The Governor and Executive Council convened at 10:00 a.m. with all members being present.

The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Streeter, accepted the minutes of the December 20, 1996 meeting .

The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Griffin, confirmed the appointment of several persons nominated for Civil Commissions from the December 18, 1996 list.

DEPARTMENT OF JUSTICE
The Governor and Executive Council acted as follows:

#2 Authorized salary increase for Lucy C. Hodder, Assistant Attorney General, as a part time employee earning 60% of the salary from Group M, Step 3 ($29,068.80) to Group M, Step 4 ($30,546.60) effective Jan. 26, 1997.

#3 Authorized salary increase for Michael S. DeLucia, Assistant Attorney General, from Group M, Step 4 ($50,911) to Group M, Maximum ($53,373) effective January 10, 1997.

OFFICE OF THE ADJUTANT GENERAL
#4 The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Burton, authorized the telephone poll held on December 20, 1996 which withdrew Captain Nicole Desilets-Bixler as an Aide-de-Camp to the Governor and replaced her with Delbert G. Downing, Major, US Air Force. The results of the telephone poll are as follows:

GOVERNOR'S OFFICE
#5 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, authorized the telephone poll held on December 18, 1996 at 2:00 P.M. which approved the following:

1) Amended the effective date from Effective Upon Confirmation to January 9, 1997 on the confirmation of Douglas Scamman, Director of Administration, Department of Transportation.

2) Approved the naming of the dormitory at the Fire Academy for Dr. Henry "Hank" Munroe. The results of the telephone poll are as follows:

OFFICE OF STATE PLANNING
The Governor and Executive Council acted as follows:

#6 Authorized to amend agreement with Cheshire County by increasing dollar amount by $15,000, from $350,000 to $365,000.

#7 Authorized agreement with the Town of Marlborough at $298,000 as part of the Community Development Block Grant through December 31, 1997.

OFFICE OF THE ADJUTANT GENERAL
#8 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Streeter, authorized the nomination of Captain Christopher E. Conley of Wolfeboro to the rank of Major, NH Army National Guard.

DEPARTMENT OF ADMINISTRATIVE SERVICES
#9 The Governor and Executive Council, on motion of Councilor Griffin, seconded by Councilor Burton, authorized RETROACTIVE lease agreement with Rockingham County, Board of Commissioners in Brentwood for office space at $12,667.19 per month from July 1, 1996 through June 30, 2005 .

RETIREMENT SYSTEM
#10 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Rinker, authorized an appropriation of $8,551.52 to liquidate the balance of accrued compensatory time in excess of available funds.

DEPARTMENT OF CULTURAL AFFAIRS
The Governor and Executive Council acted as follows:

State Library
#11 Authorized contract with Gaylord Information Systems at $18,035 for software and hardware maintenance on the Galaxy Computerized Library System through December 31, 1997. Sole Source.

#12 Authorized to renew lease agreement with the North Country Council, Inc. for office space at $18,000 for the North Country Office through December 31, 1997.

EMPLOYMENT SECURITY
#13 The Governor and Executive Council, on motion of Councilor Griffin, seconded by Councilor Burton, with Councilor Streeter voting NO, authorized RETROACTIVE agreement with Cabletron Systems Inc. at $30,326.56 for computer network equipment maintenance and repair services statewide from October 1, 1996 through June 30, 1997. Sole Source.

BOARD OF ACCOUNTANCY
#14 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, authorized RETROACTIVE agreement for the rental of the NH College Intramural Gym in Manchester on November 6-7, 1996 and May 7-8, 1997 for administering the CPA examination at an estimated $4,500 per exam period.

DEPARTMENT OF CORRECTIONS
#15 The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Burton, authorized to accept a grant of $176,501 from the US Department of Justice entitled "State Criminal Alien Assistance Program FY96" from October 1, 1995 through September 30, 1996 which was awarded on December 5, 1996.

FISH AND GAME DEPARTMENT
The Governor and Executive Council acted as follows:

#16 Authorized Memorandum of Agreement with UNH at $20,000 to continue the "Monitoring Plan for the Great Bay Estuary" through June 30, 1997.

#17 Authorized up to four persons assigned to the Atlantic States Marine Fisheries Commission to travel throughout New England and mid-Atlantic states to attend up to sixteen meetings through March 31, 1997.

#18 Authorized two persons assigned to the New England Fishery management Council to travel throughout New England to attend up to twelve meeting through March 31, 1997.

#19 Authorized up to three Inland Fisheries personnel to travel to Massachusetts and/or Connecticut to attend up to three Connecticut River Atlantic Salmon Commission meetings through March 31, 1997.

#20 Authorized up to four Fisheries personnel to travel throughout the Northeast to pick up fish and/or fish eggs for use in the hatcheries and stocking programs through March 31, 1997.

