract with East Coast Signals, Inc., Deerfield, NH, on the basis of a low bid of $337,019.40 for replacing the existing traffic signals and other associated work on NH Route 125 at the intersections with NH Route 111, Main Street, NH Route 107 and Scotland Road. Effective upon G&C approval through September 16, 2005.

#93  Authorized Bureau of Right of Way to enter into a sole source contract with the International Right of Way Association, Pacifica Harbor Business Center, Torrance, CA, for training in federal FY2005, for an amount not to exceed $20,000.

#94  Authorized DOT and the College for Lifelong Learning, University System of NH to enter into a Cooperative Project Agreement and provide for the continued funding of the Granite State Distance Learning Network for the purpose of sustaining video teleconferencing, by providing equipment, telecommunications networking and professional services to the John O. #95  Authorized Bureau of Construction to enter into a contract with Beck & Bellucci, Inc., Franklin, NH, on the basis of a low bid of $12,543,749.33, for replacement of the bridge over the Pemigewasset River between the Towns of Holderness and Plymouth along NH Route 175A, which involves improving the pedestrian facilities along Main Street and High Street as well as improving access and reconstructing the Grafton parking area on High Street.
