#1 The Governor and Executive Council, on motion of Councilor Griffin, seconded by Councilor Burton, with Councilor Streeter voting NO, authorized to enter into an Agreement with Audubon Society of New Hampshire, 3 Silk Farm Road, Concord, NH, in the amount of $11,960 under the provisions of the New Hampshire Coastal Program through June 30, 2000 to provide funding to the Audubon Society and the Seacoast Science Center in order (1) establish "real-time"video capacity on the Isles of Shoals; and (2) to assist ongoing programming and curriculum development. #2 Authorized to enter into an Agreement with Lakes Region Planning Commission, 103 Main Street, Suite 3, Meredith, NH for the amount of $13,000 through June 30, 2000 to assist conducting of a Chocorua Village pilot project as part of the Route 16 Corridor Protection Study.

#3 Authorized to enter into an Agreement with the Town of Hinsdale, NH in the amount of $12,000.00 through December 31, 2000. The funds for this contract are from the Community Development Block Grant Fund and will enable the Town to conduct a preliminary engineering study to evaluate the efforts of groundwater infiltration on the municipal sewer system.

The funds for this contract are from the Community Development Block Grant Fund to determine the feasibility of rehabilitating the Pythian Sisters Building into a Senior Center and Community Center for the underpriv`ileged.

The funds for this contract are from the Community Development Block Grant Fund and will enable the Town to assess the feasibility of rehabilitating the "Gables Property" for use as a community center.

#6 The Governor and Executive Council, on motion of Councilor Griffin, seconded by Councilor Burton, with Councilor Streeter voting NO, authorized to AMEND an existing Agreement with GZA GeoEnvironmental, Inc., 380 Harvey Road, Manchester, NH [Initially approved on July 21, 1999 (Item #14)], by modifying work tasks and provide additional consideration in the amount of $7,213 for a new total of $196,013 through June 30, 2000. SOLE SOURCE

#7 Authorized to AMEND an existing Agreement from the Department of Commerce, Economic Development Administration (Initially approved on September 28, 1999 [Item #3)], by extending the end date from March 31, 2000 to December 31, 2000.

#8 Authorized to AMEND an existing Agreement with the City of Concord, NH [Initially approved on July 21, 1999 (Item #13)], by transferring $63,000 from "Acquisition and Disposition" to "Rehabilitation-Residential," and to reduce the total number of residential units to be rehabilitated from 14 to 13. #9 Authorized to RETROACTIVELY AMEND an existing Agreement with the City of Dover, 288 Central, Dover, NH [Initially approved on August 18, 1999 (Item #23)], by modifying the reporting requirements and payment schedule, and to change the end date from December 31, 1999 to December 31, 2000 at no additional cost.

#10 Authorized to RETROACTIVELY AMEND an existing Agreement with the NH Department of Environmental Services [Initially approved on July 21, 1999 (Item #24) and amended on September 28, 1999 (Item #5)] by changing the end date from December 31, 1999 to June 30, 2000 and to provide additional financial consideration of $1,224 for a new total of $52,915.

#11 Authorized to RETROACTIVELY AMEND an existing Agreement with the City of Berlin, NH [Initially approved on January 28, 1998 (Item #5)], by changing the end date from December 31, 1999 to June 30, 2000. No additional federal funds are required by this action.

GOVERNOR'S OFFICE OF ENERGY AND COMMUNITY SERVICES

The Governor and Executive Council acted as follows:

#12 Authorized to accept and expend additional federal Low Income Home Energy Assistance Program funds from the US Department of Health and Human Services in the amount of $3,708,382.00.

#13 Authorized to AMEND the Fuel Assistance Program contract #520517 [Initially approved on July 21, 1999 (Item #42) and amended on November 10, 1999 (Item #33) and February 9, 2000 late Item #D with Southwestern Community Services, Inc., 69Z Island Street, Keene, NH], by increasing the contract by $501,177.00 to an amount not to exceed $2,255,769.00.

OFFICE OF EMERGENCY MANAGEMENT

The Governor and Executive Council acted as follows:

#21 Authorized to accept and expend Hazard Mitigation Grant Program funds from the Federal Emergency Management Agency in the amount of $401,640.00 through September 30, 2002.

