The Governor and Executive Council convened at 10:30 a.m. with all members
present
The Governor and Executive Council on motion of Councilor Wieczorek, seconded
by Councilor Wheeler accepted the minutes of January 9, 2003.
The Governor and Executive Council, on motion of Councilor Griffin, seconded
by Councilor Burton, confirmed the appointment of several persons nominated
for Civil Commissions from the January 9, 2003 meeting.
The Governor placed in nomination the several persons who applied for Civil
Commissions.
The Governor and Executive Council swore in the following representative-elect.
District No. 67 (Wards 1-6, Rollinsford, Somersworth Wards 1-5)

The Governor and Council, on motion of Councilor Wieczorek, seconded by Councilor
Griffin, voted to set the special election for state representative in Hillsborough
County District No. 50. The special election will be held on April 8, 2003.
The primary will be held on March 4, 2003 and the filing period will begin on
January 21, 2003 and end on January 27, 2003.

The Governor and Council acted as follows:
#1 Authorized to enter into an Agreement with the US Environmental Protection
Agency to accept and expend $1,029,412.84 to implement the NH Estuaries Project
Year 6 and Year 7 work plans. Effective upon G&C approval to December 31,
2004.
#2 Authorized request to transfer $18,200, as specified in letter dated December
4, 2002.
#3 WITHDRAWN - The Governor withdrew the request of the Department of Economic
Development and the Department of Environmental Services to enter into a Memorandum
of Agreement to continue the multi-agency effort aimed at increasing the use
of recycled materials in production process in NH. Effective upon G&C approval
through June 30, 2003.
#4 Authorized to enter into an Agreement with Exeter River Advisory Committee,
Exeter, NH, to conduct the third annual Exeter River Alewife Festival, under
the provisions of the NH Coastal Program, in the amount of $5,000. Effective
upon G&C approval to June 30, 2003.
#5 Authorized to enter into a sole source Agreement with Northeast Resource
Recovery Association, Chichester, NH, to provide technical assistance relative
to community-based recycling as an alternative to solid waste disposal, in the
amount of $18,200, with an initial payment of $6,200. Effective upon G&C
approval through June 30, 2003.
#6 Authorized to enter into an Agreement with the County of Merrimack, to provide
16 units of transitional housing, in the amount of $285,000, under the provisions
of the Community Development Block Grant Program. Effective upon G&C approval

#7 Authorized to enter into an Agreement with the Town of Conway, NH to assist
the RDC in improving its revolving loan fund, in the amount of $30,000, under

the purpose of upgrading the Town's wastewater treatment facility, in the amount

#11 Authorized to retroactively amend an existing Agreement on a sole source
basis with Planning Decisions, Inc., York Harbor, ME, (previously approved by
G&C on 4-17-02, item #4), by extending the end date from December 31, 2002
to June 30, 2003 and increasing the dollar amount by $6,500 to a new total of
$56,500 for the purpose of providing technical planning assistance for an additional
two communities.
#12 Authorized to retroactively amend an existing Agreement with the City of
Portsmouth, NH, (previously approved by G&C on 8-14-02, item #13), for the
purpose of extending the ending contract date from December 31, 2002 to December
31, 2003, for stormwater and sewer system improvements.
#13 Authorized to retroactively amend an existing Agreement with the University
of NH, Durham, NH, (previously approved by G&C on 7-10-02, item #3), for
the purpose of extending the end date from December 31, 2002 to June 30, 2003
to evaluate and analyze the effectiveness of the stakeholder group survey as
a planning tool.
#14 Authorized to accept and place on file the Land Conservation Investment
Program Monitoring & Enforcement Activities report of FY02. Informational.
EXECUTIVE COUNCIL
The Governor and Council on motion of Councilor Wheeler, seconded by Councilor
Wieczorek:
#14A Authorized an annual salary step increase within the salary range for
the unclassified position of Executive Assistant of the Executive Council, for
Joanne C Ruel from Group AA, step 1 ($43,860) to Group AA, step 2 ($46,604)
effective January 30, 2003.
ADJUTANT GENERAL
The Governor and Council acted as follows:
#15 Authorized to accept material donations in the amount of $907.35 for the
NH State Veterans Cemetery of be used for the betterment of the cemetery as
listed in letter dated December 16, 2002.
