The Governor and Executive Council convened at 10:30 a.m., with all members present.

The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, accepted the minutes of December 15, 1999.

The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Streeter, confirmed the appointment of several persons nominated for Civil Commissions from the December 15, 1999 meeting.

#6 Authorized to enter into an Agreement with the Southwest Region Planning Commission, 20 Central Square, 2nd Floor, NH in the amount of $1,000 through December 31, 2000 to provide technical support to the development of Connecticut River Scenic Byway organization and it's communities.

#7 Authorized to enter into an Agreement with Rockingham Planning Commission, 156 Water Street, Exeter, NH in the amount of $36,860.00 through December 31, 2000. The purpose of the project is to recognize, interpret, preserve and promote the unique scenic, cultural and recreational resources along the Byway through the development of a corridor management plan that incorporates a public participation process.

#8 Authorized to enter into an Agreement with the Town of Stewartstown, NH in the amount of $350,000.00 through June 30, 2001. The funds for this contract are from the Community Development Block Grant Fund and the Town will use the grant to rehabilitate 29 residential housing units occupied by low and moderate households, located told the a town-wide basis.

#9 Authorized to enter into an Agreement with the Coos County, NH in the amount of $500,000.00 through June 30, 2001. The funds for this contract are from the Community Development Block Grant Fund and the County will use CDBG funds to implement infra-structure improvements in the North Woods Cooperative Park.

#10 Authorized to enter into an Agreement with the City of Lebanon, NH in the amount of $500,000.00 through June 30, 2001. The funds for this contract are from the Community Development Block Grant Fund and the grant will allow the City to assist Twin Pines Housing Trust, 85 South Main Housing, LLC with the acquisition and rehabilitation of twenty residential units located in downtown Lebanon to be occupied by low and moderate income households.

#11 Authorized to enter into an Agreement with the Town of Conway, NH in the amount of $250,000.00 through June 30, 2001. The funds for this contract are from the Community Development Block Grant Fund and the Town will use the CDBG funds for the purpose of renovating and expanding of the Gibson Center for Senior Services, Inc.

#12 Authorized to enter into an Agreement with the Town of Newmarket, NH [Initially approved told the February 3, 1999 (Item #4)], by extending the completion date from December 31, 1999 to June 30, 2000. No additional state for federal funds are required by this action.

#13 Authorized to AMEND an existing Agreement with the Town of Brentwood, NH [Initially approved told the June 25, 1997 (Item #25)], to extend the time period to complete the project from December 31, 1999 to June 30, 2000. No additional state or federal funds are required by this action.

#14 Authorized to AMEND an existing Agreement with the Town of Newport, NH [Initially approved told the June 24, 1998 (Agenda 12)], by extending the completion date from December 31, 1999 to June 30, 2000. No additional state or federal funds are required by this action.

#15 Authorized to AMEND an existing Agreement with the Town of Farmington, NH [Initially approved told the October 8, 1997 (Item #13)], to extend the time period to complete the project from December 31, 1999 to December 31, 2000. No additional state or federal funds are required by this action.

OFFICE OF EMERGENCY MANAGEMENT

#16 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, authorized to lease a passenger vehicle from General Motors Acceptance Corporation as supplied by Wyman's Chevrolet-Pontiac of Hillsborough, NH for a period of 4 years from National Flood Insurance Program funds provided from the Federal Emergency Management Agency. The cost of leasing the vehicle is $432.62 per month for a total four-year lease price of $20,765.76.

GOVERNOR'S OFFICE OF ENERGY AND COMMUNITY SERVICES

#17 Authorized to enter into a contract in an amount not to exceed $57,000 with James K. Rogers, P.E., through January 31, 2001 to assist with the implementation of the Governor's Building Energy Conservation Initiative as outlined in the contract.

#18 Authorized to enter into a contract in an amount not to exceed $6,000 with Sunweaver Energy Enterprises, Northwood, NH through December 31, 2000 to assist with funding for the construction of a solar electric system at it's Northwood headquarters and showroom and for accompanying educational materials.