#21 Authorized up to three Inland Fisheries personnel to travel to Massachusetts to participate in the Cooperative Program to Restore Atlantic Salmon and American Shad to the Merrimack River through March 31, 1997.

DEPARTMENT OF ENVIRONMENTAL SERVICES
#22 The Governor and Executive Council, on motion of Councilor Rinker, seconded by Councilor Burton, authorized to reclassify position of Civil Engineer V, LG 29 to Administrator IV, LG 32.

DEPARTMENT OF SAFETY
The Governor and Executive Council acted as follows:

#23. Authorized to accept $34,708 from the Federal Highway Administration to fund the "Motor Carrier Safety Assistance Program - Traffic Enforcement" through September 30, 1997.

#24 Authorized to accept federal funds of $77,000 from the NH Highway Safety Agency in a grant entitled "Intoxilyzers - Department of Safety" through June 30, 1997.

#25 Authorized to accept federal funds of $5,176.38 from the NH Highway Safety Agency in a grant entitled "Hearings Bureau Computerization" through June 30, 1997.

#26 Authorized to accept federal funds of $5,046.30 from the NH Highway Safety Agency in a grant entitled "School Bus Driver Handbook" through June 30, 1997.

#27 Authorized to accept $6,675 from the Federal Highway Administration to fund the "Motor Carrier Safety Assistance Program - HazMat Training" through September 30, 1997.

#28 Authorized to accept rollover funds of $62,374.33 from the Federal Highway Administration through September 30, 1997.

#29 Authorized agreement with Grounds Care Unlimited of Greenland at $15,750 for snow plowing and related services for the 96/97 and 97/98 winter seasons.

#30 Authorized to extend the Gang Interdiction Program through November 30, 1996.

DEPARTMENT OF TRANSPORTATION
#31 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Spaulding, with Councilor Streeter voting NO, authorized agreement with Samyn-D'Elia Architects of Ashland at $14,500 for renovations to the Ashland Railroad Station. Sole Source.

COMMUNITY TECHNICAL COLLEGE SYSTEM
#32 The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Burton, authorized to extend leave of absence without pay for Melanie Martel from January 6 through May 22, 1997.

#33 TUITION REQUESTS
The Governor and Executive Council approved as follows:

A. COMMUNITY TECHNICAL COLLEGE - Requests permission to pay Rivier College, Nashua NH, the sum of $812.00 for the sole purpose of enrolling Susan Jozitis, Instructor, English/ Reading, in the course entitled Language & Reading: Development, Process & Remediation or Supervision of Instruction .

B. COMMUNITY TECHNICAL COLLEGE - Requests permission to pay UNH, Durham NH, the sum of $900.00 for the sole purpose of enrolling Kevin Barry, Professor, in the course entitled Issues in College Teaching .

    OFFICE OF ENERGY AND COMMUNITY SERVICES
    The Governor and Executive Council acted as follows:

    B. Authorized RETROACTIVE contract with Wilson Educational Services, Inc. of Wallingford CT at $1,500 for educational services in the Savings through Energy Management program from October 23, 1996 through June 30, 1997.

    C. Authorized to amend contract with the NH Association of Broadcasters of Bedford for radio production and air time by increasing the dollar amount by $1,536, from $25,000 to $26,536 through June 30, 1997.

    DEPARTMENT OF JUSTICE
    The Governor and Executive Council acted as follows:

    D. Authorized to grant funds in the total amount of $92,923 to local, county, state and non-profit agencies through June 30, 1998 for projects aimed at violence against women as stated in letter of December 26, 1996.

    E. Authorized to grant funds in the total amount of $162,568 to county and local agencies through June 30, 1998 for drug and violent crime initiatives as stated in letter of December 26, 1996.

    DEPARTMENT OF ADMINISTRATIVE SERVICES
    The Governor and Executive Council acted as follows:

    F. TABLED - The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Burton, with Councilor Rinker voting NO, and Councilor Griffin abstaining, TABLED the Report and Findings of Councilor Earl A. Rinker III with regard to refinancing of existing indebtedness project with the Trustees of Catholic Medical Center in Manchester.

    G. Authorized the Report and Findings of Councilor Raymond S. Burton with regard to refinancing of existing indebtedness project with the Trustees of Kendall at Hanover.

    DEPARTMENT OF ENVIRONMENTAL SERVICES
    The Governor and Executive Council acted as follows:

    H. Authorized tuition agreement with Tufts University at $2,620 for a course entitled "Air Quality Modeling" from January 16 through May 15, 1997 for Mary Ruel.

    I. Authorized tuition agreement with NH Technical College at $261 for a course entitled "CAD-I" from January 14 through April 15, 1997 for Kenneth Judkins.