#16 Authorized to reclassify position #41562, Electronic Technician I, Salary
Grade 17 to Inventory Control Supervisor, Salary Grade 14, for support needed
to operate the newly implemented Integrated Engineering Management System, used
in the tracking of utilities, personnel, and maintenance expenditures for the
purpose of analyzing, formulating, and generating the annual federal/state operation
and maintenance agreement. This position is currently vacant.
#17 Authorized to enter into a no cost amendment to an existing memorandum
of agreement with the NH Department of Fish and Game to perform Habitat Management
and Monitoring of the Concord Municipal Airport Conservation Zones, by extending
the end date from January 31, 2003 to April 30, 2003.
ADMINISTRATIVE SERVICES
The Governor and Council acted as follows:
#18 Authorized Bureau of Court Facilities, to pay the invoice from SimplexGrinnell,
as detailed in letter dated December 31, 2002, a total cost of $1,365.60 for
labor and parts to the emergency lighting located in the Plymouth District Court.
#19 Authorized Bureau of Court Facilities to pay the invoice from R.B. Allen
Co., Inc., as detailed in letter dated December 31, 2002, a total of $2,051
for labor and parts to the fire alarm system located in the Rockingham County
Courthouse.
#20 Authorized to waive the State's workers' compensation lien related to Robin
Belyea who is no longer employed by the NH Department of Transportation, and
is no longer receiving workers' compensation benefits from the State. The State
had determined that it would be best to settle for $35,000 and counsel for Robin
Belyea has agreed and now seeks approval of lien waiver in order to achieve
a just and efficient resolution of this case, it is the request to exercise
the discretion afforded them and waive the workers' compensation lien, as described
in letter dated December 17, 2002.
#21 WITHDRAWN - The Governor withdrew the request of the Bureau of Purchase
and Property, to enter into a statewide agreement with the vendors, as listed
in letter dated December 9, 2002, to provide information technology services
as well as grant permission to implement these agreements under an approved
process. These agreements have a six year term, ending June 30, 2005 contingent
upon performance reviews to occur every two years. Effective upon G&C approval.
#21A Authorized to contract with Johnson Controls, Inc., Lynnfield, MA, for
mechanical equipment service and maintenance, in the amount not to exceed $754,252.40.
Effective upon G&C approval through December 31, 2005.
#21B Authorized that Working Capital Warrant #03-08 be Authorized to cover
expenditures for the Month of February 2003, in the amount of $320,000,000.
(2)Further Authorized to accept reporting expenditures of Working Capital Warrant
#03-06 for $433,440,025.29 for the month of December and recommends the balance
of $96,559,974.71 be lapsed.
#21C Authorized Bureau of General Services to contract with The Scott Lawson
Group, Ltd, Concord, NH, for removal and monitoring of Asbestos-Containing Material
at the State House Annex, Concord, NH, in an amount of $5,485. Effective January
24, 2003 to end on January 26, 2003.
TREASURY DEPARTMENT
The Governor and Council acted as follows:
#22 Authorized to accept and expend $30,000 of Unique Plan Administration Fee
revenues from the period of G&C approval to June 30, 2003, as indicated
in letter dated December 31, 2002, to process administrative expenses connected
with the Scholarship program through fiscal year 2003.
#23 Authorized to enter into a sole source contract with Bottomline Technologies
Inc., Portsmouth, NH, for the purpose of providing services to implement "CheckMatch",
in the amount of $6,240. Effective upon G&C approval through December 31,
2003.
CULTURAL RESOURCES
The Governor and Council on motion of Councilor Burton, seconded by Councilor
Spaulding authorized:
#24 Authorized Division of Libraries to accept and expend a grant from Easter
Seals NH, for the Family Resource Connection to develop "Early Literacy
Kits" and "Books for Babies and Beyond" programs, in the amount
of $33,792. Effective upon G&C approval through March 31, 2004.
ATTORNEY GENERAL
The Governor and Council acted as follows:
#25 WITHDRAWN - The Governor withdrew the request to accept and expend a grant
from the federal Office of Justice Programs, Bureau of Justice Assistance for
Residential Substance Abuse Treatment and to direct the Director, Bureau of
Accounting Services to deposit same within entitled Residential Substance Abuse
Treatment, as indicated in letter dated January 2, 2003, in the amount of $349,605.
