GOVERNOR AND EXECUTIVE COUNCIL MINUTES

January 22, 1997 10:00 A.M.

The Governor and Executive Council convened at 10:00 a.m. with all members being present.

AMENDED - The Governor and Executive Council on motion of Councilor Spaulding, seconded by Councilor Streeter, with Councilor Normand abstaining, accepted the minutes of the January 9, 1997, 9:00 a.m. meeting as amended to include the Resolution to the New England Patriots.

The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Normand, again voiced their support to the New England Patriots and voted to urge them to consider New Hampshire as a future site for their new stadium.

The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Griffin, accepted the minutes of the January 9, 1997, 3:00 p.m. meeting.

The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Burton, confirmed the appointment of several persons nominated for Civil Commissions from the January 1, 1997 list.

The governor placed in nomination the several persons who applied for Civil Commissions.

The Governor and Executive Council accepted with regret the following resignations:

PUBLIC UTILITIES COMMISSION
The Governor and Executive Council acted as follows:

#10 Authorized to amend contract with La Capra Associates, Inc. by increasing the dollar amount by $75,000, from $100,000 to $175,000 and extend the end date from March 1 to April 30, 1997.

#11 Authorized to transfer $10,500 as stated in letter of November 7, 1996. Fiscal Committee approved January 9, 1997.

DEPARTMENT OF CORRECTIONS
The Governor and Executive Council acted as follows:

#12 Authorized to amend the rate of pay for Kimberly Kee, as a Dental Consultant, from $10.00 per hour to $10.75 and add Susan Wilson of Bristol to the list of Dental Consultants for FY97.

#13 Authorized to transfer $268,208 to the correctional Pathways salary and benefit accounts as stated in letter of November 25, 1996. Fiscal Committee approved January 9, 1997.

#13A Authorized to increase the estimated cost for Michael Torch, Substance Abuse Counselor from $4,150 to $6,750. Further Authorized to add Dr. John Hill of Amherst, Dr. Anna Konopka of New London and Dr. Matthew Winslow of New London to the Consultants list for FY97.

EMPLOYMENT SECURITY
The Governor and Executive Council acted as follows:

#14 Authorized agreement with Alternative Communications Service Corp. at $25,000 for telephone repair services through June 30, 1997.

#15 Authorized agreement with Ed's Trucking at $25,000 for general moving services through June 30, 1997.

#16 Authorized to participate in the sixth annual Made in NH Expo to be held at the National Guard Armory in Manchester at $2,600 to be held on March 21 - 23, 1997.

#16A Authorized agreement with BTU Control Inc. at $24,200 for the purchase and installation of four steam type humidifiers through June 30, 1997.

COMMISSION FOR HUMAN RIGHTS
#17 The Governor and Executive Council, on motion of Councilor Normand, seconded by Councilor Burton, authorized to transfer funds from revenue to the in-state travel account in the amount of $1,500.00.

FISH AND GAME DEPARTMENT
The Governor and Executive Council acted as follows:

#18 Authorized to accept $6,006 in Sportfish Restoration Funds through June 30, 1997.

#19 Authorized quarterly travel as needed to Fish and Wildlife Service Region 5 Office in Hadley MA through March 30, 1997.

#20 Authorized to accept and expend $80,350 of Atlantic Coastal Fisheries Cooperative Act funds and to establish up to 6 temporary Laborer positions through June 30, 1997, not December 31, 1997 as stated in letter of November 22, 1996. Fiscal Committee approved January 9, 1997.

DEPARTMENT OF RESOURCES AND ECONOMIC DEVELOPMENT
The Governor and Executive Council acted as follows:

#21 Authorized agreement with H.E. Bergeron of North Conway at $29,070 for engineering services for the design of recreational vehicle sanitary stations at various State Parks through June 30, 1997.

#22 Authorized salary increase for Richard McLeod from Group N, Step 4 ($55,025) to Group N, Maximum ($57,487) effective February 14, 1997.

#23 Authorized to accept the detailed analysis of Park Revenue and Expenditures including state operated ski areas.

#24 Authorized to accept $15,000 from the Bombardier Corporation of Bedford to sponsor a snowmobile condition phone line throughout the winter season.