The Governor and Executive Council acted as follows:

ADJUTANT GENERAL

#19 Authorized the nomination of Major Peter F. Sullivan, Jr., 7 Coffin Drive, Hampton, NH to the rank of Lieutenant Colonel, New Hampshire Air National Guard.

#20 Authorized to enter into a Military Cooperative Construction Agreement with modification #P00001 both dated 15 December 1999 with the federal government (National Guard Bureau) for the design and construction of the Army Aviation Support Facility, Project #330028, Concord, NH. This agreement will become effective when approved by the Governor and Executive Council and remain in effect until 25 years from the acceptance by the State of the finished facility. (2) Authorized to accept and spend $932,077.00 from the federal government (National Guard Bureau) for the first phase of the design of the AASF. (3) Authorized to enter into a contract with SEA Consultants, Inc., 485 Massachusetts Ave., Cambridge, MA at a cost of $917,077.00 through June 30, 2000 for the first phase of the design of the AASF. The cost of this contract shall be reimbursed to the State by the Federal Government at the rate of 100%. (4) Authorized to expend up to $15,000.00 to pay for engineering services provided by the New Hampshire Department of Transportation, Bureau of Public Works until completion of the construction. The costs shall be reimbursed to the State by the Federal Government at the rate of 100%.

NEW HAMPSHIRE STATE VETERANS CEMETERY

#21 Authorized to accept and expend monetary contributions in the amount of $716.50 for the New Hampshire State Veterans Cemetery to be used for the betterment of the cemetery. These donations were received during the period October 1, 1999 through November 30, 1999.

#22 Authorized to accept material donations in the estimated amount of $841.00 for the New Hampshire State Veterans Cemetery to be used for the betterment of the cemetery as specified in letter of November 30, 1999. DEPARTMENT OF ADMINISTRATIVE SERVICES

The Governor and Executive Council acted as follows:

#23 Authorized Bureau of General Services to pay Utility Service & Assistance, Inc., Auburn, NH $10,944.78 for emergency electrical repairs that were performed at the State House Annex between July 22, 1999 and August 6, 1999.

#24 Authorized Bureau of Court Facilities to enter into the RETROACTIVE lease agreement for a term of one year as a tenant-at-will (1/1/00-12/31/00 with Carroll County, PO Box 152, Ossipee, NH. The rental amount for the 12 month term is $15,851.76. (2) Authorized to waive compliance with RSA 10-B to test indoor air quality in this facility due to the non- budgeted financial burden imposed told the Town/State to obtain a clean air certificate.

TREASURY DEPARTMENT

#25 The Governor and Executive Council, on motion of Councilor Streeter, seconded by Councilor Burton, authorized to issue a warrant from funds not otherwise appropriated and the State Treasurer to issue check in the amount of $11,946.81 as specified in letter of December 22, 1999.

ATTORNEY GENERAL

#26 Authorized Department of Justice to RETROACTIVELY AMEND a grant award of $103,966 with Carroll County Mediator Services to change the effective date from December 1, 1999 to October 1, 1999. [Initially approved on December 1, 1999 (Item #43)].

#27 Authorized a salary increment of $1,597.80 to Suzan M. Lehmann, Assistant Attorney General (Position #9U350, effective January 22, 2000.

The Governor and Executive Council acted as follows:

DEPARTMENT OF REVENUE ADMINISTRATION

#28 Authorized to enter into a contract with optional one year renewals for an additional three years, with MDI Associates, LLC d/b/a New England Property Evaluation Specialists in an amount not to exceed $154,256 through July 31, 2002 for consultation services related to the design of procedures, support, training, models, software development, documentation, and enhancements for the department's system of appraising utility assets.

#29 Authorized to accept and place on file the 1999 Annual Report of the Department of Revenue Administration.

EMPLOYMENT SECURITY

#30 Authorized to have an additional $346,850.00 of federal funds [Initially approved on February 17, 1999 (Item #34) to be budgeted by the Director, Division of Accounting Services as specified in letter of December 22, 1999.