Effective upon G&C approval to September 30, 2004. (2) Further Authorized
Department of Justice to enter into subgrants for Residential Abuse Treatment,
as indicated in letter dated January 2, 2003. Effective upon G&C approval
through September 30, 2004.
#26 Authorized Department of Justice to enter into a subgrant, as detailed
in letter dated January 2, 2003, for crisis shelter handicap accessibility improvements
for the period of December 12, 2002 to June 30, 2003. Retroactive.
#27 Authorized Department of Justice to enter into eight sub-grants, as detailed
in letter dated December 31, 2002, to be used to increase the number of communities
reporting National Incident Based Reporting System data to State Police. Effective
upon G&C approval to December 31, 2003.
BANKING DEPARTMENT
#28 WITHDRAWN - The Governor withdrew the request to establish an Accounting
Technician position through June 30, 2003, as specified in letter dated December
18, 2002.
INSURANCE DEPARTMENT
The Governor and Council on motion of Councilor Wheeler, seconded by Councilor
Griffin:
#29 Authorized to adjust the budget for Market Conduct Examinations, (previously
approved by G&C on 6-26-02, item #68), by $54,554, through June 30, 2003,
as detailed in letter dated December 12, 2002.
EMPLOYMENT SECURITY
The Governor and Council acted as follows:
#30 WITHDRAWN - The Governor withdrew the request to reclassify two positions,
#11320 and #11339, Legal Secretary III, salary grade 13, to Paralegal I, salary
grade 16, to restructure the support staff positions to better serve this agency's
legal matters. These positions are currently vacant.
#31 WITHDRAWN - The Governor withdrew the request to reclassify one position
#30137, Field Auditor, salary grade 20, to Programs Technician, salary grade
19, to provide much needed additional technical support. This position is currently
vacant.
#32 Authorized to enter into an agreement with the Workforce Opportunity Council,
Inc., for EmplyOn ClientMatch job match system access services related to assisting
the State of NH in the implementation of the Workforce Investment Act including
the continued implementation and expansion of the One-Stop System, in the amount
of $177,500 for a two year period upon G&C approval through November 30,
2004.
#33 Authorized to enter into a retroactive sole source service agreement with
Altura Communications Solutions LLC, for telephone system maintenance services
for the NHES Local Job & Information Center, Administrative offices and
Centralized Telephone Claims Center, Manchester, NH, in the amount of $105,000,
the total price limitation of the agreement includes an annual maintenance fee
of $20,592 for each of the three annual periods and a contingency amount of
$43,224 for the entire three-year period from December 1, 2001 through November
30, 2004.
#34 Authorized to enter into an amended service agreement with Capital Alarm
Systems, increasing the current agreement in the amount of $4,120 by $2,000
to a new total of $6,120 for the annual period effective upon G&C approval
through June 30, 2003, and in the amount of $4,120 by $240 to a new annual total
of $4,360 for the annual period July 1, 2003 through June 30, 2004 thereby increasing
the total current agreement price limitation in the amount of $12,360 by $2,240
to the revised total agreement price limitation of $14,600, (previously approved
by G&C on 10-24-01, item #31), through June 30, 2004 for alarm system monitoring
and repair services at NHES's offices statewide. Sole Source.
#35 Authorized to enter into an amended services agreement with First Choice
Office Services, increasing the current agreement in the annual amount of $30,000
by $52,000 to the revised total of $82,000 annually only for the current annual
period effective upon G&C approval through June 30, 2003, thereby increasing
the total current agreement price limitation in the amount of $90,000 by $52,000
to the revised total agreement price limitation of $142,000, (previously approved
by G&C on 5-15-02, item#31), through June 30, 2004 for wall panel and furniture
installation services at NHES's office statewide. Sole Source.
#36 Authorized to enter into a retroactive third tenancy-at-will lease agreement
extension with Community Action Program Belknap Merrimack Counties, Inc., for
the purpose of leasing office space to CAPBM a NHES's property, Laconia, NH,
in an amount not to exceed $3,532 for the period August 1, 2002 through September
13, 2002. (2)Further Authorized to accept and expend additional funds in the
amount not to exceed $3,532, for the purpose of leasing office space to the
CAPBM. Effective August 1, 2002 through June 30, 2003.