#25 Authorized to amend the Memorandum of Agreement with the Garden Conservancy at $60,000 by extending the end date through December 1999 to maintain, manage and provide interpretation at the Fells, (John Hay Estate) in Newbury.

DEPARTMENT OF HEALTH AND HUMAN SERVICES
The Governor and Executive Council acted as follows:

#43 Authorized RETROACTIVE agreement with the Child Care Project/Trustees of Dartmouth College at $5,700 to provide child care training services from September 1, 1996 through June 30, 1997.

#44 Authorized to RETROACTIVELY extend leave of absence without pay for Lisa White from December 23, 1996 through January 31, 1997.

#45 Authorized to RETROACTIVELY renew agreement with Pitney Bowes of Waltham MA at $14,000 for maintenance and services on postage meter machines from January 1 through December 31, 1997.

#46 Authorized contract with the Trustees of Dartmouth College at $60,000 to establish a statewide breast pathology quality assurance program through September 29, 1997. Sole Source.

#47 Authorized to amend agreement with the Secretary of the US Department of Health and Human Services on behalf of the Town of Alexandria for the purpose of adopting the optional exclusion from Social Security and Medicare coverage the services performed by election officials or election workers for each calendar year in which the remuneration paid for such services is less than $1,000.

DIVISION FOR CHILDREN, YOUTH AND FAMILIES
#47A The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Normand, authorized a one-time grant to the NH Juvenile Court Diversion Network, Inc. of Laconia to co-sponsor the Second Annual NH Juvenile Court Diversion Conference to be hold on March 14, 1997 at the NHTI. DIVISION OF MENTAL HEALTH AND DEVELOPMENTAL SERVICE
The Governor and Executive Council acted as follows:

#48. Authorized to RETROACTIVELY amend contract with Tri-County Community Action Program, Inc. by increasing dollar amount by $70,000, from $436,000 to $506,000 from July 1, 1996 through June 30, 1997. Sole Source.

#49 Authorized to award a one time grant the NH Minority Health Coalition of Manchester at $12,517.80 to conduct a six month pilot project to increase the number of professionally trained medical interpreters through June 30, 1997. Sole Source.

#50 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Normand, with Councilor Streeter abstaining, authorized to award a one time grant Gateway Family Health Center of Nashua at $1,291 to provide partial funding for a teen pregnancy and parenting support group for teens through June 30, 1997. #51 Authorized to accept and expend an additional $101,372.52 in federal funds from the Dept. of Health and Human Services through August 31, 1997.

The Governor and Executive Council acted as follows:

#81 Authorized agreement with various communities to provide services for completing transportation enhancement and congestion mitigation and air quality projects.

#82 Authorized agreements with various communities for the reconstruction of six bridges and the layout of three roadway approaches.

#83 Authorized agreements with various communities to assist in laying out and constructing eight municipal highways.

#84 Authorized to amend agreement with Lakes Region Community Services Council by increasing dollar amount by $9,320, from $48,650 to $57,970.

#85 Authorized to accept notification that the statewide consultant agreement for bridge design has been completed and accepted.

#86 Authorized to accept the notification that the hazardous materials investigation contract has been completed and accepted.

#87 Authorized to accept the notification that the preliminary archeological evaluations for various highway and public works studied and projects have been completed and accepted.

#88 Authorized to accept the notification that the preliminary cultural resource evaluations for various highway and public works have been completed and accepted.

#89 Authorized out of state travel for the period of January through March 1997 for day trips in the performance of normal duties.

#90 Authorized to appoint a Special Commission for the alteration to NH Rte. 9 in the Town of Stoddard. The Commission will consist of: Richard Cadarette of Bow, Larry Elliott of Antrim and Wanda Druding of Contoocook.

#91 Authorized to continue membership with the International Bridge Tunnel and Turnpike Association in Washington DC at $11,614 for 1997.

#92 Authorized out of state travel for the period of January through March 1997 to conduct audits on federal aid projects.

#93 Authorized to appoint a Special Commission for the alteration to NH Rte. 12A in the Town of Charlestown. The Commission will consist of: John Sanborn of Plymouth, Roland Stoodley of Newport and Cynthia Poole of Lee.

#94 Authorized to accept the Equipment Acquisition Plan Status Report for the period ending December 31, 1996.