#31 Authorized to enter into an agreements and AMENDED agreements with other NH State Agencies, Rockingham Community Action, and NH Job Training Council in varying amounts not to exceed $77,000.00 in total for services to be provided in support of NHES's One-Stop Career Center Implementation Grant Award from the US Department of Labor.

#32 Authorized to enter into an AMENDED Memorandum of Understanding with the New Hampshire Job Training Council in the additional amount of $4,500.00 for a new total amount of $49,669.00 and to extend the end date from June 30, 2000 to December 31, 2000 for services related to assisting the State of NH in the planning and implementation of the Workforce Investment Act including the continued implementation and expansion of the One-Stop System.

#33 The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, with Councilor Streeter voting NO, authorized to enter into an AMENDED maintenance and support service agreement with Computer Generated Solutions, Inc. in the amount of $77,600.00 for a total of $227,600.00 through June 30, 2000 for maintenance and support services for the New Hampshire Accounting Contributions Tax System at NHES. SOLE SOURCE

LIQUOR COMMISSION

#34 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Streeter, authorized to utilize the banking services of Mascoma Savings, PO Box 1917, New London, NH as the depository of funds for the New Hampshire State Liquor Store #64, PO Box 464, New London, NH.

The Governor and Executive Council acted as follows:

HIGHWAY SAFETY

#35 Authorized to accept and expend an additional $1,295.00 in Federal Section 402 funds for planning and administration from the National Highway Traffic Safety Administration.

#36 Authorized to enter into an agreement with the Safety & Health Council of New Hampshire in the amount of $10,626.00 through September 30, 2000 to conduct the "Operational Lifesaver" public relations and education campaign.

#37 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Colantuono, with Councilor Streeter voting NO, authorized to enter into an agreement with the Safety & Health Council of New Hampshire in the amount of $4,600.00 through September 30, 2000 to serve as the coordinating agency for the New Hampshire Network of Employers for Traffic Safety. SOLE SOURCE

The Governor and Executive Council acted as follows:

DEPARTMENT OF CORRECTIONS

#38 Authorized to accept and expend a grant in the amount of $799.99 from the March of Dimes of New Hampshire Chapter through June 30, 2000. The objective of the Family Resource Center at the Lakes Region Facility is to educate 500 inmates-450 men and 50 women-about all aspects of pregnancy.

#39 Authorized to add Elizabeth A. Jones, DDS 17 Rangeway Road, Mont Vernon, NH the list of Dental Consultants.

#40 Authorized to accept donations of various sewing materials and notions with a total value of $4,368. The donations were made from October 1, 1999 to November 30, 1999 from various individuals specified in letter of December 20, 1999

#40A Authorized to pay $207,000 in overtime for permanent personal services out of salaries for vacant positions due to extended sick leave and pending recruitment for the period July 1, 1999 through November 30, 1999. Funds have been expanded from overtime accounts at a greater rate than anticipated and permission to transfer expenditures back to permanent personal services is requested.

DEPARTMENT OF RESOURCES AND ECONOMIC DEVELOPMENT

#41 Authorized Division of Parks and Recreation to accept and expend a $450.00 donation received for the State Park Benches program as follows: Dr. Maurice Dinneman, TTEE, Portsmouth, NH-$150.; Carol & Jerry Haines, Foxboro, MA-$150.; Evelyn Thornton, Hampton, NH-$150.

#42 Authorized Division of Parks and Recreation, Bureau of Trails to AMEND the current service agreement with Lee Waterhouse, Woodville, NH, for rail trail mowing. [Initially approved on October 27, 1999 (Item #61]. The amendment amount is not to exceed $2,100.00, bringing the total contract amount of $8,700.00.

#43 Authorized Division of Parks and Recreation to AMEND the current service agreement with Waste Management of NH-New Hampton, for rubbish removal at Wellington State Park. [Initially approved on June 22,1999 (Item #113A). The term of this amendment is from Governor and Executive Council approval through June 30, 2000. The amendment amount is $216.00, bringing the total contract to $1,080.00.

#43A Authorized to extend the completion date of a Memorandum of Agreement between the Department and the Department of Environmental Services to accomplish coordinated research regarding New Hampshire floodplain forests and development of improved Geographic Information System database layers. The current completion date is September 30, 1999; the AMENDED completion date is April 30, 2000.