#22 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Griffin, with Councilor Streeter voting NO, Authorized to enter into a contract with Wright Communications, Inc. in the amount of $11,925 through December 21, 2000 for a service contract and site rental at Plausawa Hill for the NHOEM repeater, which provides communications coverage for the south central portion the State and remote control capability for the northern repeater. SOLE SOURCE

#23 Authorized to execute a grant agreement with the Town of Salem in the amount of $99,540 through June 30, 2000 to implement high priority mitigation projects to reduce the loss of life and property damage thereby making their community disaster resistant.

ADJUTANT GENERAL

The Governor and Executive Council acted as follows:

#24 Authorized to accept and expend in the amount of $48,616.00 from the federal government (National Guard Bureau) through September 30, 2000 to cover the cost of utilities at buildings occupied by tenants at Pease Air National Guard Base.

#25 Authorized the nomination of Captain Michael J. Busby, 30 Baker Street, Dover, NH to the rank of Major, New Hampshire Air National Guard.

NEW HAMPSHIRE STATE VETERANS CEMETERY

#29 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, authorized to accept and expend monetary contributions in the amount of $145.00 to be used for the betterment of the cemetery. These donations were received during the period of December 1, 1999 through February 16, 2000.

DEPARTMENT OF ADMINISTRATIVE SERVICES

The Governor and Executive Council acted as follows:

#30 Authorized the Report and Findings of Councilor Raymond S. Burton with regard to a certain refinancing of existing indebtedness project with Kendal at Hanover, Hanover, New Hampshire.

#31 Authorized to transfer $27,619 as specified in letter dated January 21, 2000. FISCAL COMMITTEE APPROVED

#33 Authorized Bureau of Court Facilities, to enter into a lease extension agreement with the City of Berlin, 168 Main Street, Berlin, NH in the total amount of $56,683.92 through June 30, 2002.

TREASURY DEPARTMENT

#34 The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Burton, authorized to accept and place on file a copy of the average daily collected balances for the fourth quarter of 1999.

ATTORNEY GENERAL

The Governor and Executive Council acted as follows:

#35 Authorized a RETROACTIVE salary increment of $2,663 to Assistant Attorney General Richard J. Lehmann, retroactive to March 4, 2000.

#36 Authorized to accept and expend a grant in the amount of $77,576 from the US Department of Health and Human Services through September 30, 2001.

#37 Authorized to AMEND the Public Protection Litigation [Initially approved on June 24, 1998 (Late Item #P)] for specialized assistance in both Consumer Protection and Charitable Trust litigation.

#38 Authorized to enter into a grant through May 31, 2001 to the NH Liquor Commission, Bureau of Enforcement in the amount of $97,687 to continue the additional patrols and training provided through last year's grant award.

#39 Authorized to enter into a sub-grant through June 30, 2001 with the Sullivan County Sheriff's Department in the amount of $35,958, to assign a police officer to work as an undercover operative with the New Hampshire Drug Task Force.

#40 Authorized to enter into subgrants through September 30, 2000 in the amount of $53,376 to the agencies and in the amounts as specified in letter of February 22, 2000.

#41 Authorized to enter into subgrants through September 30, 2000 in the amount of $221,127 to the agencies and in the amounts as specified in letter of February 22, 2000. (2) Authorized to enter into a subgrant through June 30, 2001 in the amount of $45,954 to the Department of Corrections.

#42 Authorized to enter into subgrants through September 30, 2000 in the amount of $32,269 to the agencies and in the amounts as specified in letter of February 22, 2000.

#43 DENIED-The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Spaulding, voted to DENY the petition of Roy H. Lattanzio, Jr. for a pardon hearing for the offense of Second Degree Murder should be granted.

DEPARTMENT OF CULTURAL RESOURCES

The Governor and Executive Council acted as follows:

#44 Authorized Division of Libraries to extend position number 8T002, Librarian II (LG 20) to June 30, 2001.

#45 Authorized Division of Arts to RETROACTIVELY accept and expend carry-forward funds from the National Endowment for the Arts from July 1, 1999 through December 31,1999.

#46 Authorized Division of Libraries to enter into a contract in the amount of $223,875.00 with Bell & Howell Information and Learning, Ann Arbor, Michigan through March 31, 2002 for the licensing of a General Interest Periodical Database.