#37 Authorized to enter into a lease agreement with GE Capital Modular Space
for rental of a box office trailer to locate in Laconia, NH, for temporary claims
adjudication training activities, at a cost of $10,500. Effective upon G&C
approval through November 30, 2003 or one year from the date of G&C approval.
Subject to approval by Governor's Commission of Disability and air quality certification.
DEPARTMENT OF CORRECTIONS
The Governor and Council acted as follows:
#38 Authorized to add Linda Richardson, Concord, NH, to approved list of Dental
Consultants.
#39 Authorized to enter into a contract with Brigade Fire Protection, Inc.,
(previously approved by G&C on 4-17-02, item #36), for inspections and repairs
on sprinkler systems at the NH Prison Facilities, this increases the price limitation
from $47,340 to $64,340 and increase of $17,000. Sole Source.
#40 Authorized to enter into a sole source contract agreement with Simplex
Grinnell of Nashua, NH, for maintenance, testing and repair of the Building
Service and Fire Protection Equipment connected to the Detection, Alarm and
Communications Systems for the Facilities in Concord, Manchester, and Laconia,
in an annual amount of $102,106.92 for a total contract price limitation of
$204,213.84. Effective from February 1, 2003 to January 31, 2005.
#41 Authorized to enter into a contract with Brigade Fire Protection Inc.,
Boscawen, NH, for the relocation and addition of sprinkler heads at the Northern
NH Correctional facility in Berlin, NH, in the amount of $5,190. Effective upon
G&C approval through March 31, 2003.
#42 Authorized to enter into a contract with Simplex Grinnell, for maintenance,
testing and repair of the fire safety system at the NH State Prison for Women,
in an annual amount of $4,373 for a total contract of $8,746. Effective for
two years upon G&C approval with the option to renew for an additional period
of two years.
#43 Authorized to enter into a contract with Skyline Roofing, Inc., Manchester,
NH, for replacement of the C-tier and D-tier roofs at the NH State Prison for
Women, in the amount of $15,600. Effective upon G&C approval through May
1, 2003.
#44 Authorized to enter into a contract with J.P. Chemical Co., Inc., (previously
approved by G&C on 4-11-01, item #46), for pest control services at the
North Country Facility in Berlin, NH, increasing the price limitation from $6,588
to $13,176, and increase of $6,588 and extends the completion date from April
11, 2003 to April 11, 2005.
#44A Authorized to reimburse Assistant Commissioner Les Dolecal for the cost
of relocation expenses from July 26, 2002 through September 19, 2002, for a
total amount not to exceed $9,676.38. Retroactive.
DEPARTMENT OF RESOURCES AND ECONOMIC DEVELOPMENT
The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor
Burton:
#45 Authorized Division of Parks and Recreation to enter into an agreement
with Philip and Stephanie Hames, d/b/a: Littleton Commercial Cleaning, Littleton,
NH, as detailed in letter dated December 20, 2002, for daily cleaning of the
Peabody and Brookline Learning Center at Cannon Mountain, not to exceed $8,531.25.
Effective upon G&C approval to March 31, 2003.
FISH AND GAME DEPARTMENT
The Governor and Council acted as follows:
#46 Authorized to accept and expend $239,324 of Federal funds from the Wildlife
Conservation Restoration Act and State wildlife grants, as indicated in letter
dated December 9, 2002, to provide financial support necessary for work to be
done. Effective upon G&C approval through June 30, 2003.
#47 Authorized additions of revenue and expenditure lines to the Wildlife Habitat,
as indicated in letter dated December 30, 2002. (2)Further Authorized to expend
$700,000 to partially reimburse the State of NH's General Fund for the purchase
price of the Natural Area of the Connecticut Lakes Headwaters Tract, for the
acquisition and management.
#48 Authorized to accept and expend an additional $80,000 in federal funds
from the US Fish and Wildlife Service, for use in the construction and development
of the Holderness Hunter Education Center. Effective upon G&C approval through
June 30, 2003.