FISH AND GAME DEPARTMENT

#44 Authorized to accept a $5,000 donation from the National Rifle Association and place into the Holderness Hunter Education Center Account.

#45 Authorized to issue payment in the amount of $2,529.00 from the Fish and Game Reserve Fund to Alyson's Orchard, Inc. for damage to apple trees sustained during April and May of 1998.

#46 Authorized to accept the donation of an easement on 0.48 acres of land on the Suncook River in Pittsfield, New Hampshire from the Pittsfield School District.

The Governor and Executive Council acted as follows:

DEPARTMENT OF ENVIRONMENTAL SERVICES

#47 Authorized Waste Management Division to budget unallocated funds in the amount of $160,000 through June 30, 2000 to the Oil Pollution Control Fund, for the purpose of budgeting expenditures to support development of an Incident Command Center for coastal oil spills, purchase supplies for the containment and cleanup of coastal oil spills, and to adjust for anticipated shortfalls for emergency response expendable materials.

#48 Authorized to accept an additional $11,011,000 in federal funds from the US Environmental Protection Agency for the State Revolving Fund Program through June 30, 2000.

#49 Authorized to accept a grant in the amount of $27,828 from the Federal Emergency Management Agency, through September 30, 2000.

#50 Authorized to accept $116,950 in Federal funds from the US Environmental Protection Agency for the Brownfields Cleanup Revolving Loan Fund Program, through June 30, 2001.

#51 The Governor and Executive Council, on motion of Councilor Griffin, seconded by Councilor Burton, with Councilors Colantuono and Streeter voting NO, authorized to enter into a RETROACTIVE contract with Freese Properties, Inc., d/b/a Trailer Tom's, 16 Clark Street, Pittsfield, NH in the amount of $7,500.00 retroactive to August 1, 1999 to March 31, 2000. This is a rental contract for 13 trailers that have been used to store furniture temporarily during the course of the office consolidation a 6 Hazen Drive in Concord. SOLE SOURCE

#52 The Governor and Executive Council, on motion of Councilor Griffin, seconded by Councilor Burton, with Councilor Streeter voting NO, authorized to enter into a one-year contract with the New Hampshire Association of Broadcasters in the amount of $68,918 to produce and air radio and television non-commercial sustaining announcements dedicated to transportation-related air quality issues through the state through December 31, 2000. #73 AMENDED-The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Griffin, voted to RETROACTIVELY AMEND the request to offer a salary enhancement for recruitment and retention purposes for all professional nursing classifications or classifications which require the designation of Licensed Practical Nurse (LPN) at the New Hampshire Veterans Home. This increase is to be effective upon Governor and Council approval for a period not to exceed two-years at an estimated annual cost of $33,666 for 13 positions. This amendment retroactively changes the effective date to September 18, 1999.

#74 The Governor and Executive Council, on motion of Councilor Burton, seconded by Councilor Griffin, with Councilor Streeter voting NO, authorized to enter into a contract with Long Term Care Network, 4001 International Parkway, Carrollton, Texas in the amount of $18,353.00. A. NH COMMUNITY TECHNICAL COLLEGE SYSTEM
The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, authorized on behalf of the office of the Governor, to RETROACTIVELY enter into an agreement with New Hampshire Job Training Private Industry Council, Inc., (NHPIC) to carry out the duties and responsibilities as the administering entity as detailed in the Job Training Partnership Act and for other such state and federal programs that complement the Act.

B. NH COMMUNITY TECHNICAL COLLEGE SYSTEM
The Governor and Executive Council, on motion of Councilor Spaulding, seconded by Councilor Burton, authorized, to RETROACIVELY extend the program period for the School of Work Opportunities Grant #U-5596-5-00-60 as funded by the NH Dept. of Education, from December 31, 1999 to June 30, 2000.

The Governor set the next meeting of Governor and Executive Council for Wednesday, January, 19, 2000 at 10:30 a.m. at the State House, Concord, New Hampshire.