EMPLOYMENT SECURITY

The Governor and Executive Council acted as follows:

#47 Authorized to accept and expend additional federal funds in the amount of $1,700,000.00 through February 5, 2000 from the US Department of Labor, Employment and Training Administration Division as the third year funding of a three year One-Stop Career Center Implementation Grant Award.

#48 Authorized to enter into an agreement with the NH Job Training Council in an amount not to exceed $135,000.00 through June 30, 2001 for services to be provided in support of NHES's One-Stop Career Center Implementation Grant award from the US Department of Labor.

#49 Authorized to enter into a Memorandum of Understanding with Southwestern Community Services in the amount of $2,700.00 through June 30, 2000 for services related to assisting NHES in the implementation of the One-Stop System.

#50 Authorized to enter into a service agreement with R & T Electric, Inc. in the amount of $4,000.00annually through June 30, 2002, for electrical services at NHES's Somersworth & Portsmouth local Job & Information Centers.

#50A Authorized to accept and place on file the Informational Item " Letter of Advisement" to exercise an option in its lease-purchase agreement for Tuthery Heights & Washington Street, Claremont with Alvan and Kathleen Traffie, to buy out the balance of the lease-purchase agreement.

PUBLIC UTILITIES COMMISSION

The Governor and Executive Council acted as follows:

#51 Authorized to reclassify vacant position #14375 from a Legal Secretary II, Salary Grade 10 to a Clerk IV, Salary Grade 11, in the Legal Department.

#52 Authorized to sponsor and participate in a one (1) day conference on Telecommunications Infrastructures for New Hampshire on March 17, 2000 at a total cost not to exceed $14,650.00, at the Holiday Inn, Center of New Hampshire, Manchester, NH.

LIQUOR COMMISSION

#53 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, authorized to RETROACTIVELY enter into a two-year contract with Foxfire Property Management Inc., 29 Green Street, Concord, NH with a price limitation of $15,600.00 for janitorial services at the Bureau of Enforcement, 8 Commercial Street, Concord, NH, through January 31, 2002.

DEPARMENT OF CORRECTIONS

The Governor and Executive Council acted as follows:

#54 Authorized to accept a donation of a Logitech cordless wheel mouse and software to the NH State Prison for Men from John Hazzard, 77 McGrath Street, Laconia, NH. The approximate value of the item is $40.

#55 Authorized RETROACTIVE request for a 90-day leave of absence without pay, effective February 25, 2000 for Corrections Officer Michael Campono.

#56 Authorized to transfer $44,800 as specified in letter dated January 7, 2000. FISCAL COMMITTEE APPROVED

#57 Authorized to pay $63,360 in overtime for permanent personal services out of salaries for vacant positions due to extended sick leave and pending recruitment for the period December 1, 1999 through January 30, 2000.

DEPARTMENT OF RESOURCES AND ECONOMIC DEVELOPMENT

The Governor and Executive Council acted as follows:

#58 Authorized Division of Parks and Recreation to accept and expend $62,822.74 from the Federal Emergency Management Agency and the State Office of Emergency Management in order to reimburse expenses for mitigating rain storm, flooding damage throughout the State Parks in Grafton and Cheshire Counties.

#59 Authorized Division of Economic Development to accept funds not to exceed $12,500.00 from Public Service Company of New Hampshire in accordance with their letter of February 14, 2000.

#60 Authorized Division of Parks and Recreation to issue the Special Use Permit to Rene Fortin, New Hampshire Towing Association of Manchester, New Hampshire to conduct a Towing Rodeo, May 19-21, 2000 at Hampton Beach State Park, Hampton, NH. The fee for this permit is $4,000.00, which will be deposited to the Park Fund.

#61 The Governor and Executive Council, on motion of Councilor Griffin, seconded by Councilor Spaulding, with Councilor Streeter voting NO, authorized Office of Business and Industrial Development to contract with USA Information Systems, Incorporated, Virginia Beach, VA in the amount of $6,800.00 for the use of Military Standard and Specification Library Software, which also provides procurement history. SOLE SOURCE

#62 Authorized Office of Travel and Tourism Development to enter into an agreement with CTM Brochure Display, Inc., Woburn, MA in the amount of $14,362.88 for distribution of the New Hampshire Guidebook. Terms of the contract will cover a three-month period beginning March 19, 2000.