DEPARTMENT OF ENVIRONMENTAL SERVICES
The Governor and Council acted as follows:
#49 WITHDRAWN - The Governor withdrew the request to budget unallocated Maintenance
of Dams funds in the amount of $78,130.02 for FY03. Funding budgeted as detailed
in letter dated December 2, 2002.
#50 Authorized to expend an amount not to exceed $45,000 from the Dam Maintenance
Fund, to reconstruct a deteriorated culvert and headwalls at the Souhegan Flood
Control Site 8 property in Lyndeborough, NH, on a force account basis, through
June 30, 2003.
#51 WITHDRAWN - The Governor withdrew the request to enter into a retroactive
agreement with Amro Environmental Laboratories Corporation, Merrimack, NH, to
pay for prior fiscal year expenses for biosolids analysis, for the amount of
$16,666. (2)Further Authorized to budget and expend prior year carry forward
funds in the amount of $24,000.50.
#52 WITHDRAWN - The Governor withdrew the request to amend a contract with
H.L. Turner Group Inc., Concord, NH, (previously approved by G&C on 5-23-01,
item #56), for engineering, design and construction services, by $17,375.60
from $94,000 to $111,375.60.
#53 Authorized to retroactively amend a Local Source Water Protection grant
award to the Dover Conservation Commission, Dover, NH, (previously approved
by G&C on 4-11-01, item #59), by extending the completion date to December
31, 2003 from December 31, 2002, due to the underestimated time it would take
to complete the project.
#54 Authorized loan agreement with the Town of Goffstown, NH, for the purpose
of covering additional eligible costs related to the closure of the Town's landfill,
in the amount of $64,498.62. Effective upon G&C approval.
#55 Authorized loan agreement with the Town of Hooksett, NH, for the purpose
of design and construction of improvements to the Town's WWTP including a new
compost facility, in the amount of $3,500,000. Effective upon G&C approval.
#55A Authorized Beacon Cabin LLC's request to construct a ramp with landings
to a float, providing 2 slips on 132' of frontage on property located on the
Piscataqua River in Portsmouth, NH.
#55B Authorized Michael Marsh's request to construct a fixed pier to a ramp
to a float providing two 20' slips on 1000' of frontage on property located
at Great Bay in Greenland, NH.
#55C Authorized change of name request to Mark and Karen Bartlett, Lutherville,
MD, (previously approved by G&C on 11-13-02), to dredge and fill 104 sq
ft within the bank to construct a stairway and two concrete pads to anchor two
seasonal piers connected by seasonal walkway in an "U" configuration,
providing three slips on an average of 201 ft of frontage on property located
at Hermit Cove on Lake Winnipesaukee in Moultonborough, NH.
#55D Authorized Jerome Lemieux's request to construct a pier to a ramp to a
T-shaped float providing 3 slips on 167' of frontage on property located at
Great Bay on the Piscataqua River in Dover, NH.
#55E Authorized Dolosuki Holdings, LLP's request to amend permit to dredge
lakebed and excavate shoreline to construct a dug in boathouse, construct a
crib pier and retaining wall around an existing beach area on an average frontage
on property located at Wolfeboro Neck on Lake Winnipesaukee in Wolfeboro, NH.

DEPARTMENT OF HEALTH AND HUMAN SERVICES
The Governor and Council acted as follows:
#56 Authorized Commissioner's office to reimburse William Wright, Director,
Office of Emergency Preparedness for relocation expenses to move the household
goods from Falls Church VA, to Concord, NH of up to $6,892.79 based upon actual
expenses incurred.
Office of Health Planning & Medicaid
#57 WITHDRAWN - The Governor withdrew the request to enter into a third and
fourth year agreement with the Granite State Independent Living, Concord, NH,
for health planning services in the amount of $770,201. Effective retroactive
to January 1, 2003 through December 31, 2004. Sole Source.
Office of Community & Public Health
#58 Authorized to accept and expend $36,664 in federal funds, as specified in
letter dated December 18, 2002.
#59 WITHDRAWN - The Governor withdrew the request to accept and expend $150,890
in federal funds and continue one Program Planner III, position and establish
one Pharmaceutical Services Specialists position, two Program Specialist IV
positions and two Program Specialist III positions through June 30, 2003, as
specified in letter dated December 18, 2002.
#60 WITHDRAWN - The Governor withdrew the request to accept and expend $788,785
